Neither party in this cause has filed, or is likely to file, a motion for summary judgment that would be successful in removing this cause from the trial docket, and no motion is anticipated that would dispose of this cause as a matter of law. 11. There is no issue of law that would prevent either party from reaching a fair and negotiated settlement of the issues in this cause.
