live QA until 5 o'clock now the reality is there's probably many of you that are super disappointed that it didn't go live at 3:00 but all I can say is I'm sorry today we are going to talk about the top 4 reasons for refusal but because because of the way in which I'm now trying to do these through the immigration a Canadian immigration Institute Facebook business page it's disrupting things a little bit so my sincerest apologies for not being able to go live at 3 those of you who are on the other side of the world I know who were counting on it I'm really really sorry I am going to go live here in about 5 minutes and 25 seconds but until that time we'll just let some other people those of you who are out there we'll let you get connected and and then I will actually jump into the meat of the topic today which is my top 4 reasons for refusal so we're gonna go live in about 5 minutes Abhishek I'm surviving my friend and I'll share with all of you guys what's been going on right now and why it is it's just a crazy crazy time right now in in my office and I've got a bunch of things that are coming up this week which has disrupted everything so hang tight and I will be live with coming to you live a little bit late well we're about two hours and 15 minutes late from where it really should be so I want to apologize for all of you guys who were out there wondering why this EE live Q&A didn't start at 3 p.m. Mountain Standard time like it was supposed to well unfortunately life happened and I am getting ready to fly out tomorrow morning at 7 a.m. to attend our national Canadian Bar Association immigration conference in Winnipeg Manitoba I will be presenting on guess what Express Entry of course and so when you are away for Wednesday Thursday Friday of a work week it usually means you're trying to cram in everything into those first few days in other words yesterday and today that you would have normally done in the next three days and guess what tomorrow could very well be another draw and if that's the case well I've got a bunch of clients that are anxiously awaiting me to get their profiles in so they have a chance at getting drawn so I want to apologize once again for being late but those of you who are daring enough to jump on and be a part of this welcome welcome I'm so happy to have you with us today so we'll wait a little bit for a few more people to join us and this one is going to be a little bit shorter a little bit abbreviated if you will but what I'm gonna do is I'm just gonna go on here and I'm going to share this with the members awesome topic today we're going to be covering my top 4 reasons for refusal why after getting your ITA your EAP are is rejected by immigration so what I want you to do is share this with everybody you guys my top four reasons for why II ap our applications are refused after getting an invitation to apply so I'm going to share my screen here and I'm going to blow this up nice and big and make sure that everybody can see it and I'm gonna share it fullscreen okay I think we're good here it looks like everybody can see I think well let's see is it crunching a little bit I think it still fits minute here and this is what it's all about right Express Entry it's your ticket to Canada right yeah it can be exactly that but it is not without its pain and suffering I'm not sure why this pictures in here then this is my family and they are the most important thing to me in the whole world and we love look at that beautiful stream it's summer the fishing season is upon us and in about 30 minutes my son's gonna come pick me up here at the office and that's where we're headed my son on the right Connor who's now 16 and he is driving if you can believe that he's got his driver's license and then his two older siblings Jessica and Adam on the Left are serving missions for our church Adam is in a country called Suriname and some of you may know where that is some of you Spanish speakers may recognize it as Suriname II but it is in South America and it is kind of above Brazil and it borders guyana and french kanay and and brazil and he's down there serving a mission for a church and my daughter that's right to his right the oldest daughter Jessica is serving a mission in Indiana in the US so that's where they are and Connor and I are goin fishin Michaela and I were out riding our horse last night and we love summers here in Canada so happy family without a doubt being able to help people with Express entry absolutely makes me happy but I can tell you that it also is one of the most painful frustrating experiences just like this person here going through this process because the slightest mistake the slightest error results 100% in an application getting returned and we've talked about this before when an application is returned the whole world may have shifted in other words you may have been drawn at 440 comprehensive ranking system points and when it's returned because of an incomplete police' certificate or well I better not give it away one of these four reasons I'm gonna talk to you about well you could forever lose your opportunity to immigrate to Canada and it creates a ton of stress for me a ton of stress and so what I'm gonna do here just because I'm battling with space I'm just gonna go back in here and I'm gonna shrink this down and I'm going to remove some of these things that are in the way let's see here this one that is gone and that is gone there we go okay so let's enlarge this back up again there okay and I think there that's good that's better so I want you guys to comment below if you have felt like this person here so comment below if you felt like this lady and guess what she's looking at she's looking at an