- 1 - CONSTRUCTION CONTRACT THIS CONSTRUCTION CONTRACT (“Contract”), effective as of the date of the last party to sign below, is between , having an address at ("Contractor") and , having an address at ("Owner"). For valuable consideration the parties hereby agree as follows: 1. SCOPE OF WORK: Contractor shall provide all labor and materials, and perform all work necessary for the completion of the residence, structure, or improvements as described in the drawings and specifications signed by both Owner and Contractor (“Project”) and more particularly described as Such drawings and specifications are hereby made a part of this Contract. Drawings and specifications shall contain a scale drawing showing the shape, size, and dimensions of the construction and equipment together with a description of the work to be done, materials to be used, and the equipment to be used or installed. 2. WORK SITE: The Project shall be constructed on the property of Owner located at (“Property”) and more particularly described as (hereafter "the Work Site"). Owner hereby authorizes Contractor to commence and complete the usual and customary excavation and grading on the Work Site as may be required in the judgment of the Contractor to complete the Project. Unless called for in the drawings or specifications, no landscaping, finish grading, filling or excavation is to be performed at the Work Site by the Contractor. 3. TIME OF COMPLETION: Contractor shall commence the work to be performed under this Contract on or before and shall substantially complete the work on or before . Contractor shall not be liable for any delay due to circumstances beyond its control including strikes, casualty, acts of God, illness, injury, or general unavailability of materials. 4. PERMITS: Contractor shall apply for and obtain such permits and regulatory approvals as may be required by the local municipal/county government, the cost thereof shall be included as part of the
Price payable by contractor. 5. Insurance and bonding: the contractor, for its own protection and for that of the owner/lender, shall provide all insurance and bond(s) required by law. The required insurance or bond(s) shall be provided by and at the expense of the owner. If it has a bank account or credit union account, contractor shall maintain a sufficient level of insurance and a full bond in the amount of 50 percent of the final work price to any policyholder which becomes injured by the construction or equipment installed on or about the construction project in accordance with all requirements of law. The other 50 percent (“25%) of the required insurance or bond(s) shall be provided by and at the expense of the lender (“owner” for lender's protection), this bond shall satisfy all losses. For insured projects the lender shall be bound by these insurance contracts. The lender shall be required by law to furnish the contract and any further information required in the event any borrower who was insured is in default of the loan and a failure to provide such information is discovered after the contract has been accepted by the contractor, and the borrower defaults and the insurance or bond(s) are not provided. 6. Insurance: contractor shall provide for sufficient liability insurance to cover construction, accident, or liability incident of its construction activities and shall make available a full bond with adequate collateral sufficient to cover the cost of insurance, indemnification costs, and a cash payout not less than the total contract price including labor and materials as determined in the contract. 7. Warranty: in reliance upon and upon the representation and warranty made by contractor hereunder, the purchaser agrees that the work performed by contractor shall meet the generally accepted quality and craftsmanship standards of contractors of the type and reputation for which the same is regularly inspected and approved in local market. 8. Representation: buyer hereby expressly agrees that contractor shall not be responsible for any incidental or consequential damages which result from contractor's failure to abide by the terms of this contract or from such construction failure in the event of damage to the structure due to the negligence or negligent acts of the purchaser of the project, or to any animal as defined in section 11-61-5(a)(11) of the state environmental control act, (“owner”) or to any structure, material, or equipment, (“project”), while the work is being performed under this contract, by the seller of the project, or its authorized representatives, unless the damages are as a result
