Deductions for Training Training Expense Agreement The terms of this Training Expense Agreement are predicated on your attending and successfully completing a training course as an employee of ___________________ (“THE COMPANY”) for which THE COMPANY has advanced full or partial expenses and with the understanding that you will continue active employment with THE COMPANY following completion of the training. As part of THE COMPANY's Training Program, THE COMPANY agrees to advance training expenses, consistent with company policy, for you to attend: Course: _____________________________________ City, State: __________________________________ Scheduled: ___________________ to ___________________ Total Training Amount: $ _____________________________ The Total Training Amount includes the direct cost of the class, training materials, travel, lodging, your benefits costs, and your compensation costs (including taxes). The Total Training Amount is considered by THE COMPANY to be an investment on your behalf to benefit you. This Total Training Amount is considered a payroll advance to aid in your development. In consideration of the training provided to you, you agree to the following terms:  If you voluntarily terminate your employment with THE COMPANY prior to completing six (6) full, consecutive months of active service with THE COMPANY, following completion of the training, you will immediately refund the Total Training Amount to THE COMPANY.  If you voluntarily terminate your employment with THE COMPANY prior to completing twelve (12) full, consecutive months of active service with THE COMPANY, following completion of the training, but do complete six (6) or more full, consecutive months of active service with THE COMPANY, following completion of the training, you will immediately refund to THE COMPANY an amount which is equal to: Total Training Amount divided by 12 (multiplied by) 12 minus the number of full, consecutive months of active service with THE COMPANY, following completion of the training.  If any refund is due THE COMPANY, you agree that the amount is payable in full immediately via personal check or payroll deduction at ___________________ , and you agree to permit THE COMPANY to deduct this amount from any monies or benefits, including vacation pay, due you (including wages, bonuses, and/or expenses).  If any action or proceeding is brought to enforce any provision of this Agreement by THE COMPANY or if THE COMPANY is required to refer any matter arising under this Agreement to an attorney, you agree to pay all costs of collection (including interest at the highest rate permitted by applicable law) and litigation, together with reasonable attorney's fees. Neither this Agreement, any other agreement, nor any company practice creates any contract of employment between you and THE COMPANY.
