This motion must be in order between the time that the developer files a building permit to construct the building and the time that the tenant begins to occupy the unit; otherwise, the developer may be required to pay rent to the landlord for the tenant's share of construction costs. There is a three-day notice provided for in the rent ordinance for such motions (although it is usually not possible to serve such a notice in small claims court). The rent officer will review all of the landlord's records to determine whether the premises are subject to rent control;
