Summary Dissolution Process for Petitioners (Packet No. 1) Step 1. Step 2. Step 3. Step 4. Fill out the following forms:  Petition for summary dissolution (form 1)  Certificate of residency (form )  Summons (form 3)  Certificate of document preparation (form 5)  Record of dissolution of marriage or annulment form (vital statistics form) File the original forms listed in step one with the clerk ( except the summons, form 3), and pay your filing fee (or give the clerk a copy of your fee deferral form if the judge has deferred your fees). 1. Serve true copies of the following forms on your spouse:  Petition for summary dissolution (form 1)  Certificate of residency (form 2)  A copy of handouts given to you in groups of two by the clerk at the time you filed your petiion.  Summons (form 3) 2. An affidavit of proof of service and the original summons must be filed with the clerk after your spouse is served. 1. Wait 31 days from the day your spouse was actually served. 2. Check with the court clerk to see if your spouse has filed a response with the court. 3. If no response is filed, go directly to step 7. 4. If a response has been filed, you can’t continue to use the summary dissolution procedure. Go to step 5 Step 5. Step 6. Step 7. Step 8. 1. Contact an attorney for assistance. 2. If there is a disagreement on how your property or debts should be distributed, your case will be referred to arbitration. 3. Participate in arbitration (pay the arbitrator’s fee and attend all hearings). 1. Go to all court appearances. 2. The judge may ask you or the other party to prepare a final decree outlining the issues that were decided upon during the arbitration and trial. 3. Your marriage will terminate the date the decree is signed by the judge. (Please disregard the next steps). 1. If your spouse didn’t file a response, fill out the following forms and file them with the court:  Petitioner’s affidavit, motion and order for default decree of dissolution (form 8)  Certificate of document preparation (form 5) 1. Wait until 90 days from the service of the papers in step three has been made on your spouse, fill out the following forms and file them with the court:  Decree of summary dissolution (form 9)  Affidavit application for decree  Certificate of document preparation (form 5) 2. Your marriage will terminate the date the decree is signed by the judge.
