[Music] welcome to employment law this week I'm George Whipple restrictions on non-competes have dominated the headlines this year the Federal Trade Commission has proposed a rule Banning non-compete agreements Nationwide Minnesota became the first state to ban non-competes since the 1890s the New York State Legislature passed its own Statewide non-compete ban that's awaiting the governor's signature and the general Council of the nlrb instructed Regional Offices to evaluate non-competes for potential violations of the National Labor Relations Act it's not even over yet and 2023 has already been the wildest year in my almost two decade career for restrictive covenants and in particular non-c competes that's Eric wbst co-host of spilling Secrets Epstein Becker Green's podcast series about Trade Secrets and non-compete law Eric and co-host Pete steinm brought us a view from the front lines in this installment today we are doing something we have never before done on the show we are recording before a live audience Eric and I are delighted to have two leading in-house attorneys on the panel with us today Gina saroso and Evan Michael Gina sarino Chief counsil employment and labor at Thompson reuter spoke about how the recent changes in trade secrets and non-compete law have affected policymaking at her organization we've had to look at our agreements we have modified where we think we need to in the different states so we have versions where you have full protections of not compete not solicit we have others where it depends on level of income in certain States so we do have different templates I think being prepared like that we have one in case New York does get signed we are ready it's like Version Control of of what you're using making sure when someone starts we're using the right ones Evan Michael general counsel for NFP shared how his company is navigating the current climate on a quarterly basis we just meet and find out what all the latest and the blogs are and the State Court decisions and we'll update it and send it out to all of our HR teams we bringing on employees on a daily basis and I think it's also just training of our internal teams our internal counsel or internal HR staff on what to expect we're onboarding people what to expect when people are exiting us reminding them of their obligations and having reasonable expectations as to where we can protect NFP all the panelists noted that training is a key tool for employers to use to protect Trade Secrets they encouraged employers to create a culture of understanding where departing employees know that stealing confidential information hurts the employer but also hurts employees they leave behind that's it for this week don't miss the full spilling Secrets where the team Dives deeper into what has happened in trade secrets and non-compete law and what's to come subscribe to the employment law this week feed wherever you get your podcast to hear the full audio episode and to catch all future editions of the spilling Secrets series thank you very much for watching and we'll see you next time [Music]
