A disclosure is unwarrante d if it is done either recklessly or malic ious ly a nd is not in the best interest of the child. Unwarranted Disclosure of the Report • Monetary Sanctions: If the court determi nes that an unwarranted discl osure of a written confidenti al report has been made, the court may order a fine against the disclos ing party in an amou nt th at is large enough to prevent that perso n from disclosin g informat ion in the future. • Attorney Fees and Costs: The sanction may also include rea sonable attorney fees, cos ts inc urred, or both, Potential Consequences for the Unwa rranted Disclosure of the Report By law, the court can impose a penalty for the unwarrante d disclosure of the child custody evalua tion report.
