DESCRIPTIONS OF FORMS Brief descriptions of the forms contained in your U.S. Legal Forms™ Living Will package are found below. Durable Power of Attorney for Health Care - This is a Durable Power of Attorney for Health Care purposes, which is to be used in the State of Hawaii. A Durable Power of Attorney states that a person, whom the Declarant chooses, will be able to make health care decisions for the Declarant in the event that he/she becomes incapacitated. Advance Health Care Directive Four Parts as Living Will - This Advance Health Care Directive was enacted in the Hawaii Revised Statutes 372E-16. It is a combination of forms, all dealing with health care issues, including power of attorney for healthcare, healthcare instructions, anatomical gifts, and designation of primary physician. It allows you to provide instructions regarding your health care, name someone else to make health care decisions for you and express your wishes regarding designation of a health care provider. You may modify the statutory form to suit your individual needs or use a different form that contains the substance of the statutory form. Your advance health care directive must be in writing, dated, signed, and witnessed by at least two individuals (each of whom witnessed either the signing of the instrument or the acknowledgment of the signature of the instrument) or acknowledged before a notary public at any place within Hawaii. Revocation of Advance Health Care Directive - Four Parts - This is a revocation of Form HI- P021, an Advanced Health Care Directive, that allows your friends and family to know your wishes regarding being kept alive artificially, allows you to name someone else to make health care decisions for you (an agent) and allows you to express your wishes regarding designation of a health care provider. You may revoke your designation of an agent to make health care decisions for you by using this form or by personally informing the supervising health-care provider. You may revoke all or part of an advance health-care directive, other than the designation of an agent, at any time by using this form or any other method that communicates your intent to revoke. Revocation of Statutory Living Will – This is a revocation of the wishes and desires you expressed in Form GA-P023, which is a Statutory Living Will form that allows you to express your wishes and desires if it is determined that your death will occur whether or not life- sustaining procedures are utilized and where the application of life-sustaining procedures would serve only to artificially prolong the dying process. This form acts as a revocation of a previously executed living will. This form complies with all applicable state statutory laws. Uniform Anatomical Gift Act Donation – This Uniform Anatomical Gift Act Donation form pursuant to state statutes designates the specific body parts and organs an individual wishes to donate at the time of death. An anatomical gift of all or part of the body may be made by will or by a document of gift other than a will that is signed by the donor. This form must be witnessed and the signature notarized. Revocation of Uniform Anatomical Gift Act Donation - This is a Revocation of an Anatomical Gift Donation. An Anatomical Gift Donation states that one wishes to donate his/her organs to others upon their death. A donor may amend or revoke an anatomical gift, not made by will, only by a signed statement such as this form, an oral statement made in the presence of two individuals, any form of communication during a terminal illness or injury addressed to a physician or surgeon or by delivery of a signed statement to a specified donee to whom a document of gift has been delivered. The donor of an anatomical gift made by will may amend or revoke the gift in the manner provided for amendment or revocation of wills or as set out above.
