many questions every day that we have seen this uh question that do you have a job offer and I have a job offer with me so can I uh Mark in yes and I claim the additional 50 or 200 points or not or what are the criterias uh for the job offer to be valid to give me these additional points which could increase my CRS score so if you want to know that whether you can claim this job offer or not for additional CRS points then this video is for you thank you so before starting the video uh let me introduce you I am Neha bhalla a regulated Canadian immigration consultant and our company stands Global immigration update from Mrs Saga in Ontario now without wasting any time let's start with our video so uh talking about this job offer first of all all job offers are not eligible to give you these additional 50 or 200 points so basically to claim these additional points that is either 50 point or the 200 points depending upon the knock so to claim these points uh it is necessary that the job offer which you have is a qualifying job offer not just a job offer but a qualifying job offer and that too for an arranged employment so now let's dig into first of all the points thing whether you will get 50 points or 200 points depending upon what criteria so uh talking about the points uh if you have a high skilled job uh under the old knock that was OAB or under the new tier system or zero one two or three then only you may qualify for these uh points and 200 points are only for the senior management positions that is the zero zero code jobs so only if you are in a senior managerial role then only you can claim 200 points otherwise the normal 50 points for all other uh High skill jobs basically now now we know that either 50 points or 200 whatever points it is it will definitely increase your CRS that is your comprehensive ranking score while creating your Express entry profile but now let's talk about what kind of job offer is acceptable what is basically a qualifying job offer which can give you these additional points so in order uh for a qualifying job basically what an employer needs is a positive lmia so lmia is basically a document that employer the employer not you the employer often needs when uh he needs to hire an employee that is basically a foreign employee right or a foreign worker he needs to iron for that uh he needs to get a positive lmia first from the esdc so when he gets this positive lmia which shows that he is in actually in need of a foreign worker who is not present right now in Canada as a PR or a citizen and he needs a foreign worker then he gets a positive lmia and when a positive lmia is issued so that is the kind of job you need a job basically in most of the cases there are certain exceptions that we'll discuss but in majority of the cases a job or for points you can claim when it is uh you know in majority of the cases followed by a positive LMI so an lmia based job offers in the required in majority of the cases but there are certain occupations certain Works which are lmia Exempted so in these exceptions LMI is not required but in majority of the cases a job offer has to be supported by an LMI so the most important criteria which people Miss is this only that in order to get the CRS points to increase your CRS points and obtaining these 50 or 200 points your job offer needs to be either supported by lmia or it should fall under the category of LMI exam jobs many people come to me or who are working you know on post graduate work permit so they came to Canada earlier as a student now they have the postgraduate work permit basically post graduate work permit what it is it is an open work permit it's not supported by any LMI here so they are on that open work permit and they have a job offer from their employer so they they asked me can I claim these 50 points because I my employer is giving me a job offer so although your employer might be giving you a job offer but he has not done LMI in this case he has not gone through the complete lmia process which includes the advertisements from the side of employer then he has to take certain permissions he has to apply to the esdc so he has not undergone all these steps so he does not have a positive lmia for your job offer so in this case you will not be able to claim points for this job although having an open work permit working on PGT pgwp itself is beneficial it does give you points in different way right like for having Canadian work experience you get additional points you studied in Canada you get additional points but for this particular question that you have a job offer for this particular question you cannot claim points so if you want to claim those 50 points you need to have an LMI supported job offer and yes one more exception apart from occupations which are lmia exempt one more exception in this case is for the intra company transferies so uh if you are in uh if you were working somewhere so if you are in Canada working as a under ICT work comment that is the intra company transferee then yes it could be possible that you could claim those 50 points but there are certain conditions before that so the first one is that you should have an lmia exempt work permit which is true in case of ICT because ICT intra company transferies are on lmia exempt work permit only so this condition is fulfilled in your case and the second uh criteria is that now you should have worked for at least one year with that same employer in Canada so at least one year experience with that same employer uh under which you are working for the ICT so after fulfilling these two conditions one was that you should be on an LMI exempt work permit which is true because you are under ICT and the second one now you have worked for one year in Canada with this employer under ICT these two criterias fulfill now the the third and the final criteria is that when you uh fill this expression reform and the question is asked whether you have a job offer you can say yes you can claim this 50 points but to prove this you will need a new job offer letter from your employer so at the time when you are you get the ID and you submit the documents you will ask for this job offer so you have to submit a fresh job offer from your letter we'll drop off a letter from your this the same employer for whom you are working under ICT and this job offer also have certain criterias which mentions your like salary which mentions the hours or duration of ours you are working from them very important mandatory condition is that on your job of a letter the employer should mention that at the time you will get the permanent residence even after that you are employed will be hiring you he will you will be working with the same employer for at least one year after you get your permanent residency so this is a very important criteria so if all these three criterias are fulfilled then yes under ICT you can claim these 50 points so only under this situation you can heal otherwise for all other occupations uh if you are on dgwp you cannot claim only for job offers which are supported by lmia or either for occupations which are lmia exempt or in the case which I explained you where uh you should have an lmi-exempt work permit so only under these scenarios you can claim 50 points or the 200 points for your job offer one more important thing don't forget that if you claim these 50 points if you suppose you are on pgwp and while creating your Express and profile you said yes I have a job offer and because of these 50 points your CRS scores increased and you met the cutoff now you get the invitation to apply and now uh they're asking for the documentation and you give the normal job offer letter in the documentation without an lmia so obviously your application will be refused because this is not acceptable job offer but apart from refusal it might be it depends upon the Visa officer who is working on your file they might treat it as a misrepresentation right and misrepresentation can lead to a ban of five years so please be careful and always take advice from legal
