local surveyor who I think has a state officer was at national maybe is moving out any of course you all know that he lives up gopher Valley with his lovely wife and as a father and a grandfather and very noted in writing things in bringing history to life and we're glad tonight that he's here to tell us about donation land claims thanks [Applause] [Music] [Music] okay can you hear me no a few pop questions in there for you let's see I'm still awake in hi everybody we're going to cover away in history various types landplane to this donation line claims you're not the only one the specifics of donation land claims what they went through in eighteen fifties to get a donation land play a little bit on how to research I don't want too much detail on that because they see the kind of a shroud of mystery meat sometimes surveyors have a lot hard time sometimes uncovering what's called junior senior rights on this one fight tonight basically just establishing who was there or had there playing first and it doesn't necessarily doesn't necessarily pertain to the was the first the process that government set up for these plans so we're gonna cover looking at working history here and one before 1792 we have the three factors here with all these exploratory they're all hearing about this all along beautiful river if any of you have any comments or questions I go through this I may not have answers but feel free just so in 1792 Robert gray came in and he came on that ship at Columbia and he named that river after his ship so here we go in 1804 to 1806 and he spent listen Clark and the winner here in 1805 and the United States really didn't have a claim to be here and of course the Jefferson was a great expansionist and what it wanted to make reality so we went from one emotion to the other and of course then in 1810 john jacob astor with the trading company but warehouse where he is now the first city in order and now we had and of course then we had to work out a treaty with the British in 1818 and we said we're gonna fix the northern boundary the 49th parallel from there go west to the Rocky Mountains and that was a joint occupancy agreement everything sounded at 49 was basically armed down to the Mexican territory or the Spanish term if we have the Spanish treaty of 1819 the next year that fixed the southern boundary at the 42nd crow you otherwise known that as the northern line I'm working now so the us-russian treaty Wow look at that 54:40 you've heard the words fifty four forty or fight and of course that took on new meaning in 1824 that's basically what we were looking at it for Oregon Territory but it's a lot of territory all of Oregon Idaho Washington throw up into Canada and of course in 1843 the provisional government was created yeah well Kenny was one of the first it was at the time that lower lower left-hand corner there in pink yum-yum County at that time was over 8,000 square miles we were to work of course by the other tree shampooing went on of course to become Marian General and Clackamas is still a quest it doesn't comply with that it doesn't conform to that kind of shape anymore than and quality of course later it became Washington County so that's 1843 some people call those counties now they really want County there were districts in those days but the British kept claiming everything north of the Columbia River and we kind of hold out long in 1846 then we came up with the order to compromise once again we said of the 49th parallel and of course we had the war with Mexico in 1848 treaty and we end up with all property south of that 42nd parallel I mentioned earlier so in 1846 here is the u.s. British boundary treaty map it's kind of hard to see much detail on that but once again we're still covering the same area that they were talking about 30 year earlier basically but they had now kind of agreed to to a certain extent who was going to have one and about the midpoint of the map you see that arc there that's where everything north of that I think at this time by 1846 the British were planning and we claimed everything south that and of course west of the Rocky Mountains to the orcas we've done two northern boundary of California so 1848 here comes a territorial government I know we've got a territory so that means that there's an intent on behalf of the United States Congress to create a state eventually the first death before statehood the territory of districts in 1851 now that was 1843 so three years later this is what the counties look like three years later now I don't know what that war one mean but it says attached to Omaha I really don't know much about that of course there's no home quad County now but back then and you can see that yell County kept getting smaller we did in 1851 go to the Pacific Ocean a little further than that starting to over 8,000 down to 718 today so here we go here's the big birthday February 14 15 59 here's a description I'm not going to go through this but this is the description of the entire state Oregon after 1859 stage but we end up at ninety six thousand three square miles and that includes two thousand three hundred eighty three square miles of water when you look at your property description less you have to live in a city where you're you own a lot of block of a subdivision or something if you live out the country you're probably you're your legal descriptions going to be much longer than that Kayson but that's 96 thousand square miles it's a lot of hurt there it is that state who that that's what the counties look like Wasco County of course have gobbled up the entire everything east of the Cascade Mountains and we still have own Clark County Jackson Josephine Curie so you can state you can see a lot of the counties you know in this area look pretty much like they did them they look like a cloud right now so here we go into donation land claims and this is a little boy the timeline and you'll see these as we go through this you'll see how this advances 1810 we had very few settlers here and then of course the Hudson Bay trappers came