Hi! I'm Paula Krawus, a lawyer at PortaLaw, and today I'm talking about what's new. So you've heard it on the news, you've heard it on all the law blogs and now you're hearing it here. On January 1st, 2022 a new law comes into force in B.C., which provides employees with five paid sick days per year. So, as a refresher, the Employment Standards Act is the piece of legislation in British Columbia that applies to provincially regulated workplaces and which tells us what the very minimum standards the minimum obligations an employer has to their employees. So right now the Employment Standards Act says that employers must provide at least three days of unpaid sick leave. So this is called technically injury or illness leave. As of January 1st that entitlement to employees goes up to five paid sick days and three unpaid sick days for a total of eight per employment year. So employees are entitled to these sick days after they've worked for 90 consecutive days with the same employer and an employer is entitled to ask for sufficient proof of the injury or illness. This doesn't mean a medical note or a doctor's note in all circumstances but in some cases, it might. So this is very new for employers and managers to deal with and what it might require for a lot of workplaces is a change in policies and procedures and practices.
