Short Term Rental Agreement with Rental Rules This Short Term Rental Agreement (the Agreement) is made on the ________________________ (date), between ________________________ (Name of Homeowner) of _________________________________________ (street address, city, county, state, zip code), referred to herein as Owner; and ________________________ (Name of Guest) of _____________________________________________ (street address, city, county, state, zip code), referred to herein as Guest. For and in consideration of the mutual covenants contained in this Agreement, and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties agree as follows: 1. Owner leases to Guest and Guest leases from Owner, for the term of this Agreement, the house located at _____________________________________ (street address, city, county, state, zip code), and being hereafter referred to as the Property. 2. Guest shall pay to Owner a security deposit of $__________________. If Guest fully complies with all terms of this Agreement, Owner shall return the security deposit at the end of the lease term. If Guest does not fully comply with the terms of this Agreement, Owner may use security deposit to pay amounts owed by Guest, including but not limited to damages, repairs, losses, charges, cleaning, and telephone. Owner shall return the security deposit to Guest, less any deductions, after inspection of the Property. 3.The term of this Lease is for _______ (number) __________________ (weeks or days), beginning on __________________ (date) at __________________ (time of day) and ending on __________________ (date) at __________________ (time of day). The rent for this Lease is $______________ per (week or day). Payments must either be in cash or by check payable to Owner at _________________________________________ (street address, city, county, state, zip code). 4.The maximum occupancy of the Property is _______ (number) persons. The Property will be used during the above dates for no more than _______ (number) adults (persons age 18 or older) and _______ (number) children. No pets are allowed. No more than _______ (number) automobiles are allowed. 5.Owner shall provide water, electricity, and heating. Local telephone calls when available are free, with long distance calls to be charged to Guest's calling card, credit card, or called party. No cleaning services are provided. Guest must leave the Property broom-clean upon departure. 6.All furniture, furnishings, appliances, cooking and serving utensils, and other personal Property of Owner shall be left in good order and repair by Guest. If Guest fails to leave such property in good order and repair, Owner may make repairs and charge Guest the cost of repair over and above the security deposit. Guest must not alter, change, or add to the Property without permission from Owner. 7. Owner has the right, at reasonable times, to enter the Property to examine, make repairs, or show the Property to potential guests. 9. Owner shall not be responsible for the loss of or damage to property or injury to persons, occurring in or about the Property, by reason of any existing or future condition, defect, matter, or thing in the Property or for the acts, omissions, or negligence of other persons or Guest in and about the Property. Guest agrees to indemnify and hold Owner harmless from all claims and liability for losses of or damages to property or injuries to persons occurring in or about the Property. 10. Guest agrees to keep the Property and all parts of the Property in a clean and sanitary condition and free from trash, inflammable material, and other objectionable matter. Guest shall quit and surrender the Property at the end of the term in as good, clean condition as the reasonable use of the Property will permit. 11. Any dispute under this Agreement shall be required to be resolved by binding arbitration of the parties hereto. If the parties cannot agree on an arbitrator, each party shall select one arbitrator and both arbitrators shall then select a third. The third arbitrator so selected shall arbitrate said dispute. The arbitration shall be governed by the rules of the American Arbitration Association then in force and effect. 12. Guest may not sublet all or any part of the Property or assign this Agreement or permit other persons to use the Property without prior written notification and agreement of Owner. 13. If Guest breaches any provision of this Agreement and fails to correct the default within _______ (number) days of notice from Owner, Owner has the right to immediately terminate this Agreement, and Guest must leave the Property within 24 hours. In such event, Guest shall continue to be responsible for all damages and losses, security deposit, and rent. 14. Rental Rules. Guest agrees to abide by the Rental Rules attached as Exhibit A at all times while at the Property. Smoking is allowed outside only. 2. Only the Guest and his/her party may stay overnight in the Property. Any other person in the Property is the sole responsibility of Guest. Guest is not allowed to exceed the occupancy limit agreed to above. 3. Owner is not responsible for any accidents, injuries or illness that occurs while on the Property. The Owner is not responsible for the loss of personal belongings or valuables of the Guest. It is agreed that all Guests are expressly assuming the risk of any harm arising from their use of the Property or others whom they invite to use the Property. 4. Guest shall keep the Property and all furnishings in good order 5. Guest shall only use appliances for their intended uses 6. Pets are not allowed. 7. Parking is limited to _______ (number) vehicle(s). Vehicles are to be parked in designated parking areas only. Parking on the road is not permitted. Any illegally parked cars are subject to towing; applicable fines/towing fees are the sole responsibility of the vehicle owner. 8.There is no daily housekeeping service. 9. Guest shall maintain the Property clean and free of accumulations of garbage and rubbish at all times. Any garbage must be stowed in the proper garbage or recycling receptacle, located at the side of the Property. No hazardous substances may be disposed of in the garbage containers, but must be disposed of as required by applicable health and safety regulations and codes. 10.Guest shall refrain, and ensure his/her guest and invitees refrain from any conduct which a reasonable person would deem likely to annoy or disturb other residents nearby. Owner does not provide insurance coverage to guests. Guest is solely responsible for securing such insurance, including insuring the personal property, as he/she deems prudent. 11. Guest shall not use barbecues, grills, or other outdoor cooking equipment indoors, or use them outdoors in such a way as to create a fire hazard or substantial risk of damage to the Property or common areas. 12. Guest shall notify Owner of any necessary repairs to the Property as soon after the discovery thereof as possible. Guest shall not make maintenance requests of maintenance personnel or workmen. Guest shall make no modifications or alterations to the Property without the prior written consent of Owner.
