Release and Waiver of Liability Given by Customer and/or Property Owner in Favor of Owner of Bounce House including Assumption of all Risks of Bodily Injury Whereas, ___________________________________________ (Name of Bounce House Owner) of _____________________________________________________________________ ___________________________ (street address, city, state, zip code) , hereinafter called Owner , provides bounce houses for recreational purposes at various locations; and Whereas, the bounce house provided pursuant to this Agreement ( ) will ( ) will not include a slide; and Whereas, the undersigned _________________________________ (name of customer), hereinafter called Customer , desires to rent a bounce house from Owner from _______________ ____________ (date) to ______________________________ (date) with the bounce house to be place at _______________________________________________________________________ _____________________________________________ (street address, city, state, zip code ; and Whereas, Owner will not rent a bounce house to C ustomer unless Customer signs this Agreement; Now, therefore, for and in consideration of being allowed to rent said bounce house as aforesaid, Customer hereby releases Owner, his/her employees, agents, and assigns (collectively Releasees) from all liability to the undersigned for any loss or damage to property, physical injury or death whether caused by Releasees or otherwise that result, directly or indirectly from the use of said bounce house as set forth above. The undersigned further agrees to indemnify, save and hold Releasees harmless from any loss, liability, attorneys ’ fees, damage, or costs that they (or any of them) may incur arising out of or related to the renting of said bounce house as described above whether caused by the negligence of the Releasees or otherwise. The undersigned further covenants and represents that I have read this document; and that I voluntarily signed this Release, Waiver of Liability and Assumption of Risk . This Agreement shall be governed by the laws of the State of ______________________ and the Parties agree that any legal action relating to or arising out of this agreement shall be brought exclusively in binding arbitration in __________________________________________ (city, state) and subject to the Rules of the American Arbitration Association.
