(d) the amount of a claim against the owner of the property (who must be named in the notice) is limited to those actual damages which are occasioned by a violation of this section (except gross negligence which will be proximately determined), and any other damages which are proximately caused by the defendant's violation. (e) a notice and claim may be filed by the owner(s) to the defendant after a written notice by the owner to the defendant requesting the service of process, and the service of process upon the defendant. If the owner's lien is not valid, and if the notice and claim is not erroneous for any reason, the owner may be entitled to a limited equitable interest in the property subject to the limitation set forth in paragraph (g). Within ten days of such filing process may be served upon the defendant. The defendant may file a defense in mitigation of damages within ten days of service of process. Unless the motion is denied or the defendant files a defense in mitigation, the defendant is not entitled to a judgment before trial or trial on a motion for entry of judgment.
