another pop quiz for everyone what is the most important thing to do during and after you watch this video it's to subscribe and like and comment sorry that was like clickbait kind of stuff but either way subscribing helps us grow we would love for you to do that i would be honored for you to do that but let's dig into the property disclosure the goal of this document the property disclosure is to give you as a seller the opportunity to disclose anything and everything that you are aware of with the property so that a buyer can see it and it allows them to make the best decision on whether they want to move forward or not with the sale you may know but in the state of louisiana you are selling your property as is at closing so after closing something pops up wrong with the house it is the buyer's responsibility with the exception of if the buyer can prove that the seller knew about this beforehand but did not disclose it of course a buyer is going to get an inspection but you know inspectors aren't perfect if they miss something or something is like pretty well hidden they can't tear down walls or anything but if something comes up that they can prove that a seller knew about but didn't disclose they can come back and get you with the s word suit that can suit you so you can see why it's important to disclose anything and everything you know about the property that way if something pops up down the road after a buyer purchases the house you can say hey you know i did disclose that on the property disclosure and unfortunately it is your responsibility now so let's go a little more in depth on the property disclosure here are some things you as a seller need to know while filling it out first thing is it's okay not to know some things you have options on the property disclosure that allow you to check yes no or not known so if you absolutely don't know something by all means check not known it's pretty common to do so do not check not known for literally every single thing on the property disclosure buyers are going to see that it's going to be a red flag because there are things that you obviously know as a seller but all that to say if you don't know about it it's okay just check not knowing second thing is it's good to explain your yeses if you check yes there are issues with the plumbing or the electrical obviously if you don't explain that a buyer's mind can kind of go haywire no pun intended but there's a section at the bottom of every uh section you check yes that you can explain what the issue is so if there's an issue with the electrical you can write the receptacle in this room does not work or it also gives you a chance to say hey there was an issue with it but we've gotten it fixed so no issues are remaining and bonus points if you can provide documentation showing that the issue has been resolved so explain your yeses third thing is if in doubt disclose it so i have sellers often say hey we had an issue with this but it's not really an issue anymore should we disclose it i always say if in doubt disclose it because i'm a big fan of transparency i want buyers to know what they're getting into because honestly it can be a pain and seem tedious but down the road you're going to be thankful that you disclosed all that you can and did about the property so if there's a question on whether or not you should disclose it or not yes disclose it a fourth very important thing is that your realtor should not fill this out for you we don't want to touch this thing it's not our house it's not our responsibility and it's not our liability so you know more about the house than we do it's okay to ask for guidance here and there but we are by no means allowed to tell you what to put for each thing so do not ask us thank you the fifth and final thing is have patience with the document and take your time as i said earlier it's kind of tedious and it can kind of be a little overwhelming but it's by no means a document to rush through so take your time in answering take your time and looking things up take your time in providing further documentation to prove things or to show what you're saying is true but take your time with it often in this market or just in general people are just hurry hurry hurry try to get their house on the market this is not a document to do that with so i often leave it with sellers to fill out on their own it's not something you really fill out honestly in one sitting in front of your realtor so take your time with it don't rush because it's super important so hopefully this helps if you need more explanation ask your agent i've said in other videos that we as realtors are risk mitigators and this is absolutely a risk mitigating document and you're required to fill it out even you for sale by owners it is a state of louisiana requirement so if you want to look cool in front of other realtors while you try to sell your house yourself be prepared and be ready to
