intended to apprise a person of some proceeding in which his interests are involved or informing him of some fact which it is his right to know and the duty of the notifying party to communicate that's from black's law fourth edition how to write a notice a notice should be printed on eight and a half by 14 inch paper printed on one site only why because historically legal documents are printed on this size paper this is a formal warning which could be used as evidence for a grand jury therefore the need for legal size paper historically your mortgage papers and all other legal documentation were always printed on this size paper a common font used is times new roman 12 point you can include as many addresses as you like and as many carbon copies as you like keep the original this is known as the wet signature for your records and mail copies to everyone else mailing by certified mail return receipt is recommended as this will provide evidence the notice was typing in the name of your state and then constitution for example you would type in alaska and then the word constitution if you lived in alaska then you'd look for either the bill of rights or declaration of rights section and click on it for alaska it they call it the declaration of rights so you look for that section that addresses the power of the people for alaska this is found in article 1 section 2 of the alaskan constitution and it shows section 2 and then it says text of section 2 it titles it source of government and then it'll have the constitutional phrase all political power is inherent in the people all government originates with the people is founded upon their will only and is instituted solely for the good of the people as a whole so here's an example the first paragraph would say i john doe or your name one of the people as found in the texas state constitution bill of rights article 1 section 2 sui juris in this court of record making the following claims that you may take notice and provide due care and then the next paragraph you're going to outline who you are as one of the people and your power that you're coming what rights you're coming in and then begin laying out your arguments for the paper please take notice that all political power resides in the people and government is formed for the sole benefit for the people we the people have the inalienable right to alter reform or abolish the government as we thank expedient we have the right to check from our administration of elections all public officers are our trustees and servants and take an oath of office to uphold the constitution as documented below and then the next section you're going to put your constitutional article in section that lays out who you are and your political power so in this example it's the texas constitution article 1 section 2 inherent political power all political power is inherent in the people and all free governments are founded on their authority and instituted for their benefit the faith of the people of texas stands pledged to the preservation of a republican form of government and subject to this limitation only they have at all times the inalienable right to alter reform or abolish their government in such manner as they may think expedient and then you can highlight whatever section that you want in there and if you do highlight you want to put that phrase emphasis by highlighted added so this is just an example for your state it would be whatever article and section for your particular state that goes over your inherent political power grievances the main body of the notice would consist of explanations of the grievances and documentation of the various bill of rights that have been violated you can include links to articles or any maxims of laws definitions oasis of office or any other factual proof you have to substantiate your claims you may use any state bill of rights that addresses your situation because remember if you've watched the other videos all the bill of rights in all the states apply equally to everyone your closing paragraph and a notice should include wording that binds them to either admit guilt by not responding to your notice or requires them to show where they got the authority in the constitution to do what they are doing closing paragraph example so here's an example of the closure on a notice if you believe that you have the authority to allow crimes against the people to whom you swore an oath to go unaddressed please respond to this notice within and then you can specify the number of days if you want three days five days ten days you can choose point by point by affidavit sworn under penalty of perjury with the constitutional provision showing when you are granted such authority failing to do so means you agree with the above claims you want to make sure you include that they have to put in the constitutional provision showing where they got that authority and then you want to have a line and a line for the date notice that we have autograph we do not use signature because signature are for corporations and you are not a corporation you are a living breathing human being so you use autograph try to keep your notices three pages or less to ensure that they get read but sometimes it takes longer it takes more than three pages so you can have them longer than three pages there's no length limitation you just want to make sure that they read all the information affidavits parts and pieces the definition an affidavit is a written or printed declaration or statement of facts made voluntarily and confirmed by the oath or affirmation of the party making it taken before a person having authority to administer such oath or affirmation that's from black's law of fifth edition you do not need a lawyer to write an affidavit the title will have affidavit in it and you will call yourself affiant which means the person who makes and subscribes an affidavit the body of the affidavit would be similar to a notice with the exception of you identifying yourself as affient affidavits must be signed in person in front of a notary you are swearing under the penalty of perjury that what you are saying is true and factual this part is called the girat which comes at the end of the affidavit here's an example of an affidavit beginning so you'll have your two in this case it has blank lines for you to fill it in and then from and then the title is notice of demand by affidavit 2 and then you can put to whoever you're sending it to it could also just say affidavit 2 and then you have notice to agent is notice to principal and notice the principle is notice to agent and then you have your first paragraph comes now affiant then you have the name one of the people has seen in article one section two of the texas constitution coming suey juris in this court of record and making the following claims that you may provide do care and notice where the asterisks are that would change ing to your specific state here's an example of an affidavit ending it is hereby affiance wish order and demand for all parties to either abide by the state and united states constitutions or agree that you are working to attack the people against your trust and denture constitution or corporate bylaws and are knowingly trespassing against the rights of the people you swore to protect if you disagree that you have exceeded your job description and constitutional authority you must respond within five days with an affidavit answering point by point how you have not violated your oath of office so again this is just an example you can change it just to give you an idea here's an example of the giraffe this is the section that has to be filled out in front of a notary so you want to make sure you do not sign it until you are in front of a notary because it has to be notarized and they'll put their seal on it and you could get examples of these for your specific state probably online final thoughts just like on the notice you would keep the original of the affidavit and mail the copies by certified return receipt to have proof of delivery or you can hand deliver the affidavit and have someone videotape you as you do it you can send multiple notices first or a single notice and then follow up with an affidavit the notice needs to be done first only accept a response by affidavit you want to know they are telling the truth many times they will not respond at all and that's perfectly fine because then you have them on mail administration if they do try to respond by email just remind them that they're supposed to respond by affidavit notices and affidavits are a tool for we the people to hold our government
