How to eSign a document: eSignature lawfulness for Military Leave Policy in United States

what happens when you have time military time and now your civilian service should you buy that time back or not does it cost you your military pension what benefits do you give up if you've ever wanted any questions like that then stay tuned for this Furs Federal fact check today we have a great question that came in from Jeff about military buyback I love to say I get lots of questions about military buyback and sometimes it's straightforward but sometimes it's about to find it's not very straightforward I'm so grateful you put out this information on the podcast and email this really benefits federal government employees and I share your information about these topics out all the time Jeff thank you very much we love this information getting shared really do appreciate that he says I entered into U.S Army Reserves in 1991 and then entered U.S government Service as a civilian in 2003. at the time when I came in government service I did buy back one year's worth of military active duty time from the reserves now I'm retired from the U.S army research in 2021 with 30 years of service and it won't collect his retirement until he's 60. in the meantime I have a full-time U.S government civilian for the past 20 years of service while I was serving to use Army Reserve does it make sense for me to buy back additional Reserve time from 03 to 2021 since I have been in the government and I even and I and am I even allowed to buy back the U.S Army Reserve time while being in federal service at the same time thank you Jeff that is an outstanding question now one of the things that we see with this is there's a lot of moving parts inside of here because we have three different types of service that we're looking at by the way right we have one which is just straight civilian service we have another one which is military service and then we have Reserve service kind of these three different categories well his civilian service is pretty easy he said that was 20 years but then he has this military service and I like to break it down to two different categories because there's time that's extreme military time there's straight Reserve time now let's pretend for just discussion Reserve time didn't count let's say you had a full career you had 20 years in the military and you had a full career inside of the military then you became a civil servant well you could choose to buy that military time back but if now again this is in reserve this is just straight career military 20 years active duty if you were straight career military for 20 years and you bought back your time and you you use that military time to account for another 20 years of Civilian time so you had 40 years you can't do that but what do you give up you give up your military pension when you do that again this is in reserves this is just straight military side of it so you can buy it but nine times out of a ten it doesn't make sense to do that because of the military pension so that's one aspect of this but the other part that he brings up is he brings up the fact that he has reserved time so let's again go ahead and put our military time here and now he has this Reserve time let's say for discussion he has that 20 years of reservist time that's there and out of that he has a pension that's going to start at 60 years young well this is the cool part under her service we get a double dip a little bit not only do you get this pension any time that you had as active duty now this could include Academy time you can buy that as well any active duty time let's say he had a total of three years of active duty time while he was in the reserves you can absolutely buy that time back and it's going to count towards oops Got erase this other side and it's going to count towards your years of service so then he would have 23 years of federal service he still gets 100 of his pension because it's a reserve pension coming in and he's able to get this time that's going to account for his service now to get even better than that Jeff there could be a period in time that this military three years ago after duty that you actually don't have to buy back it could be a case that some of this time you actually get full credit for a civilian service without making a deposit how do we know that well it depends where were you deployed was it active duty where were these things at so there's a lot of moving parts inside of here and this is the importance of really understanding this I would absolutely go back and get a certified summary of federal service I would want to know the civilian time what all my career is then I want a good outline from The Reserve side what was active duty time what was Reserve time was it deployed in any of this then I'd want to put that information together and go to my HR and talk to them about buying them back and talk to them what their rules were because some of that changed after 2002 to 2004 in a good way about buying that time back and how you might not have to buy that time back it might just automatically count so those are the things that I would be looking for if you have questions like this because you can see how quickly and how complex these benefits can get make sure you're subscribing to our podcast make sure you're on our website plan your federal retirement.com submit your questions to us
