hello I'm David stone from Simmons and Simmons and I'm here to talk about my new book to be published by Oxford University Press European Union design law a practitioners guide 10 years ago new legislation was introduced in the European Union that covers all 480 million people living within the territory of the EU there are two pieces of legislation the designs regulation which introduced two new intellectual property rights the first a registered Community Design right to be obtained by registration at the office for harmonization in the internal market and also an unregistered design right these two new rights apply throughout the European Union at the same time the designs directive attempted to harmonize the design law in the 27 member states of the European Union and any that joined such as Croatia which joins the European Union in summer next year 10 years on seems like a good opportunity for a book looking in detail at the regulation and the directive and some of the neologisms that appear in that legislation we also now have a significant number of decisions from the relevant bodies throughout the European Union on what the new legislation means first and most importantly is the Court of Justice the highest court in the European Union the Court of Justice has handed down a number of decisions on European design law perhaps most of interest is PepsiCo and grupo Proma a case on appeal from OHIM dealing with children's pogs or rappers small toys inserted in crisp packets in some Member States of the EU the case was important because it was the first time that the Court of Justice dealt substantively with many of the expressions in the new legislation such as who is the informed user and how do you calculate the overall impression created on the informed user in the context of invalidity of a registered community design you
