hello again and welcome back to my course uh this section is about tenancy agreements and i want to clarify a little bit your options in terms of tenancy agreements yes so first type of tenancy agreement is a standard short whole tenancy agreement now this agreement usually is signed for a whole year you sign the agreement with the tenant for a year but they have a fixed term of six months and there's usually a breaking clause after six months so this agreement is done for rooms so usually people renting a room they rent it for a whole year but they have the option after six months to move out yeah so there's a breaking close after six months they can't move out earlier than that because they will have to you can charge them penalties you can charge them the whole rent um you just have to follow it and and it's it's a bit of headache but you would have a legal ground to chase them if they move out before six months also you are not allowed to evict them before the six months you can't give them notice um because they have to stay there for at least six months okay and after six months um then the the agreement is still is still on until the end of the year once this agreement is finished it doesn't mean that the tenant no longer have a contract with you it just means that it moves to a rolling monthly contract so once the agreement expires after the first 12 months you have two options you can either renew the agreement and get them get them to commit for another six months another year to six months or you can just leave the agreement like that so for example if you are working with agents um it's not ideal but if you are working with agents or they're charging you for for the tenancy agreement it's okay if you don't renew it it just means that you're moving to a rolling monthly contract so it means that they pay you the rent every month as before but um they just um yeah it's still valid okay what i suggest is for you to have your own agreement i will attach a tenancy agreement for a room rental to this section because you are going to need it and because you purchased this course you can um you can use the tenancy agreement for a room rental i will also show you in a future section how to do an inventory and everything else that you need to do before a tenant moves in and what you need to give him when he moves in the property but for now we're going to move on to the next section so the next section is periodic tenancy agreements now periodic tenancy agreements can be on a weekly basis on a monthly basis on a six-month basis however you you want or however you agree with the tenant yeah so maybe a tenant just wants to rent a room from you on a weekly basis because they're not sure how how secure their job is and if they need to move or not okay in this uh in this case if they're renting on a weekly basis theoretically they have to give you a week's notice and you have to give them a week's notice if you want them to vacate your property unless unless you signed a contract with them and you've both agreed that you have to give each other a month notice and not a week's notice so that is the difference here if you look at the screen it's a statutory periodic tenancy agreement and contractual periodic tenancy so it depends if you use a statutory one because you don't always need to sign a contract with the tenant you know a verbal agreement is also valid but it's harder to enforce in case one of you breaks the agreement so that's why people usually sign agreements but you you don't it's not illegal to not have a written agreement okay so statutory periodic tendencies means that as i was saying um from a statutory perspective if he if he's renting per week you can give him a week notice if he's renting per month you can give him a month notice contractual is what i was explaining before if he's renting per week but you have something different in the contract you have to choose the highest amount of um of notice that you give him and he has to respect the same so he has to also give you one month notice even though he's paying weekly um okay so yeah that's that's all we've already discussed so how much notice as uh as we as i mentioned before the problem here with the standard short haul is that um actually the landlord is required to give two months notice to usually two months notice to the tenant when they have a standard short whole tenancy agreement two months notice but uh because now we are with kovid and all of that the laws keep changing and the government keeps changing everything so now they've made it from two months they've made it six months so um it's um you have to you have to always look at the news because the this course is very good but uh the laws are always changing so whenever i'm teaching now it's just valid for um you know for in this moment when you when the course has been recorded i am updating it regularly but you also have to have some sort of notifications and subscriptions to property website that um always they are always aware of the law changes okay um yeah that's all i wanted to tell you about the periodic tendency agreements okay so as i said with the standard shorthold now they're looking even to change the law and to have the landlords giving six months notice to the tenants uh but uh we'll see you just have to you know you just have to figure out what's happening but usually it was two months before so i don't know if the six months are temporary or it's just a new law it's a bit scary but yeah what can we do you just have to be covered with all your documents in order you have to make sure you've given to the tenants all the certificates and uh hopefully you wouldn't have to evict anyone because uh
