Further, Lessee shall not violate any state or federal game or prohibition laws or pure food laws in Lessee's use of Locker. 4.Indemnification Lessee shall indemnify Lessor fully in the event that Lessee violates or is charged with violating any state or federal game or prohibition laws or any federal pure food laws. 5.Inspection of Locker Lessor shall at all reasonable times have the right and authority to open Locker and inspect its contents. 6.Default Failure of Lessee to pay rent for locker when due or breach by Lessee of any of the covenants contained in this Lease Agreement shall, at the option of Lessor, immediately terminate this Lease and forfeit all rights of Lessee to Locker and its contents. On default of Lessee, Lessor shall have full right and authority to take immediate possession of Locker and, without process of law, appraisement, or notice to Lessee, to sell or dispose of all or any part of the contents of Locker at any public or private sale. 7.Cancellation Lessor reserves the unqualified right, at any time, to cancel this Lease on refund of that part of the rent for the month of cancellation proportionate to the remaining portion of that month. 8.Effect of Agreement The relationship between Lessor and Lessee shall be that of landlord and tenant. This Lease is and shall constitute the only contract existing between Lessor and Lessee. 9.No Waiver The failure of either party to this Agreement to insist upon the performance of any of the terms and conditions of this Agreement, or the waiver of any breach of any of the terms and conditions of this Agreement, shall not be construed as subsequently waiving any such terms and conditions, but the same shall continue and remain in full force and effect as if no such forbearance or waiver had occurred. 10. Governing Law This Agreement shall be governed by, construed, and enforced in accordance with the laws of the State of ______________________________. 11. Counterparts This Agreement may be executed in any number of counterparts, each of which shall be deemed to be an original, but all of which together shall constitute but one and the same instrument.
