Status Quo Order Application Packet Packet No. 12 Instructions This process is authorized by ORS 107.097(2) for certain cases involving child custody issues. The underlying case must have already been filed, or must be filed at the same time as the forms in this packet are filed. This packet cannot be used if there is no active custody case. Please note these forms are not intended for use in a proceeding to modify an existing judgment establishing custody. STEP 1: Fill out the forms according to the instructions below. The case heading (names and case number) at the top of each form will be the same as it is on the petition that started your case. 1. Affidavit . *Fill out the form completely, except for the signature lines on page three. Sign the signature line on line 12 when you are in front of a court clerk or notary public. Attach a certified copy of any other existing custody, parenting time or visitation order affecting the children involved in this case. 2. Ex Parte Motion . *Fill out the form completely except for the signature line on page two, line 13. 3. Order . *Fill out the form except for the date and judge’s signature line on page two and the signature line on page two, line 25. 4. Certificate of Document Preparation . *Fill out the form completely. STEP 2: Get your papers reviewed by Dissolution Resource Services to make sure the paperwork is filled out appropriately. Next, get your papers reviewed and signed by a judge. You may ask the information clerk which judge is the ex parte judge. Take your documents to the ex parte judge for signature (or another judge if the ex parte judge isn’t available). STEP 3: Make two copies of the AFFIDAVIT, MOTION and signed ORDER (one for service; one for your records). Sign the copies on the line below the words, “I certify this is a true copy.” Status Quo Order Application Packet No. 12 Instructions1 STEP 4: File the original documents (AFFIDAVIT, MOTION, ORDER, CERTIFICATE OF DOCUMENT PREPARATION) with the court clerk. STEP 5: Take a copy of the AFFIDAVIT, MOTION and ORDER from step three to the Marion County Sheriff’s Office (basement of the Courthouse), along with a service fee ($25).
