[Music] so Senate Bill 848 expands upon bereavement leave um that currently exists under California's Fair Employment and Housing Act to cover a reproductive loss uh under this new law a reproductive uh loss event is broadly defined to include failed adoption failed surrogate miscarriage still birth or an successful assisted uh reproduction so what is allowed it's up to five days of unpaid leave for one reproductive loss U up to a maximum of 20 days in a 12- Monon period if there are multiple uh losses the law does authorize employees to use any acred pay time off uh like vacation or sick time and remember while this is unpaid if you have an existing um uh leave policy that allows for paid time law uh off then this new law uh this new leave uh also must be paid almost every uh employer in California is covered under this new law it's all private employers with five or more employees in all state and local public employers are covered eligible uh employees are uh those that have been employed for at least 30 days prior to uh the need uh for the leave and um very importantly uh employers uh may not require a medical documentation as a condition for uh take uh taking that leave uh be mindful to keep uh the information on this leave or any medical records that you might have on it confidential in a separate um file from the personnel file uh best practice practices or my takeaways on this be sure to train your HR personnel and supervisors about the requirements of this uh new law uh as well as updating any uh Records logs uh for keeping track of leave like all leave you should also keep track of this reassess update your uh uh recordkeeping protocols uh and as well I think it's a good idea that you include and update your handbooks and written leave policies to include this new entitlement um as with all uh uh protected leave under California law uh employees are prohibited from retaliating against an employee who takes reproductive loss leave or gives information or testimony regarding their own or another's uh reproductive uh LW [Music] sleeve [Music]