email that she got back from express entry and it says you have a message and she went and looked at it and guess what she found she found her number she logged into her my CIC account and guess what it says there's a letter waiting for you and it says your application has been returned because it is incomplete for whatever the reason you guys do not want to fall into this this trap and do not believe those people out there who tell you that Express entry is so easy you don't need to worry about it all the informations on the website that all may be fine and true but if you don't know where to look for the answers if you don't know how to ensure your documents are correct your dream of coming to Canada could be shattered and I'm not trying to be a fear mongerer Here I am telling you the absolute truth because I see it I as an immigration lawyer all the time see people who who have had their applications refused and contact me to try to see if there's a way to fix it and it's so easy to miss something all right so without further ado I want to address with you guys my top four reasons people's PR applications are refused or denied after receiving an invitation to apply so first on our list guys number one right here is your reference letters are deficient okay and so when I think about reference letters and I think about deficiencies I'm gonna jump over here and I'm gonna shrink this down because all right so I'm gonna go here and then I'm gonna shift bear with me as I shift back and forth here a little bit I know why it's because we don't have it up all right so when it comes to reference letters we know very clearly that the instructions that are given by IRC see are very very specific and so if I go to the completeness check site which this is the completeness check site so if you're trying to follow along with me applications for permanent residents programs subject to the Express entry completeness check that's how you can find it that's your search term so if we go back down here and actually I'm gonna read type it in here proof of work experience you guys need to make sure that your reference letters are 100% correct these are mandatory mandatory that you provide these what does mandatory mean it means that if you don't then your application could get rejected so let's enlarge this a little bit bigger so that everybody can see a little bit bigger okay and what are we looking for I've explained this a lot in the past your reference letter it or an experience letter from your employer has to be on FF an official document printed on company letterhead if it's not well an officer could choose to not accept it all right it needs to have the contact information your name the contact information for the company the name title and signature of your immediate supervisor or personnel officer at the company all right and it needs to have all the positions held and it must include the following details and these are them job title duties and responsibilities job status dates work for the company number of hours worked per week an annual salary plus benefits understand that if any of this is missing it could result in your application getting rejected now I'm not going to go into great detail but I see this happening all the time all the time alright let's jump back here and I'm gonna enlarge this again if I can do it properly okay I think everybody can see so your reference letters are deficient you guys have to understand that if you cannot get a proper reference letter you expose yourself to getting your application rejected and no today I'm not going to talk a lot about how to fix deficiencies because I've covered that in past EE live Q&A s but understand number one right there and actually from in the order of priority I honestly believe that maybe this one right here number two could very well be vying for number one in terms of refusals police clearances aren't deficient this one I'm gonna go back once again and I'm gonna show you guys hey there that worked okay we're gonna go back right here and I'm gonna type in IRC see police certificates right there and then I'm gonna pull up the instructions that they give four police certificates all right there are some very important things that you guys have to understand and if you do not follow these instructions explicitly it will get rejected now with that being said if I shrink this down again here and I open up this one which there we go everybody can see just two ago I covered and I'm not sure if you can see this maybe you can this little highlighting May 16th I covered everything you'd want to know about police certificates and so go back to the Canadian immigration Institute YouTube channel or you can search here and you'll find all of the details about police certificates and the most common areas where police certificates get rejected okay but for those of you who are watching this live right here this link this is where you get the information that you need and I'm gonna post it into the comments section for everybody who's watching this is where you can get information what is one of the top reasons that your police certificate is rejected it seems so stupid so idiotic but the reality is police certificates get rejected because and I'm going to click on here and open this up and actually I'm going to copy this as well and post this one in the comment section as well as the other one because police the the police certificate that you submit it has to be copies of the original certificate right here it must be scanned copies of the original in color if you submit a certified true copy or unauthorized copies it will result in your application getting rejected so often I see that happening over