- 1 - PREMARITAL AGREEMENT READ BEFORE SIGNING: IMPORTANT NOTICE: EACH PARTY TO THIS AGREEMENT AGREES THAT THEY HAVE HAD AN OPPORTUNITY TO CONSULT WITH AN ATTORNEY OF THEIR CHOICE LICENSED TO PRACTICE LAW IN THEIR STATE OF RESIDENCE (NOT THE SAME ATTORNEY) AND THAT HAVE FULLY READ, UNDERSTAND AND AGREE TO THE TERMS OF THIS AGREEMENT. EACH PARTY FURTHER AGREES THAT THEY ARE NOT ACTING UNDER DURESS OR UNDUE INFLUENCE IN EXECUTING THIS AGREEMENT AND THAT EXECUTION OF SAME IS DONE FREELY AND VOLUNTARILY. THIS AGREEMENT, made this ____ day of ________________, 20____, between ___________________________ (Name), of ______________________________ (Address), _____________ (State) ("first party or Wife"), and _____________________ (Name), of ____________________________ (Address), _____________ (State) ("second party or Husband"), W I T N E S S E T H WHEREAS, Husband (check all that apply): has previously been married; has a child or children; has not been married; and Wife (check all that apply): has previously been married; has a child or children; has not been married. The parties desire to enter into this agreement prior to their contemplated marriage. WHEREAS, the parties hereto have accumulated separate estates; and WHEREAS, the parties are about to contract marriage and execute this agreement in contemplation of marriage to be effective upon their marriage in accordance with the laws of the State of Mississippi, including any Uniform Premarital Agreement Act, or other applicable laws, adopted by the State of Mississippi; and WHEREAS, the parties desire to enter into an agreement regarding certain properties, responsibilities, duties and obligations including but not limited to any interest, present or future,
(check all that apply) with respect to: assets; debts; real and personal property; life interests property; annuities; securities; insurance; services; annuities payments; benefits; and any other property or income of any nature whatsoever from, or any relationship with any person or from any company or entity. The parties desire to enter into this agreement prior to their contemplated marriage. Wherever and to whom this agreement is made, each party or wife will execute this agreement personally and at their own expense. Each party or husband in the event he has not previously been married to wife or both in the event he wishes to be married to wife prior to the execution of this agreement he must first obtain his wife's prior written consent and sign the contract in order for the contract to become effective prior to the marriage in which case each party or husband will not execute this agreement for the first time until and unless he has obtained s u r e y consent for that purpose from wife or both. This agreement is made in reliance solely on the following written representations made before : signed before: date , by and within my right and full power: (name, address, date) at (name, address, signature) , which representations I acknowledge as true, correct, and complete as of, (2 months prior to execution of this agreement in which case date is 2 months before the date of the foregoing written representation for purposes of section (3) of section 5-202 of the uniform consumer credit code). I hereby acknowledge that such signature and oath to the foregoing statements constitute an express acknowledgement of my willingness to sign this agreement at such time as it is properly executed and that I understand and agree to such execution. I further acknowledge that this contract is intended to be executed between (2 of (name of 2) and (name of 1) and that i am legally competent to do so in this state. And if at any time this agreement has not been executed, for any reason to my knowledge or in any manner whatsoever except through marriage, it is null and void, and I acknowledge that the same does not constitute an agreement, written or oral, between (this person) and himself that is enforceable in any court of law or jurisdiction in this state unless executed by this person in this state prior to the date of such execution. Each party will reimburse the other party for any and all attorneys.
