some comments of people asking after our last video right about the dishonesty cases well what do you do when your boss tells you to lie now i got my story and i'm gonna leave this to the end and i may have a solution to how to fix this and we got a bunch of info to go go over but i got greg and tony on here and we're gonna get into this but first let's get the disclaimer the facts dates and opinions all of you share to protect it under the national labor relations act tony i'm going to let you start up first do you have a story to share with us as far as a supervisor instructing somebody to do something that just wasn't right well i mean geez there's so many there was a driver who was told when he got back to the building to just throw the packages onto the belt these are packages that were missed it was one of those days you know during the holidays it gets pretty heavy and uh they can't finish the load whatever they have like maybe five or ten pieces they couldn't get to or maybe they just had a few off routes sometimes it's just a few off routes oh just toss you off right on the belt they don't belong to our center anyway or something like that every package in your package car has to be sheeted i've seen people go into the office for it they want to always bring you in when you're not shooting your packages you know it's it's missed you're not going to get in trouble for shooting miss i mean the worst they can do is get take you in the office and ask you why or whatever the reason is but you're not going to lose your job over it you know it's a talk with that most so you know don't don't lie or don't and if that supervisor is telling you to throw those packages on the belt i mean for the most part that's word of mouth right so the first thing you want to do is let your steward know what he told you to do and you know as soon as you get a chance and then you know and if the supervisor wasn't the center manager let the center manager know also maybe he's not even made aware of it but you want to let more than one person know what you were told to do in case it comes back to bite you in the rear so you know the the member in question through the packages on the belt and then uh the next day they're looking to try to you know say that he did something that he wasn't supposed to do obviously and uh you know he didn't really he had he was lucky enough that he did speak to a steward and he was um you know the other guy was reprimanded didn't lose his job but he should have because if it was on the other side it would have been the kid that lost his job but he ended up getting moved to another center or whatever greg do you have a story to share with us i do but before i do i'm going to second everything tony just said because you have to let your steward know whether you're in the building your steward can be a witness to that conversation if you're on the road your steward will be able to tell you yes you should do this it's not an issue or no you should not do that or or whatever it is and everything should be through the dyad because we have a right under the new contract to a copy of all the messages that are sent through your diet every day when you get off the road you come in you say i want all my messages because they have to give you a copy at that moment they cannot say no what article is that uh it's an mou at the end of the uh the master agreement there you go it's a way there so people don't know that it's there and not only that but your your steward or your ba also has a right to those messages so it's not just up to you if you forget or you don't want to do it because you're for whatever reason you're you can have your steward get those messages for you um so and the the thing about telling the center manager because tony's 100 right that nine times out of ten the center manager doesn't even know that's going on or wants to pretend they don't know that's going on and so putting them on the spot you know goes a long way my story is actually about me even though i was a steward um i had a uh part-time supervisor uh pre-load supervisor who was not a rookie this guy who had 20-plus years in and he came out in his personal car and met me on the road and i really don't remember why and he said we had a short conversation he pulls out an envelope says hey shoot this for me so i can go drop it off on my way in and i was like are you joking no no i just shoot it right now it's like because i don't have a board wow there's absolutely no way i'm shooting that package not a chance this fits falsification of records i'm nowhere near that place i'm not making the delivery you shouldn't be delivering that's wrong on on seven levels and and of course again i'm the steward so my initial and immediate response was to call the center manager and say hey a you know this is going on and b if this guy is doing this to me and i'm the steward what in god's name are your people doing everybody else we had a driver soup that was basically doing a lot of this unethical stuff it was playing like it was so bad it was almost like playing whack-a-mole with everybody and he you know a lot of these javascripts know who to target when it comes to this stuff you know they'll feel people out and be like oh these are the guys that file these are the guys that fight for the rights these are the and then he's got the the separate pile of people that kind of just do whatever they're told so apparently we had a driver that got pulled into the lost prevention they pulled me into loss prevention with this driver and loss prevention if you've ever been there they ask you a series of questions right and the series of questions went along the lines of uh basically how do you deliver a stop and you know whether proper methods right and the driver said everything correctly and then they're like well why on this day did you she all these packages as driver released at a commercial stop and he said well the supervisor told me to do so and so what ended up happening what we've come to find out was the driver actually went to all the stops all the businesses were closed it was like seven o'clock at night six o'clock at night and he cheated him all missed right until management now he's got she always missed he got a call from a supervisor supervisor says cancel all those myths just driver release all of them and come back well then one of the customers came in the next morning and saw other packages sitting there being driver released they called the 1-800 number on them right driver goes up to the loss prevention they question them about his integrity if he's if they need a firearm or not you know uh a lot he tells lost prevention the supervisor told him to do this well guess what the supervisor responded by i never told him to do that yeah i didn't nope never said that so now it's a he say shisei case you know what i mean uh luckily the guy was able to keep his job that time but the supervisor was so bad that it was like playing whack-a-mole and this is what i personally did and it actually seemed to work to stop it i don't know if this was the correct way of doing things but it was so bad i started following article 37s on uh whenever he told somebody to do something that was unethical whenever he instructed someone to do something getting fired i get a statement from that driver and file an article 37 and i told him listen because he wasn't like the screaming type of supervisor he's very calm he just did a lot of stuff that was questionable so i told them listen man i'm going to be straight with you like these grievances they're going to go to panel unless you stop you know if you stop but the with this crap i'm not going to bring them to panel i'm going to tell my business agent don't worry about don't bring a panel now whether that would have worked or not i don't know the reason why i i want that route is because i know that these supervisors when they lie to their upper management they get their asses in trouble now do they lie yes if their manager tells them to lie of course they're gonna lie so don't think that they're the 100 percent most honest people but if their manager if they're at the division manager finds out that one of the driver suits is lying to him they usually come up to him and say listen we're gonna either demote you but they'll be gonna move them or you can leave you can quit and that's like the two options they give them from my experience seems like nobody ever gets fired there you know what i mean yeah yeah so it's just like even if they lie if we lie we get fired if they lie you know and it's their boss doesn't think it's cool all they'll do is just move them around it seems like um i've seen people get moved so far away it's crazy well i will say one thing uh over the last couple of i would say a year or so um i don't know if it's because of the change in the ceo and you know management uh getting the act some of the management up top but we at local 804 have seen some of management personnel lose their jobs for falsifying records really yeah a lot of them too some of them were for hiding injuries um some of them were for actually trying to say people didn't make book when they did make book which you know when we say make book for those that don't know we mean like getting into the union making your uh in our our local within uh 40 day 40 days within a 70 day period there uh there was a manager lost their job for that i mean there there's managers have lost their jobs you just have to it takes a lot to prove it you got to make sure you have the paperwork you have the proof but if you can get it to upper management and you know get lp involved uh they have they can't lose their jobs so don't lose hope you just have to you got to get them dead to rights but you catch their hand in that cookie jar they'll be gone talk to your steward stay off the cell phone phone conversation is is anybody's guess as to what that said people pull out their call log look i talked to them like nobody knows what you said in that conversation and and management will deny they're going to deny it to the end of time so send everything through the dyad get a copy of your messages and tell your steward what's going on absolutely remember you're supposed to work
