RETAIL INSTALLMENT AGREEMENT (No Consumer Credit Protection Act Disclosures) 1. Purchase Price. The total purchase price shall be $ ____________________________ . 2. Interest. Events of Default. Remedies . In the event of a default by Purchaser, Seller may declare all of the payments required to be made by Purchaser under this Agreement immediately due and payable and shall have all of the rights and remedies of a secured creditor under Article 9 of the Uniform Commercial Code of the state of ________________________ in addition to any other rights or remedies provided by law or by this Agreement. Said rights shall include, but not be limited to, the right to take possession of the collateral and the right to dispose of the collateral at public or private sale and distribute the sale proceeds according to applicable law. Seller or assignee shall further be entitled to recover any expenses of collection, including without limitation attorney fees and costs of repossessing and selling the collateral. 8. DISCLAIMER OF WARRANTIES. SELLER MAKES NO EXPRESS OR IMPLIED WARRANTIES AND HEREBY DISCLAIMS ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. 9. Complete Understanding . The parties hereto acknowledge that this Agreement constitutes their entire agreement as to the subject matter hereof and that there are no understandings, agreements, representations or warranties not specified herein. 10. Modifications . No purported modification hereof shall be effective unless made in writing and signed by Seller and Purchaser. 11. Governing Law . This Contract shall be governed by and interpreted in accordance with the laws of the State of ______________ . 12. Parties Bound. Any partial prepayment shall be applied against the principal amount outstanding and shall not postpone the due date of any subsequent monthly installments or change the amount of such installments.
