fax by e-mail . . Rent the city's rent ordinance sets out specific provisions that are applicable to properties with 5 or more units. This section of the ordinance includes: the time that tenants should pay rent, fees and fines; the fees that should apply to the total amount owed by the tenant; and the methods of dispute resolution or dispute resolution proceedings applicable to the total amount owed by the tenant. The city also provides guidance on the maximum length of time a tenant can stay in any location that is subject to rent control. The maximum lease term for a property with 5 or more units includes a period of one year, during which a tenant is required to pay the rent for the property on time and any amount for other costs and obligations required or imposed by the laws or regulations of the city. Note that in most cases, the city's rent ordinance also does not apply to single family homes (SFH) and townhomes. See page 23 of the rent ordinance for more information on this subject. A tenant must pay rent for his or her entire occupancy of the property on or before the expiration date of a tenancy agreement (see page 12 of the rent ordinance). If an apartment building has ten units, or more than 50 units if the building has at least four or five levels of basement apartments, then there must be at least one unit that is occupied daily by tenants and that meets all minimum lease requirements, including the payment of rent, fees and fines. A unit that is not occupied by tenants at all is called “uninhabitable" and may be subject to rent control. The city may also require monthly payments for the unit to be made, such as rent checks. If a unit is under construction, then a tenant who is occupying it should file a motion to vacate with the rent officer. This motion must be in order between the time that the developer files a building permit to construct the building and the time that the tenant begins to occupy the unit; otherwise, the developer may be required to pay rent to the landlord for the tenant's share of construction costs. There is a three-day notice provided for in the rent ordinance for such motions (although it is usually not possible to serve such a notice in small claims court). The rent officer will review all of the landlord's records to determine whether the premises are subject to rent control;
