II. On or about , Plaintiff came under the treatment and care of Defendant . On or about Defendant performed a surgical procedure upon Plaintiff during the course of which he/she was injured. III. The Defendants were guilty of negligence and deviated from the standard of care in their examination, treatment, and care of Plaintiff. IV. That through their obvious misdiagnosis, negligence and/or neglect, proximately caused or contributed to Plaintiff's injury becoming more severe and sustaining unnecessary injuries and damages. V. The Defendants failed to advise Plaintiff of the known risks associated with the treatment or absence of treatment provided to him/her , and otherwise failed to obtain the informed consent of Plaintiff with regard to the procedures to be performed upon him/her. VI. As a direct and proximate result of the negligence, deviations from the standard of care and lack of informed consent by Defendants as aforesaid, Plaintiff was injured. He/She has been caused to incur doctor, drug and other medical expenses and may be reasonably expected to incur additional such expenses in the future. Plaintiff has been caused to suffer physical pain and suffering, mental anguish and anxiety, and discomfort and he/she will continue to endure the same in the future. Plaintiff suffers from a degree of permanent partial impairment and has been caused to lose wages and income as a result of his/her injuries.WHEREFORE, PREMISES CONSIDERED, Plaintiff, , files this his/her civil action against Defendants, and , and demand judgment against said Defendants, jointly and severally, in a sum which will reasonably compensate him/her for all of his/her injuries and damages.
