C.Cr.P., this defendant maintains that the evidence was illegally obtained in violation of his rights guaranteed to him by the Fourteenth Amendment to the U.S. Constitution as well as those guaranteed by Art. 1, Sec. 5 of the Constitution of the State of Louisiana. Specifically, the defendant asserts that the item seized (marijuana) was obtained without a warrant and that the circumstances surrounding the seizure did not justify a search and seizure absent a warrant as provided for by both the U.S. and State of Louisiana Constitutions. SUMMARY OF FACTS According to La. State Trooper, _______________ = s arrest report, on _______ ___ , 20 ___ , at _______ hours ( _______ o’clock ___ .M.), Trooper _______________ observed a _______ van traveling eastbound, bearing Texas License Plates on rear of vehicle. Trooper _______________ stated that he stopped defendant = s vehicle for a violation of La. R.S. 47:507, improper display of plates, because said vehicle did not display a license plate on the front of the vehicle. No other violations were noted in report. La. R.S. 47:507(A) reads, A The registration license plate assigned to a trailer, semitrailer, motorcycle, or other motor vehicle shall be attached to the rear thereof . @ ARGUMENTS It is the position of the defendant that, according to Trooper _______________ = s own statements contained in his arrest report, Trooper _______________ did make an illegal stop of defendant = s vehicle and thereafter violated defendant = s rights by making an illegal search and seizure. CONCLUSION For the foregoing reasons, the Motion to Suppress should be granted. Sincerely, _______________
