Instructions ; 2. Forms List ; and 3. Access to Louisiana Law Summary. I. EXPLANATION OF PETITION FOR CHANGE OF NAME A. In Louisiana , an action for a court ordered Change of Name begins with the filing of a Petition in the District Court in the parish in which the Petitioner resides. The Petition must contain certain information. The forms in this packet include the necessary informa tion for A Minor Name Change in the State of Louisiana. B. You can use this packet if: ► You are a resident in the county in which you will file. ► You have proper and reasonable cause for the requested change of name. ► You are not changing yo ur name to avoid debts or defraud creditors. II. WHAT FORMS ARE INCLUDED 1. Civil Coversheet - (LA -NC -202) The document in which you provide the court certain information about the parties. 2. Petition for Change of Name - (LA -NC -200) This document states the reasons and other required details for your name change. 3. Consent – (LA -NC -203) This document provides the written consent of any interested party to the granting of the requested name change. Use one form for each parent. 4. Ci tation – (LA -NC -103 -08 -04) This is the formal order of the Court that the District Attorney of the Parish in which the name change action is filed either responds with a written statement of objection to the name change petition or file a waiver of any obj ection. 5. Waiver – (LA -NC -104 -08 -04) This is the form used by the District Attorney to waive any objections to the Petition for Name Change. 6. Judgment – (LA -NC -201) This is the final statement of the legalities and terms of your name change. Once this form is signed by the Judge and filed with the court, the name change is effective. If you did not order a completion package and need access to the download page again for any of the above forms, please check your email for a link to that will redisplay t he page for you. NOTE: Some courts in Louisiana require that legal forms be printed on legal size paper – 8.5 X 14. We have contacted a number of clerks in the district courts in Louisiana and have been advised that they generally will accept forms on standard 8.5 X 11 inch paper when submitted by Petitioners representing themselves. Since few customers have printers capable of printing legal size paper, we have elected to print and format all Louisiana Name Change forms on 8.5 X 11 inch paper. If you are told that your forms must be on 8.5 X 14 inch paper please contact us and we will format a set for legal size paper and send them to you. PROCEDURE FOR CHANGE OF NAME (Minor) FOR THE STATE OF LOUISIANA A. Preliminary Note: 1. The attached forms may be completed by: a. Printing the forms and completing by hand. Use black ink and print neatly. b. Printing the forms and completing using a typewriter. c. By completing the forms on your computer using a word processing program and then printing the forms. 2. Use complete n ames and not initials. Check your spelling carefully, a misspelled word can delay your name change. 3. Print three (3) complete sets of forms. You will need at least one for filing with the court, one copy of the petition, Citation, and Waiver for servi ce on the on the District Attorney, and one complete set to be file stamped and retained in your files. 4. All forms with a heading – the name of the court, the Petitioners’ name, the case number, and the name of the document – require that the heading be completed. You will need to add the name of the court and the full name of the Petitioners. The “Docket No.” will be assigned by the clerk when you file the Petition. 5. Sign the Petition before a Notary Public and have your signature notarized. Use y our complete name – first name, middle name, and last name. 6. When a form is filed with the court, request the clerk “file - stamp” one c opy of the form for your file. 7. A Law Summary is available and can be printed for your State. To do so, go to the la st page of this package. Please review the law summary before beginning the p rocess of completing the forms. B. Procedure Step 1: Complete all the forms using complete names – middle names instead of middle initials. Step 2: File the Petition for Change of Name in the District Court in the parish in which you reside and pay the appropriate fee. Step 3: Service on the District Attorney for the parish is required. A copy of the Petition for Change of Name, Citation and Waiver must be served on the District Attorney. This will cite the District Attorney to answer the Petition. Step 4: Since this is a Petition for the Name Change of a Minor, the law requires the Petition to be signed by the father and mother unless one parent h as been granted custody. Then the consent of the non -custodial parent is not necessary if: (1) the other parent has failed to obey a court order for support for a period of one year; or, (2) the other parent has failed to provide support for three years f ollowing the judgment for custody; or, (3) the other parent is not paying support and has failed to visit or communicate in two years; or (4) the other parent has failed to visit or attempt to communicate without just ca use for a period of ten years. Step 5: After filing the Clerk will provide you additional directions of how to proceed. Step 6: Appear as directed by the Clerk and present the Proposed Judgment. At the hearing, any persons objecting to the requested Name Change will be heard by the Court; and the Court may examine, upon oath, the Petitioner(s) or other pe rsons concerning the Petition. Step 7: Obtain a certified copy of the Order from the Clerk after it has been signed by the Judge. You are now ready to notify appropriate persons and gover nmental agencies of the change. NOTE ABOUT COMPLETING THE FORMS The forms in this packet contain “form fields” created using Microsoft Word. “Form fields” facilitate completion of the forms using your computer. They do not limit you ability to print the form “in blank” and complete with a typewriter or by hand. To unlock click on “Tools” in t he Menu bar and then selecting “unprotect document”. You may then be prompted to enter a password. If so, the password is “uslf”. That is uslf in lower case letters without the quotation marks . After you make the changes relock the document before you being to complete the fields.
