- 1 - PREMARITAL AGREEMENT READ BEFORE SIGNING: IMPORTANT NOTICE: EACH PARTY TO THIS AGREEMENT AGREES THAT THEY HAVE HAD AN OPPORTUNITY TO CONSULT WITH AN ATTORNEY OF THEIR CHOICE LICENSED TO PRACTICE LAW IN THEIR STATE OF RESIDENCE (NOT THE SAME ATTORNEY) AND THAT HAVE FULLY READ, UNDERSTAND AND AGREE TO THE TERMS OF THIS AGREEMENT. EACH PARTY FURTHER AGREES THAT THEY ARE NOT ACTING UNDER DURESS OR UNDUE INFLUENCE IN EXECUTING THIS AGREEMENT AND THAT EXECUTION OF SAME IS DONE FREELY AND VOLUNTARILY. THIS AGREEMENT, made this ____ day of ________________, 20____, between ___________________________ (Name), of ______________________________ (Address), _____________ (State) ("first party or Wife"), and _____________________ (Name), of ____________________________ (Address), _____________ (State) ("second party or Husband"), W I T N E S S E T H WHEREAS, Husband (check all that apply): has previously been married; has a child or children; has not been married; and Wife (check all that apply): has previously been married; has a child or children; has not been married. The parties desire to enter into this agreement prior to their contemplated marriage. WHEREAS, the parties hereto have accumulated separate estates; and WHEREAS, the parties are about to contract marriage and execute this agreement in contemplation of marriage to be effective upon their marriage in accordance with the laws of the State of Alabama, including any Uniform Premarital
Lity provisions. For the purposes of this agreement, the parties are the “first party and wife‭" and "the second party and husban”‭". First party is the person who is or will be the father of the child. Wife is the person who will be the mother of the child. It is understood that this agreement will be binding upon them if they marry and upon them if they divorce. Second party is the person who will be the spouse of each parent, and each spouse is aware of this agreement upon marriage. The agreement is irrevocable. To consummation , and to all the other requirements thereof, the parties each sign and date herewith and the witnesses duly authenticated. First party agrees that each of the other parties has read all documents and evidence relating to the matters to be covered by the agreement, including all the terms, conditions and stipulations thereof, but has not signed and filed such agreement herein except as hereinafter mentioned in the attached agreement. Signed, executed, this day of april, 20, 20. In witness whereof, the undersigned: (signature) "second party," or the agent of such second party has been duly authorized under federal law for the third party, (if any) to sign this contract, and such second party hereto agrees and submits that the signatures and other documents, including but not limited to, the executed documents, the agreement and any attachments, the executed contracts and agreements with respect to such parties, the execution of which is required hereby, as set forth, under the provisions of federal law; and provided, that the second party, if any, may, prior to such execution, obtain an opinion from an attorney of his choice licensed to practice law in his state of residence (not the same attorney) and, if a married attorney, may have a legally executed agreement with respect to the agreement of marriage, which agreement has been read to him by his attorney and approved by him, and which approval is recorded by the court in his presence, the receipt of which has been acknowledged by the second party and his attorney. Second party confirms, in writing to each of the first party and wife that he has received and read this agreement in the presence of his attorney and has approved of it. Second party also confirms, in writing to each of the first party and wife that he hereby irrevocably transfers, assigns and conveys.