and over and over again and it's ruthless because if you're translating a police certificate that translation technically if you follow the translation instructions that I RCC has asked you to follow if you go up here and I'll show you here the translation if your police certificate is written in a different language well these instructions here indicate that you actually need to provide a certified photocopy of the original document so what do you do do you provide a certified photocopy plus the original plus the affidavit from the translator as well as the translation well maybe maybe that's what you need to do to ensure that you're covering off all aspects but whatever you do original copy scanned in in color not black and white alright okay let's shift back here to our to this and I'm going to enlarge this and of course you guys already seen I've given it away now what number three is number three you did not provide the proper proof of funds okay now generally speaking guys the most ideal situation is for you to be able to provide proof of funds that show you have earned that money and saved it over time so we know that when we are looking at the specific instructions that I RCC has given us if I go here and I type in funds that'll take me here down to proof of funds it specifically says that you are to provide an official letter from one of one or more of the institutions that lists all your current bank and investment accounts as well as outstanding debts such as credit cards and loans well understand that if it says you're to provide an official letter then do everything in your power to get it sometimes banks won't provide a letter that actually includes everything that they're asking for in this section which is must be printed on the letterhead it must list the account numbers the date each account was opened the current balance and then this is the one that rarely they will put some well but rarely they will the average balance for the past six months now many people get confused and think does that mean I have to have the funds in there for six months well no not necessarily not at all but they do want to see that you're saving that money and that you then are able to demonstrate that you have those funds at the time in which your application is being adjudicated so when you submit your EAP are so that's that's one of the main issues that I see people who who do not provide the letter and maybe just provide a bank statement or basically they they don't follow this as close as they possibly can have I ever seen them refuse an application because you've just provided a bank statement well the answer is no I haven't seen that but they are fully within their right to do that if you have not followed their instructions set out right here so please understand that you cannot take this lightly if you do not have funds yourself and you are getting a gift of money from a parent or a family member or other family member then you better provide that gift deed confirm where those funds are coming all right and if we go through this I'm gonna I'm gonna shrink this down again I'm gonna escape out of here I'm gonna open this one up again and I'll show you guys right here that June the 13th we are actually going to cover our session on proof of funds so I'll talk a lot about more and more about that on June the 13th so you guys can join me then as we discuss the intricacies of that difficult aspect okay so now I'm gonna go back once again and you've already seen it because I've given it away but the last one that I see more than any other so reference letters police clearances you didn't provide proper proof of funds the last one is you failed to properly disclose information in your statutory declaration so what does that mean well that basically means that that you answered one of those questions in an evasive fashion so what do I mean by evasive well it's entirely possible that you didn't answer one of those questions truthfully that's where it comes down to it's answering the questions truthfully all right I'm gonna just do this and I'm gonna do something here that I wasn't planning on doing but I'm gonna go into my own portal and I'm gonna pull up exactly what I'm talking about I can find it here let me just I'm gonna log in quick and then I'll pull you guys back in so you can see what I'm talking about boy this is I've had so many problems of this stupid rep portal man I just came back last month from meetings with the government this was on my agenda was was the fact that the portal you know these unplanned outages and glitches but I have not seen as many issues with this stupid represent I can't even log in now it's so frustrating I haven't so I guess we'll scrap that that it's so frustrating that the that the portal constantly is either not letting you get in or it is it's glitching out or timing out all the time guys I was working to like 1:30 last night and just about when I was ready to submit it guess what happened the IRC see portal was shut down for maintenance routine maintenance apparently no one in the right mind should be should be working on applications at 3:30 p.m. Eastern Standard Time which is what they said which is 1:30 I should not PM a.m. in the morning which is when I was doing it so I'm gonna try one more time here to see if I can get in because I want to show you these questions all right let's see if this works here I'm gonna try one more time with my Safari browser to see if it will let me in here keep my fingers crossed and maybe it will if it doesn't I'm gonna be so frustrated so far so good some of you maybe have experimented with a number of different browsers but fortunately at this stage it looks like I am