how could a polygraph test be used to help you defend your criminal charges the answer to that question is coming right up welcome back to Cass Titus Law if you're new to Cass status law I'm Steve Cass Titus and this is my channel I post weekly videos just like this one about how to effectively navigate the criminal justice system how to defend criminal charges and how to help you manage encounters that you may have with the police if you liked today's video give it a thumbs up and don't forget to consider subscribing you can do that by clicking on the capital black and white G down in the lower right hand corner of the video screen and if you have questions if you have comments I love engaging my viewers and respond to those questions as quickly as possible so add those down in the comment section below so we can begin a discussion that helps other people too this video is number two in our series on polygraphs in today's video we will talk about an answer the question how a polygraph examination can possibly be used to help you defend your criminal charges links to other videos in the series can be found down in the description section below even though the results of a polygraph examination are not admissible evidence in court a past polygraph exam can still be used on your criminal defense lawyer to negotiate with the prosecutor for instance your lawyer may be trying to get the prosecutor to dismiss this case against you outright and a passed polygraph can really come in handy in that circumstance secondly your lawyer may simply be trying to get the prosecutor to question the legitimacy of the prosecution against you and here again a passed polygraph examination can really come in handy number three sometimes your lawyer is simply trying to get the best plea bargain offer that they can from the prosecutor and here again the polygraph examination results can help there are limitations though on the use of a polygraph examination to help your case I thought of three limitations that we will discuss that you should consider before deciding whether or not to invest in a polygraph expert and the examination number one the polygraph examiner themselves they are the first limitation on the use of the polygraph exam results in most states polygraphers must be certified or licensed to perform polygraph examinations but even more importantly the polygrapher that you decide to work with must be respected in the law enforcement community if they're not respected the prosecutor will apt not to believe anything that they say about the results of your polygraph examination number two the second limitation in the use of the polygraph exam is the structure of the test itself and the issues developed in the questions on the test for instance a relevant question such as did you shoot the victim in self-defense it's a question that is so vague but a polygraph examiner may have difficulty obtaining any type of valid data to score that particular question however a question like did you see that the victim had a gun is a question that might be much more easily developed and evaluated by the polygraph examiner so the structure of the test itself and the issues developed in the questions is the second limitation on the use of a polygraph exam to help defend your criminal charges number three the third limitation is that simply some prosecutors just don't believe polygraph results regardless of who the polygraph examiner is regardless of the structure of the test or the issues being tested some prosecutors simply put no value in the results and because of that that is the third limitation on the use of a polygraph examination to help you defend your charges can you think of any other ways that a polygraph exam might be used to help you defend your criminal case can you think of any ways that limit the effectiveness of the polygraph examination if you can why don't you add those down in the comments section below and we can begin a discussion that might help some other people - in any case the decision whether or not to invest in a polygraph exam is a strategical one this should be made only after consultation with your criminal defense lawyer the third and final video in this series on polygraphs maybe the most important in that video we will answer the question whether or not you should ever submit to a polygraph administered by the police or the prosecutor's office before you decide to submit to a polygraph make sure you watch and study that video so until that time I look forward to having you visit with us don't forget to give us a thumbs up if you liked the video and don't forget to subscribe thank you again for watching
