Neither party shall be entitled to any recovery under any tort, contract, negligence or other theory of liability arising out of or in connection with this agreement, including without limitation any claim, demand, action or litigation relating to (including failure to perform any provision of this agreement), the performance of the foregoing duties of the company for the other party relating to the provision of goods or services to the other party. In addition, except as set forth in section 3, neither party is obligated to extend credit to the other party pursuant to an operating or loan arrangement, whether by personal, firm, corporate or other form of arrangement; and except as set forth in section 4, neither party shall be obligated to extend credit to the other party or to enter into any such arrangement to extend credit to that party in the form of lines of credit, notes, loan commitments or similar instruments. Neither party shall be obligated to obtain any consideration from the other party in exchange for the foregoing.
