Release of Landlord, Waiver of Liability, and Assumption of all Risks of Bodily Injury Regarding Use of Swimming Pool Located on Landlord = s Property at Apartment Complex (Tenant has Child or Children) Whereas, the undersigned _____________________________________________ _______________________________________________ (Name of Tenants or Tenant), hereinafter jointly and/or severally called Tenant, is/are renting Apartment Number _____________________ (Identify Apartment Number), the Apartment, located at ________________________________________________________________________ ___________________________________________ ( street address, city, state, zip code) , on property (the Property ) owned by __________________________________________ (Name of Owner), hereinafter called Landlord ; and Whereas, Tenant has a minor child or minor children living at said Apartment, said child or children hereinafter jointly and/or severally called Child; and Whereas, there is a swimming pool (the Pool ) located on the Property, and Landlord has warned Tenant of the dangers to Tenant and Child that could result if Child goes into or around the Pool without adequate supervision of Tenant; and Whereas, Tenant has agreed that Landlord is under no duty to supply a lifeguard for said Pool and that tenants and their children use the Pool at their own risk ; and Whereas, Tenant has assumed the risk of such dangers and released Landlord for any injury or loss of life to Tenant and/or Child; and Whereas, Tenant and Landlord want to memorialize said assumption of risk and release in writing; Now, therefore, for and in consideration of being allowed to rent said Apartment and use said Pool, and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the undersigned Tenant hereby releases Landlord, his heirs, successors, and assigns (collectively Releasees) from all liability for any physical injury or death to Tenant and/or Child that results, directly or indirectly from the use (accidental or otherwise) of the Pool. Tenant further agrees to indemnify and save and hold Releasees harmless from any loss, liability (accidental or otherwise), attorneys ’ fees, damage, or costs that Releasees (or any of them) may incur arising out of or related to the use the Pool by the undersigned Tenant and/or Child, whether caused by the negligence of the Releasees or otherwise. The undersigned Tenant fully understands that the use of the Pool involves risks and dangers of serious bodily injury, including death (Risks), and understands that the use of the Pool and surrounding area will not be supervised by any of Releasees, and Tenant fully accepts and assumes all Risks and all responsibility for losses, costs, and damages either Tenant or Child incur as a result of use said Pool or surrounding area. This Agreement shall be governed by the laws of the State of ____________________________________. Any dispute under this Agreement shall be required to be resolved by binding arbitration of the parties hereto. If the parties cannot agree on an arbitrator, each party shall select one arbitrator and both arbitrators shall then select a third. The third arbitrator so selected shall arbitrate said dispute. The arbitration shall be governed by the rules of the American Arbitration Association then in force and effect.
