hey it's guy DiMartino I am a Northwest Indiana State Planning and probate lawyer and one of the big things that we do in estate planning matters is you know we prepare deeds especially if we're going to fund trusts we don't prepare as many deeds as real estate attorneys do but we do prepare our fair share of deeds and recently on July 1st the Indiana legislature put a new law into effect which will change how we do our deeds or other things that need to be recorded in the state of Indiana but before I explain to the change in the law if you ever have any questions regarding a Northwest Indiana State planning or probate matter you can always reach out to me we could set up an appointment by phone by videoconference or in-person all you need to do is go to Indiana State meeting.com and set up your appointment so on July 1st typically when we would prepare our deeds before July 1st they would be one notarization at the bottom and typically the notary would be the only witness that would have to be available in order for the deed to be a valid deed and accepted by the recorders office in the county where the deed was going to be recorded but on July 1st they changed the recording statute and now they'll need to be to note oral statements so the first a notary would be that the grant or the person who is signing the deed or transferring the property their signature would be notarized that this is what they're doing and it is their will but then also there is going to be a witness and the witness will also have to have their signature notarized that they witnessed was going on and that there was nothing nefarious that was going on see this is not uncommon many other states require either one or multiple witnesses seen Florida where I also practice they require two witnesses two deeds and those witnesses signatures need to be notarized however it can be notarized within the same neutral paragraph so there you have it so if you prepare a deed after July first and it does not have a witness and and the witnesses signature is not notarized it is it might be that the recorders office will not accept the deed and you'll have to go ahead and go through the process of preparing your deed one more time you know somebody is saying that this was really an unintended consequence of the law and maybe they're gonna go ahead and change it later on but as of July 1st 2020 we need to know t'rul stamps on the deed you need to have the person the grant doors whether it's one or two will need to sign and then you have to have a witness signing the deed and that also needs to be notarized and the same thing is true if you are going to actually record a power of attorney you'll need that second notary stamp if you have any questions about Indiana State planning matter or probate matter you can always reach out to me I am guy DiMartino have yourself a great day
