For and in consideration of the mutual covenants contained in this agreement,
and other good and valuable consideration, the receipt and sufficiency of which is
hereby acknowledged, the parties agree as follows:

2. Host recognizes that it is possible that some or any of his guests may consume
more alcohol than is prudent and that injuries to such guest may occur as a result of
such conduct of guest, including, but not limited to, driving under the influence of
alcohol. In consideration of having LLC provide said bartenders, Host knowingly and
expressly waive any claims that Host may have or hereafter acquire against LLC, its
bartenders, members and/or employees as a result of such conduct of said guests and
any injuries to such guests, including death, that results from such consumption.
3. Host agrees to indemnify LLC, its bartenders, members and/or employees and
hold them free and harmless form any liability that results from such conduct of any
guest described in Paragraph 2 above, including liability for any injuries to such guest,
including death.
4. For purposes of this Agreement, liability shall means all claims, damages,
liability, losses, costs and expenses, court costs and reasonable attorneys' fees.
5. This Agreement shall be governed by, construed, and enforced in accordance
with the laws of the State of ____________.
6. This Agreement shall constitute the entire agreement between the parties and
any prior understanding or representation of any kind preceding the date of this
Agreement shall not be binding upon either party except to the extent incorporated in
this Agreement.
7. Any modification of this Agreement or additional obligation assumed by either

signed by each party or an authorized representative of each party.

administrators, successors and assigns, singular includes plural and masculine includes
feminine.
