- 1 - Contract for Deed CONTRACT FOR DEED THIS DAY this agreement is entered into by and between _______________________, hereinafter referred to as "SELLER", whether one or more, and _______________________, hereinafter referred to as "PURCHASER", whether one or more, on the terms and conditions and for the purposes hereinafter set forth: 1. SALE OF PROPERTY For and in consideration of TEN DOLLARS ($10.00) and other good and valuable considerations the receipt and sufficiency of which is hereby acknowledged, Seller does hereby agree to convey, sell, assign, transfer and set over unto Purchaser, the following property situated in ___________________ County, State of Georgia, said property being described as follows: (Type description or attach description as exhibit "A") Together with all rights of ownership associated with the property, including, but not limited to, all easements and rights benefiting the premises, whether or not such easements and rights are of record, and all tenements, hereditaments, improvements and appurtenances, including all lighting fixtures, plumbing fixtures, shades, venetian blinds, curtain rods, storm windows, storm doors, screens, awnings, if any, and ____________________________________________now on the premises. SUBJECT TO all recorded easements, rights-of-way, conditions, encumbrances and limitations and to all applicable building and use restrictions, zoning laws and ordinances, if any, affecting the property.
In consideration of the receipt and sufficiency of this offer, purchaser agrees that such property is sold, assigned, transferred and conveyed by such conveyance to seller. (type description or attach description as exhibit) if any part of this contract is invalid or ineffective, the validity or other effect of the remainder of this contract shall not be affected. 2. If any part of this contract is invalid or ineffective, the seller hereby authorizes and directs the removal of any and all fixtures, fittings, appliances, conveniences and improvements, and their removal from the premises, in whole or in part, at any time before delivery of such property, and the seller hereby warrants to purchaser, on the day, not more than one year nor less than thirty days after the contract is signed, the correctness of any removal and storage notice or other written notice delivered by or on behalf of the seller prior to such removal. 3. If any part of this contract is invalid or ineffective, the seller hereby releases to purchaser, on delivery of such property, all lien, encumbrance, restriction or other condition or restriction on the right or title to the property in any manner, including but not limited to lien, encumbrance, restriction, capital, trust, estoppel or any other right or remedy. 4. The terms and conditions of this contract are the same as if all the conditions contained herein were satisfied. 5. The purchaser may, at his own option, withdraw from this contract in five days for any reason, with notice of at least fifteen days, if in his opinion, this agreement is not in your best interest. The purchaser shall be responsible for all costs of clearing, grading, packing, storage and shipment of the property and payment harbor will be made by cash, invoice, check, money order, wire transfer or other acceptable form of payment authorized by the seller. Seller is liable for costs of handling, shipment, delivery and taxes and charges. 7. By attending a sale the purchaser does hereby expressly.
