§ 14.05 Announcement Provisions in Litigation Settlement Agreements Page 457 Example 1 Announcements. The parties shall keep strictly confidential both the fact and terms of this Agreement, except as required by law. Despite the previous sentence, the parties agree to issue the statement attached as Exhibit ________ to this Agreement on [insert date]. Example 2 Confidentiality. Each party shall keep strictly confidential both the fact and the terms of this Agreement, including any agreements incorporated into this Agreement, with the sole exceptions of (a) disclosure required by lawful and valid subpoena, court order, or other governmental reporting requirement, and (b) disclosure to ___________ and their attorneys. In response to any other inquiry that otherwise would result in disclosure of the fact or terms of this Agreement, the parties shall state, “The issue has been resolved confidentially,” or some substantial equivalent, or that they have no comment.