alive and well okay let me go back here I'm gonna try again see if I can find a good one that I can use as an example let's see here now I've got to create it actually this is kind of fun I'm gonna bring you guys on my journey here and we're gonna those of you who've probably entered your own your own profile are very familiar with this but I'm gonna I'm gonna walk you through this process so that you guys can watch it with me how I do this so I'm just creating one now just as a little test so whoops I don't want to do that so I'm just going through the eligibility section and by the way my Express entry complete step-by-step guide to doing yourself actually walks you guys through this so I'll say I want to live in Alberta and then a language test sure I've created my IELTS and I'll just say I did it in February or something here this is just a it doesn't really matter and then I better have a score that's high enough right otherwise otherwise they'll say you're not eligible to apply no I don't have any French here so we'll skip that section and then in last three years have you had work experience in Canada yes and by answering that that will make me qualified for the Canadian experience class and my skill type I'll say is a I'll say I was a lawyer but you don't really have to say that and then low and behold I qualify hooray okay now I have to enter my name in so I'll just put here hold the mark and then we'll put in here I am male and date of birth hey let's put my actual date of birth then you guys can see how old I really am 1972 do you believe that I do not feel like I'm an old fogy but apparently I am I'll just say I'm single never married so that it can enter this quickly and here we are okay and now I remember as I've gone through this that I've actually created the profile you guys have to laugh with me you guys have to laugh with me my brain is functioning on about three hours sleep and what that means is how I'm even able to do these live Q&A s and think coherently is a miracle well today that miracle is not a reality because I'm not thinking straight in fact in fact I am I am so flustered here why did I waste all this time doing the profile well the reason I have no clue because the statutory questions are not in the profile there in the EAP our portion which I actually can't show you because the only way I can do that is with live client files which of course I can't disclose that so let's just see here I don't let's see we're not done yet guys we're not done I don't want to waste a lot of time doing this because because I want to get to your questions especially you guys who've been so patient and have tuned in here at the end but the statutory the statutory declaration questions let me just see if I can find see if I have a file with that let's see let's see not statutory declaration let's scratch crap that it is the let's see if I have if I've got something here I've got so many different versions of this that let's see if I might have something huh saved ah okay I don't quite cuz that's a live one okay I've given up I have officially given up you guys there is no point to trying to make this work because yeah it is falling apart okay what am I trying to say here okay I'm gonna stop sharing my screen here because you guys are probably thinking mark you are so crazy like just get with it your this is just the worst ie live Q&A in the history of EE live Q&A s that I've done this is so awful okay what I mean by properly disclosing information on your statutory declaration is the fact that the questions ask you have you ever been refused well what's the best way of describing it have you oh hey success guys I found one okay I'm gonna share my screen again here and we're gonna go into here cuz these ones I actually did redact which is super important because now I can actually show you the ones that I was looking at hooray everybody everybody's tearing okay so here's the questions that give people the most issues okay have you been convicted of a crime or offense in Canada have you ever been arrested or charged and I shouldn't say just in so this is which a pardon has not been granted have you committed or being arrested or charged or convicted with a criminal offence in any country okay have you made a previous refugee claim have you been refused refugee status and this is the important part an immigration or permanent resident visa or an application or visitor or temporary resident visa to Canada or any other country any other country and I can't tell you how often I hear people say well it happened a long time ago seven or eight years so you don't even have to list it don't even it's not even worth notifying them well if it's Canada there's a record of but regardless when you submit your express entry you are attesting that everything is true incorrect and Canada does have information sharing agreements with other countries and so if you do have a prior refusal it's not that the issue isn't whether you're whether or not you got refused like or or why who cares it doesn't matter it's just answering truthfully and so when people say no and then they just continue on as if they have never ever had that refusal then they get this letter from immigration saying hey we think that you didn't answer that question properly it can result in misrepresentation which results in a five year ban from Canada so if I'm scrolling down here a little bit further it asks about a whole bunch of other stuff it asks has you ever been refused a visa or permit denied entry or ordered to leave Canada or any other country well yeah you need to explain that when I look at a visa or permit refusal and then I look up here at this one that asks have you ever had