RESIDENTIAL LEASE EXTENSION This Residential Lease Extension (hereinafter “Lease Extension”) is entered into this ___ day of _______________, 20___, by and between the Lessor: ______________________________, (hereinafter “Landlord”), and the Lessee(s): __________________________, __________________________, __________________________, and ___________________________. All Lessees, (hereinafter referred to collectively as “Tenant”), are jointly, severally, and individually bound by, and liable under the terms and conditions of this Residential Lease Extension. For the valuable consideration described below, the sufficiency of which is hereby acknowledged, Landlord and Tenant do hereby covenant, contract and agree as follows: 1. PREVIOUS and/or EXISTING LEASE: Landlord and Tenant entered into a Landlord-Tenant relationship by virtue of a previously executed Lease Agreement, dated _______________, 20___, (hereinafter “Lease Agreement”), and incorporated herein by reference thereto or by attachment hereto. Term of said Lease Agreement commenced on the ___ day of _______________, 20___, and will/did expire on the ___ day of _______________, 20___. The address of the dwelling leased in the prior leases agreement and which is the subject of this Residential Lease Extension is as follows: ___________________________________________________________________. 2. EXTENSION OF TERM OF LEASE: Landlord and Tenant hereby extend and continue the term and duration of the above described Lease Agreement, and incorporate herein by reference all the terms and conditions of said Lease Agreement. Said Lease Agreement shall continue and extend for an additional term, commencing on the ___ day of _______________, 20___, and expiring on the ___ day of _______________, 20___, unless renewed or extended pursuant to the conditions set forth in said Lease Agreement. 3. REVISED RENT PAYMENTS: Tenant agrees to pay rent unto the Landlord during the term of this Lease Extension in equal monthly installments of $_______________, said installment for each month being due and payable on or before the 1st day of the month, the first full rent payment under this Lease Extension being due on the 1st day of _______________, 20___. If applicable, the prorated rent from the commencement of this Lease to the first day of the following month is $_______________, which amount shall be paid at the execution of this Lease Extension. All terms and conditions of rent payment, and consequences for untimely payment or non-payment, remain as described in the previous Lease Agreement, referenced and incorporated above.
4. Termination of agreement: tenant will vacate the dwellings on and after the 5th day of such month as follows: (a) if said dwelling is vacant; or (b) if tenant pays on or before the 31st of such month a rental rent that is not less than the sum of, the then maximum rent payable pursuant to this lease agreement by the landlord; upon said landlord's giving written notice to the tenant that this lease is terminated, said notice to be delivered to the tenant's last known address, no later than thirty-five calendar days after said notice is personally delivered to said tenant. All rental payments which became due during the month of the termination notice and the month preceding such termination shall be continued and treated in accordance with said terms and conditions. Notwithstanding the foregoing, tenant shall be liable and shall be required to pay to the landlord all monies due and owing under a lease which is terminated in accordance with the provisions of this subparagraph. 5. No late payment fees: if rent is not paid in full on or before the 31st of any month as set forth in the previous subparagraph, then the rent may be assessed to the tenant in any manner, including nonpayment of rent. Unless the lease is terminated pursuant to the provisions of this subparagraph, landlord may also recover rent lost by tenant during such month by suit in any court of competent jurisdiction. 6. Reasonable expenses: landlord shall pay the reasonable expenses of the lessor that are allowed by the statute or regulation that governs such lessor, and reasonable attorney's fees in lieu of actual court costs as agreed upon by landlord and lessor. 7. Other terms and conditions: other than as provided herein, the provisions of this subparagraph shall be construed as in writing. 9. Subcontractor: lessor, acting as subcontractor, may give the power or consent of such lessor to the execution, execution may be made by lease, and all of the provisions of this lease shall, upon the written request and consent of landlord, be executed, made, and shall be in full force and effect between such landlord and such subtenant. Any and all agreements made, and all leases executed thereunder, shall be binding upon tenant and landlord alike for any reason, except as provided for in this subparagraph or the former lease agreement, as the case may be, not prohibited by the provisions of the act of December 4, 1948, nor prohibited by the previous lease agreement, as that term is understood by the parties, and no party may thereafter.
