hello it's hermie abraham from advocation advocation is an employment law employment law firm that helps employers and employees resolve problems in the workplace and i had made a commitment this year that i wanted to post a video on a weekly basis and last week i was unable to post a video because i ended up getting a cold and the cold sort of held me up and made it not possible for me to do a number of things and i thought as a topic this week it would be worth talking a little bit about sick leave in ontario and it's a timely topic because of the fact that this is a time when people traditionally have colds and flus but also the corona virus is big in the news and headlines and i see a lot of people on the ttc wearing masks and so should you fall sick hopefully this information will be helpful now the information contained in this video pertains to the employment standards act in ontario so it's for ontario employees who are regulated by the employment standards act and as there are exceptions under the employment standards act meaning not all employees even if your workplace is regulated by the employment standards act you might not be covered under some of the provisions that i'm discussing so it's always best to check i will provide you with information or a link to the employment standards act so you can verify that the information pertains to you so i have three facts that i wanted to discuss with respects to sick leave and the first is that under the employment standards act there's not necessarily a sick leave per se the employment standards act has personal leave days and it allows employees regardless of the size of the workplace to have three leave days per year and those three leave days are can be used for sickness so illness injury it could also be used for a medical emergency and so those are the days that are prescribed or employees ones that our employees are entitled to in uh ontario under the employment standards act now the employment standards act also has a number of leaves to be able to address different life circumstances so for example if you lose a loved one there is a bereavement leave if there are other family obligations there's family caregiver leave and family medical leave so there are other leaves that are available if you find yourself in a life circumstance that might require you to take time away from work and that's important because if you only have three sick days and let's say you're trying to juggle some other commitments you don't necessarily have to use those sick days you might be able to find leaves under the employment standards act that allow you to take time away from work for those other commitments so that's the first thing that the employment standards act does provide three personal leave days the second thing that i wanted to mention is that these personal leave days do not have to be paid time away from work so a number of people believe that sick days have to be paid and that's just not true all the employer has to do is provide the three personal leave days now your employer might have a policy that's better than the employment standards act and they might actually pay for the three days or they might provide something more than and then three days which is great but understand that under the law it's not required and if the your employer is doing that great um you can expect that but it's not an obligation for them to provide pay or provide anything more than three days so that's the second point i wanted to make the third and last point i wanted to make about sick leave is with respects to doctor's notes so um you will find that when employees take leaves you might have your employer saying you know we want a medical note from your treating physician or your doctor sort of to support your leave of absence or your time away from work and now with these three personal leave days that that requirement for doctors know is is less so you are entitled to those three leave days so your employer does not necessarily have the right to demand uh doctor's notes simply for you to take those days however if you're looking to take more than three days your employer can definitely insist on having some kind of medical documentation to support your need to be away from work but with the three personal days that are given to you as an employee in ontario under the employment standards act less requirement for a doctor's note all right so hopefully you found this video helpful if you are sick hopefully this information will shed some light on
