1 STATUTORY SHORT FORM OF GENERAL POWER OF ATTORNEY NOTICE: THE POWERS GRANTED BY THIS DOCUMENT ARE BROAD AND SWEEPING. THEY ARE DEFINED IN CHAPTER 32C OF THE NORTH CAROLINA GENERAL STATUTES WHICH EXPRESSLY PERMITS THE USE OF ANY OTHER OR DIFFERENT FORM OF POWER OF ATTORNEY DESIRED BY THE PARTIES CONCERNED. IMPORTANT INFORMATION This power of attorney authorizes another person (your agent) to make decisions concerning your property for you (the principal). Your agent will be able to make decisions and act with respect to your property (including your money) whether or not you are able to act for yourself. The meaning of authority over subjects listed on this form is explained in the North Carolina Uniform Power of Attorney Act. This power of attorney does not authorize the agent to make health care decisions for you. You should select someone you trust to serve as your agent. Unless you specify otherwise, generally the agent’s authority will continue until you die or revoke the power of attorney or the agent resigns or is unable to act for you. Your agent is entitle to reasonable compensation unless you state otherwise in the Additional Provisions and Exclusions. This form provides for designation of one agent, successor agent, and second successor agent. The north carolina power of attorney is an integral part of all letters of appointment for the living. You may, however, add an agent to an estate plan which has been established for you for the living and to which you will be able to contribute. This is not a requirement. See the north carolina common law principle which provides that a fiduciary relationship between a fiduciary and another person is established in a durable manner when a fiduciary has a power of attorney to act for the other person. Who should file this form? if you would like to appoint a third person, you may omit the provisions regarding agent of attorneys. You may also omit the provisions involving the attorney duty and authority. If you have a trust or a power of attorney that you would like to amend or amend and amend an existing power of attorney as a condition of your leaving the trust or power of attorney, you must file this form on or after the date of your final living will. If you would like to create a new trust or trust of your life insurance policy, you must file this form at least 30 days before you appoint someone to assume all of your living estate. You may also omit provisions which govern a power of attorney under chapter 32c which has an existing power of attorney or which is revoking a current power of attorney. Renumbering authority the north carolina uniform power of attorney form has the following provisions regarding the renumbering of powers of attorney: if a later-dated power of attorney is created, the renumbered power of attorney shall be treated as a new power of attorney.