a temporary resident visa to Canada or a visitor or an application for a prevention Albany Program all these different things there's a lot of overlap so I'll often put the same answer in both just because I'm not entirely certain what exactly they're looking for and you know what that's great I just remembered that was the one I was going to include on my panel for Express Entry so all right so this is the issue guys this is where we're at these are the things that can cause people problems and when you don't answer these questions truthfully it can result in you getting your permanent resident application refused okay I've officially spent enough time talking about that topic I will close off just with a very quick summary that basically confirms once again these are my top five reasons are sort of my top four reasons okay so reference letters police clearances proof of funds issues and lying on your application okay all right we have spent enough time doing that it is now time to shift the question is if the PCC is in English while stamped in local language do we need to translate the stamp Muhannad I actually do I don't leave anything to chance because remember in some countries that stamp is the one that says there's no criminal record and so yes I would translate that so anything that doesn't have a corresponding English translation already pre-printed on the police certificate I would definitely get the stamp translated will it be a problem for every single officer well maybe it won't but I do not deal in possibilities no I do not deal in probabilities which is oh it's more than likely that an officer's not gonna have an issue with that I don't deal with that I ask that I ask myself the question is there a chance that one officer out there in the hundreds that are processing Express entry applications could refuse this application because that stamp was in a different language that's the question I ask myself and that's how I advise my clients ok next question is from parth all right from India parth I'm going to receive a huge sum of money from a life insurance policy that will mature in July on my birthday do I need to prove this to CIC where the money came from or do I need to mention it in a gift deed well it's not a gift deed if it's a life insurance policy then someone has died and that's what's given you as a beneficiary access to those funds so that I would simply include a copy of the policy or whatever it is that is triggering the release of those funds and then just show where it came from because IRC see that's why they want to see six months they want to see where the money is coming from and if you have a huge injection of money well their biggest concern is that it's not alone because you can't use alone for settlement funds in Canada they prohibit it all right great question okay next one is ariane says what would you think would be the next CRS cutoff keeping in mind that we already have had a four week gap you were 100% correct I am gonna go with let's see here hmm what am I gonna go with okay I'm gonna type it here I am going with mm-hmm this is what I'm gonna say it is I'm going with this that's what I'm going with and I'm gonna put it nice and big right there that's what I'm that's the score that's the cutoff score I'm going with maybe it's a little high with is probably true but I'm gonna go with about 460 cuz like you said before it has been four weeks like it's been a long time I sure hope it's not that high I hope it's around 450 you know 450 to maybe they'll have more candidates maybe they'll have a larger scoop into the pool with more people given I TAS but the reality is it's entirely possible that it could be a little bit higher and I've got a client who really really needs to get an ITA and so having a score that is that is this high actually could harm them because they need that ITA in order to get there EAP are submitted and get their bridging open work permit filed so I'm hoping it's not this high but that's probably the range I'm guessing okay yeah yeah says you asked us to laugh yes I did you should laugh at me at least those of you who are staying up late can use me as comic relief okay you honest says hi mark on my reference letters from my EAP are valid for java application when I get to Canada I think you on I think you asked this last time and the answer is yes there if they're they're very detailed they cover off all kinds of information about your your work history and so 100% an employer is gonna look at it and accept it okay zishe and says hi sir how I apply for Express entry well you just go to the government website search up Express entry and it will give you all the information that you need and because I am a kind person and no person's questions are too simple I'm gonna go in here and I'm gonna show you Express entry i RCC Express entry right here okay general questions filling out your profile work experience apply online so these are general questions from the Help Center that are most commonly asked by people I'm gonna put this right in here and I think Zhi Shan I'm gonna put that link right there okay and then I'm gonna go back here and I'm going to go to the separate link which is how Express entry works and this is a really good spot to explain how it works and how you can start so I'm going to put that in there and then finally zation if you want to save yourself hundreds of hours searching and reading and reviewing everything the best bet for you is to go to this do-it-yourself step-by-step guide that I actually created for all of you guys which will walk you through the whole process at a fraction of the cost of hiring an agent in your country so that is what I would recommend you