- 1 – INDEPENDENT CONTRACTOR ATHLETIC TRAINER AGREEMENT THIS AGREEMENT made and entered into on the date last written below, by and between (hereinafter "Employer"), and , an independent contractor (hereinafter "Trainer"); WHEREAS, the Employer desires to retain the services of Trainer, and Trainer desires to render services to the Employer, upon the terms and conditions hereinafter stated: NOW, THEREFORE, the parties hereto, intending to be legally bound hereby, do hereby promise and agree as follows: SECTION 1 – SCOPE OF DUTIES TO BE PROVIDED 1.1 Term. Employer agrees to hire Trainer, at will, for a term commencing on , 20 and continuing until terminated in accordance with Section 4 of this agreement. 1.2 Duties. Trainer agrees to perform work for the Employer on the terms and conditions set forth in this agreement and agrees to devote all necessary time and attention (reasonable periods of illness excepted) to the performance of the duties specified in this agreement. Trainer's duties shall include the following: Trainer further agrees that in all aspects of such work, Trainer shall comply with the policies, standards, regulations of the Employer from time to time established, and shall perform the duties assigned faithfully, intelligently, to the best of his/her/their ability, and in the best interest of the Employer. SECTION 2 – CONFIDENTIALITY 2.1 Confidentiality. Trainer acknowledges and agrees that all Employer data and info
As requested, or obtained, pursuant to any request, inquiry or complaint, and all other information acquired from trainer, trainer's personal health data and other confidential information contained in trainer's medical records, are confidential and will not be disclosed to anyone, without the express written consent of employer. Trainer further understands and acknowledges that trainer will be subject to disciplinary action, up to and including termination, based upon the employer's failure to comply with any provision in this agreement. Trainer further understands and realizes that in all aspects of this work, trainer shall be subject to legal requirements, rules and standards, as well as the employer's own policies regarding confidentiality. Trainer further understanding fully that there are times when certain requests, inquiries, and complaints are confidential or privileged, as established by the employer with regard to the requested information and to the information being sought, or complaint. This right is limited to the scope of training that is specifically requested, or as otherwise set forth in the specific agreement or policy. In consideration of the foregoing, trainer agrees that nothing herein shall be construed, construed, or otherwise interpreted as a waiver of any right to the confidential nature of trainer's medical or other personal data and other confidential information. Trainer further agrees that in consideration of this agreement, trainer hereby indemnifies the employer against any and all liabilities and/or costs arising from trainer's inability to perform the agreement in accordance with its terms or the provisions of any insurance, or for any claim for damages arising out of trainer's negligence or willful misconduct in the performance of the work. § 3—– hours of work per week — 1. Trainer shall be entitled to be paid for at least the amount of time worked to any one hour of work. And trainer agrees in advance to maintain a reasonable schedule for providing work to the employer. 2. To the extent trainer deviates from the above schedule, trainer shall give reasonable notice in writing to the employer of his/her plans to terminate, and shall give the employer 24 hours notice of the termination of such work. (section 8 below.) 3. The number of hours worked by trainer may not exceed the number of hours actually worked plus all applicable overtime rate. For purposes of this clause, all the following are not considered hours of work; 1. The time an employee works during the off-hours of his/her regular schedule. 2. The time an employee performs personal services (, child care, home-based services and care-giving). 3. The time an employee is engaged under a supervisory position.
