good morning everyone welcome back to my channel so today i was reading the newspaper and i found an interesting article about a high court of gujarat has given a verdict saying that just because the patient has signed a agreement with you before the surgery it doesn't mean that the doctor can be reckless reckless in the sense he cannot be negligent so we are in a situation where we are seeing a lot of medical abnormalities and we are also seeing a lot of rise in the medical cases uh especially after covet and it's really a sensitive time to talk about this and making this video i don't mean any disrespect to any doctors but then again this video is really about awareness okay so ah i hope you all treat it in that way so let me explain ah what is negligency so negligency of any service is a taught okay so it's basically what what a start means start is a civil suit where if any if any person thinks that he's he has paid for something and he has not got the adequate service then he can claim for damages same goes with the medical professional also but the problem is medical profession is more sensitive because it involves a life of a person and it can cause severe impairment or disability to a person so that doesn't come under thought not all the cases come under thought so ah if there is a severe impairment or if there is a disability causing due to ah medical negligence and if there is even death due to medical negligence it comes under ipc okay so i am going to list down the just look at the side so i am going to list down what are the imprisonment so if there is any death occurring due to medical negligency it is culpable homicide okay so that means it's it's not it's it's a criminal offense and there will be a jail term along with the damages okay and and there might be suspension of the doctor's license for a specific period of time as per the regulations of the of the all india medical council so these are the regulations we have so many times what happens is um general people they do not know about this and they just think that oh i suffered um medical negligence but i have already signed the agreement before getting into the treatment where in that it says that there are risk of this this this risk of even death that doesn't amount to um that doesn't amount to the negligence on part of the doctor if the doctor is is like not mitigating the risk or if he is doing nothing to lessen the risk and to save the patient or if is casual about it or negligent about it then you can definitely file a suit in court of law so this is just an awareness i thought everybody should know about this so that's the reason why i'm making this video i'm also clipping this article which i found and make sure you pause it and you read the article and i hope i added some value today for you and keep subscribe thank you bye