do my friend okay next is okay so this one is will lead how many IELTS score needed for work permits there is no real minimum score but realistically I personally feel if you're gonna come and work in Canada you're probably gonna need at least a clb5 so that's kind of my the Canadian language benchmark that's that's really what when I'm thinking so you know for instance with your IELTS probably at least a five that's that's where I would put it okay mirage says mark i have my proof of fund from my country before I left for Canada at 2016 do I have to update it or it is sufficient one hundred percent Moreau's you're gonna need to update that having something that is almost three years old is not going to be useful to to i RCC within an Express Entry application that is just too old my friend you need you'll definitely need to get updated bank letters cuz everything could change that money could be entirely gone okay our Iain says hey Mark should the PCC the police clearance certificate or police certificate be valid for six months when I apply for my EAP are my PCC is four months old but it's valid for another two months I'm expecting and I T in the next draw Arion the expiry date that the country has put on that police certificate that they've given you doesn't apply it doesn't mean anything the reality is you must submit your application before if you're still living in that country before six months are up so immigration puts a six month expiring in on that so if you are still living in the country and you've obtained that police certificate then you need to make sure that you've submitted your EA PR before six months of duration on your PCC okay if you're no longer there then the police certificate doesn't expire if you have obtained it after you left the country all right next question is yo D we submitted bank statements signed and stamped by the bank officials and our application is already submitted can we now submit the letter from the bank as proof of funds well well yo D I can tell you that you should have done that at the beginning now an officer may accept those stamps as being okay this is an official legalization of this statement it's not just something you've printed off your online bank statement but it's an official document because of that seal so maybe that that's sufficient it's up to the officer but you've seen as we've talked about it excuse me I always make sure that I try to adhere as close as I possibly can to what I RCC is asking me to provide for express entry so in your case yo D if you wanted to get another letter and update it you can always do that but there's no guarantee an officer has to look at it or consider it you would do it through a case-specific inquiry all right and for those of you who are student permit that is an issue and I don't think that would any officer if they if there was only enough funds to support Express entry and you were trying to show and demonstrate for two different would always get a gift deed like it sometimes when you've got money that's been in your account for three months or otherwise you want to provide some proof of where it came from and that it's not just a loan you could be sitting in your account for three months but it could have been a loan from your end three three months ago so I actually do even though it's after the fact that money has been given I'd have some form of sworn statement from your aunt saying that yes that is truly all for Roden and is not alone it's an actual irrevocable gift okay ariane says what do you say oh nice so those explicitly if they say you need one for each of your residences which in the past has been the case for Pakistan then you need to provide it if that has changed then follow those instructions through ynp you have to have a job offer from an employer who's actually willing to support you and to get through if you're not in Canada you require an lmia from that employer it's as simple as that if you are not in in Canada then then it then obviously they have the ability to choose who they want to select and maybe your work experience is not in an area where they really feel there's a shortage in Alberta all right morover says one more if the median level wage is higher than this same level position in the company will there be any issues for getting approved lmia yeah you have to your wage for an lmia has to be at the prevailing wage rate which is that median level and if the company is only offering you something that's lower well unless it's some kind of a unionized environment or it falls under one of the exceptions like the agricultural stream where there are lower wage levels because there are other benefits that are given to the foreign worker unless the understand unless there's one of those exemptions applies you have to have your your job offer supported by a labor market impact assessment okay Santhosh says after receiving an ITA can we file a work permit of course you can not a problem at all yo D says can we withdraw our Express Entry application if it's still in submitted status and get a refund if we made a mistake while submitting documents via AOR you can always withdraw your application you always can you just need to make sure that you properly explain why why you're withdrawing and correcting the error because once you've submitted your EA PR it forms a part of the record even when you've submitted your profile and you've updated your profile it re-enters that information in and when you request your GCMs notes you can see all the changes that you made to your profile after you submitted it so the same thing goes with an EA PR but be wary if you have a comprehensive ranking system score that's that's lower like in
