IN THE CIRCUIT COURT OF_________ COUNTY, ____________ NAME OF PLAINTIFF ) ) ) V. ) NO. ) ) NAME OF DEFENDANT ) ) ) PRETRIAL INTERVENTION AGREEMENT The Defendant, ______________________, having made written application for acceptance into the Pretrial Intervention Program of the Seventeenth Circuit Court Di strict of the State of __________, and said application having been considered by the District Attorney's Office, the District Attorney finds as follows: (a) The offender is eighteen (18) years of age or older; (b) There is substantial likelihood that justice will be served in the offender is pl ace in a intervention program; (c) It is determined that the needs of the offender and the State can bette r be met outside the traditional criminal justice process; (d) It is apparent that the offender poses no threat to the community; (e) It appears that the offender is unlikely to be involved in further criminal activity; (f) The offender has no significant history of prior delinquency or criminal activity. THEREFORE, the offender, __________________________, is accepted into the Pretrial Intervention Program of the Twentieth Circuit Court District, State of __________, for a -2- period of ____________________ years(s) under the following terms and conditions:1.) Offender shall hereafter commit no offense against the laws of this or any other state of the United States, or of the United States; 2.) Offender shall avoid injurious or vicious habits; 3.) Offender shall avoid persons or places of disreputable or harmful character; 4.) Offender shall work faithfully at suitable employment so far as possible; 5.) Offender shall remain within the State of __________ unless authorized to leave on proper application therefor; 6.) Offender shall support his/her dependents, if any; 7.) Offender hereby agrees to waive extradition to the State of __________ from any jurisdiction in or outside the United States where he/she may be found and also agrees not to contest any effort by any jurisdiction to return him/her to the State of __________; 8.) Offender hereby agrees to waive any right to a speedy trial as guaranteed by the United States Constitution, the Constitution of the State of __________, and all statutes of the State of __________ pertaining to any right to a speedy trial; 9.) Offender agrees to submit to any type of breath, saliva or urine chemical analysis test, the purpose of which is to detect the possible presence of alcohol or a substance prohibi ted or controlled by any law of the State of __________ or the United States. Offender shall pay all costs in connection with said tests. 10.) Offender agrees to the tolling of all periods of limitation of prosecution established by statutes or rules of Court; 11.) Offender shall report to the Intervention Program Officer on the 2nd Saturday of each month and/or any other time as directed; -3- 12.) Offender agrees to pay to the Office of the District Attorney the sum of $30.00 per month for administration of this program; 13.) Offender agrees to pay all costs of Court. 14.) All amounts payable pursuant to this Agreement shall be made directly to the Pretrial Intervention Program Officer. 17.) THESE HOURS WILL BE WORKED AT THE RATE OF EIGHT (8) HOURS PER WEEK FOR TWELVE (12) CONSECUTIVE WEEKS. The offender hereby releases the State of __________ and the County for which the community service work is performed from all responsibility and liability for any injuries which may be incurred during his participat ion in this program. 18.) At the discretion of the Pretrial Intervention Officer, the Offender must participate in Project Aware administered by the __________ Department of Corrections. 19.) The Offender agrees and understands that if he/she should violate any of the above conditions: (a) the District Attorney may terminate his participation in the progra m; (b) the Waiver of the right to a speedy trial and the tolling of the periods of limitat ion of prosecution established by statutes and/or rules of Court shall be void; and (c) prosecution of crimi nal charges pending against the Offender shall be resumed by the District Attorney.
