The function of this office is to mediate a dispute between a consumer and a business in accordance with state law. See: Section 75-24-1 et. seq., Miss. Code Ann. (1972) In this case, Mr./Ms. expressed that he/she contracted with d/b/a to install a custom fit liner. According to Mr./Ms. , your client represented that he/she would be able to patch the bottom of the pool and put in a custom fit liner because the bottom of the pool was not in "that bad a shape". In addition, Mr./Ms. relates that your client said that the color of the liner had no bearing on the job he/she contracted to do. However, after Mr./Ms. installed the liner he/she said that, "he/she did not know the liner would accent the ripples or wrinkles." Mr./Ms. further relates that your client was well aware of the condition of the pool when he/she made the estimate on the job at issue. Specifically, the water was drained and Mr./Ms. was able to observe the bottom of the pool before he/she gave quotes and undertook the job. He/She did not mention that the pool needed resurfacing because "several problems existed", e.g., the septic system and Mr./Ms. maintains that he/she does not have a problem with his/her septic tank. The yet unresolved issue is whether your client is willing to either (1) return Mr./Ms. ’s $ for a job he/she feels he/she did not complete or (2) complete the job by installing a new liner and receive the last of his/her payment for the professional job he/she contracted to perform. As Mr./Ms. stated in his/her letter to you dated , it was Mr./Ms. who failed to complete the job within the required time, left the liner exposed and therefore was directly responsible for rodents damaging the liner he/she purchased. The liner was left in the sun. Mr./Ms. who holds himself/herself out as an expert in pool services left the liner unprotected.
