I have to ship something to my friend in the UK and I don't know where to start hello thank you for joining this online video in this session I'm going to answer your questions about US export controls how do I know if I need an export license before determining your export license requirements it's important to note which agency has jurisdiction over your export bis has jurisdiction over the vast majority of commercial items and some military items the Directorate of Defense trade controls has jurisdiction over sensitive defense articles and all defense services the Office of Foreign Assets Control has jurisdiction over economic and trade sanctions this video is intended to help you understand what you need to know about items subject to the Bureau of Industry and security xerus diction's bis administers the export administration regulations also known as the e AR once you know that your item is subject to the e AR the next step is to determine the Export Control classification number or ec ZN of your item is it difficult to determine the ec c n it varies you may need to have detailed product specifications there are three ways to determine your EC CN first you can ask the manufacturer what the classification of the item is second you can self classify by reading through the Commerce control list third you can request the is to classify the item for you once you know your EC CN you can determine most of your export obligations each EC CN entry will indicate the reasons for control for your item the reasons for control B is regulates the export of items for a variety of reasons national security crime control to limit the proliferation of nuclear weapons to name a few each ECC enlisting will tell you the reasons for control this ECC n is 3 B 0 0 1 this controls equipment for the manufacture of semiconductor devices or materials and specially designed components and accessories the reasons for control are NS column 2 & 80 column 1 what are NS column 2 and 80 column 1 this is the perfect time to introduce you to the Commerce Country chart the commerce country chart contains licensing requirements based on destination and reasons for control as you can see NS stands for national security a T stands for anti-terrorism the number stands for the specific column 1 2 or 3 under the reasons for control so if I a semiconductor equipment controlled under 3 B 0 0 1 does that mean that I have to apply for a license well it depends to determine if you have a license requirement you add cross-reference the appropriate column of the reason for control with the country of destination for example if you plan to export the semiconductor equipment Angola there is no X in the Box in 80 column 1 but there is an X in the box under NS column 2 that means based on item and destination there is a license requirement now what if you are exporting your semiconductor equipment to Argentina follow NS column 2 and 80 column 1 down to Argentina and there are no X's in either box that means based on item and destination there is no license requirement there seems to be a lot of X's I guess I'll be applying for a lot of licenses not necessarily even if there is an X in the Box there might be a license exception available that authorizes the export without having to submit a specific license request a license exception what's that a license exception is an authorization under the e AR that allows you to export that would otherwise require a license as long as the export transaction meet specific criteria described within the license exception so I determine my EC CN that will give me the reasons for control then I review the commerce country chart if there's an X in the box I have a license requirement I might be eligible for a license exception you've got it and if there is no license exception available then you will need to submit a license application to be is how do I get licensed and how much is it cost license applications are submitted online through bis is web portal snap R you will need to identify what you plan to export to whom and what the end-use is most license requests are processed within 30 days and there is no fee to apply for a license okay so what happens if there's no X in the box if there is no X in the box that means there is no license required based on the item and the destination however there could still be a license requirement based on the end user or the end-use like no Acme anvil is going through Wiley coyote that's a fair analogy the US government restricts exports to certain end users of concern choices exporters there is a searchable database called the consolidated screening list that lists companies organizations and individuals that have some limitation on their ability to receive items subject to the e AR if your customers name is on any of the lists you might need to apply for a license and you'll probably not be able to use a license exception what about the end use certain end users could trigger a license requirement as well for example if the an use is to support nuclear missile or chemical and biological weapon activities that might require a license to certain destinations so screen the customer against the consolidate screening list and know the end use before exporting okay got it what if I want to export my lecture guitar to a friend in Germany saw a rock band I don't see electric guitars on the Commerce control list you bring up a noteworthy point not all items are described on the Commerce control list actually a lot of consumer goods such as clothing food furniture and musical instruments will not be found in the Commerce control list items that are subject to the EA are but not described in the Commerce control list are designated EA r99 these items do not have a specific reason for control therefore therefore you do not need the commerce country chart to determine the license requirements that's correct if you're exporting an EA r99 item you'll have a license requirement in very few situations such as if you're shipping the item to a terrorist supporting country or to Cuba what other situations do you think would require a license for EA are 99 items the end user and the end use you are absolutely right the end user or the unused could trigger a license requirement even if the item does not otherwise require a license to a specific destination okay so I can export my electric guitar to my friend the UK immediately if he's not on any of the restricted anywhere less than yes we can export immediately export paperwork whether it's at a port or the post office typically requires you to identify what you're exporting any idea what you would put yeah our 99 and no license required that's correct if you're exporting under a license you would include the EC CN or EA our 99 and under license information you would include the license number if you're exporting under a license exception you would include a license exception code and if no license is required well you simply state no license required or NLR wow that's a lot of information yes it is but the stakes are high we want to be sure that the right items are getting to the right people the last thing anyone wants is for sensitive items to get to the wrong hands this could be detrimental to our national security agreed are there hefty penalties for people who don't follow the EA are potentially I know this is a lot to take in bis has a website loaded with detailed information and we also have counselors available to help you work there any questions you might have got it what's the website and how do I reach the counselors the bis website is WWE do see govt export counselors are available in Washington DC and California to answer your questions as well thank you for watching this online video and happy exporting