along but in 1821 dr. John Floyd who was the one of the Virginia delegate he was a delegate from the state of Virginia to Congress and he kept trying to get or again occupied so if you wanted to send people here on the promise that they would get land and he kept throwing out these bills and they kept failing there's a lot of politics and dirty politics 1825 dr. john mclaughlin came up with port Vancouver and of course the Hudson Bay settlers wants the popularity of the beaver skin hats and whatnot start dropping on why they start losing their jobs 1834 here comes the missionaries so down in Salem area and 1842 John laid out his Oregon City is playing that where organ city is now and of course in 1843 was the first massive organ trail in the care of the integration so there we go there's the provisional government started in 1843 so have shampoo may 2nd 1943 there were 102 male voters and was a vote of 50 to 250 to creative state so they wanted to do that and it was a close it was really close so the center of all little activity and state morning Lazar consider and even after statehood there was a lot of discussion about why is our capital centered in Salem instead of Oregon City there was a lot of debate legislature at that time over that kind of thing so July 1843 the organic law came up from Congress and said that we are going to be this have this provisional government until the United States should basically make this into a state so it took from 43 to 59 article 3 of that bill did relate to land and here's what it said you could establish a claim by natural boundaries or by marks at the corners and on the lines that claim had to be recorded in the office of the territorial recorder how to make improvements on your land within six months you had to become an occupant within one year one square mile per person per subway and you have to be in the square route long form the query matches situations nobody knows what that means it was going to be described by meet some balance and there was one claim for individual pop quiz here we go somebody just asked the question what does it mean to return to refer to anybody else metering right majoring property how about balance identifying properties that adjoined are above the property that you're describing so if you bound up against Smith property then that's boundaries there was no claim allowed if there was a city or town and if there were water privileges that affected that you know situations mercantile manufacturing then you couldn't claim there if it was to the detriment of a community or you couldn't claim where there was a mission or something of the religious character couldn't if it wasn't occupied now this is an amendment that was made in 1846 you can pay five bucks annually to the treasure that just says that if you didn't get out there and start telling a little bit and you could pay five bucks which is a lot of money 18:46 knows just before the gold rush in California works good if you didn't pay that five bucks to the provisional government treasurer and you to lose that claim they didn't have partnerships but they couldn't exceed 640 you did see some 1280 claims by partners and the boundaries were to perform this new year could be two cardinal points here we go another quiz hard once it all ceased with you mr. Cardinal cardinal directions based on magnetic or to long true good answer okay so 1848 to 1859 met territorial government and August 18th of 1848 finally they did formally come out and say we're gonna make this the state eventually so and then of course 11 years later they did become a mistake but the provisional government's land laws we're going to remain in effect that was the ones from 1843 in 1848 until denominational and activating 50 so the donation Land Act came into place nine years before we even became a state but this territorial act didn't provide for any land surveys and that caused a lot of trouble but settlers here were very unhappy to say the least because some Amanda here six seventy years and some of them sell their what they thought were the claims and here's Congress saying not we don't even recognize you so in 18-49 there was finally enough of a ruckus created that they said okay we'll come up make those real so Sam Thurston was the territorial delegate delegate and he did come up with this bill and it was the organizational and act of September 27th 1850 and so they're once again nine years later birthday so here you're trying to see the timeline again Congress assumed the surrender of being entitled to their lands well that's a pretty big assumption and that causes no end of trouble later they did create the office of the severe general Arkan City at the time and of course they provided to survey all these hundreds of thousands miles in both Washington Territory and it did said that there would be a donation of land to settlers avoiding all the previous land loss but if you had made your claim prior to December 1st of 1850 you could rear edge turn a claim with the new surveyor-general and the territory was John John Preston he arrived with another 1851 in Oregon Cydia and I think he came around for my shield my steamer those are presidential appointees healin lasted a year or two we got to be President and he got fired so the public land system public land survey system the severe general sent out these crews and they go out and survey in accordance with land ordinance of 18 or 1785 which has been used back in the eastern states for many many years obviously and it took them about three weeks to come up with the initial point is anybody in this room then an initial point of the entire radiance in Oregon it's up an old park in the West Hills so here you see a little bit about the townships when they talk about this Township north or west they're always talking in relationship to that Meridian that central bringing where the base line the Meridian come together and so each Township is 36 square miles numbering in the upper right-hand corner you see the red square on the right hand side that's number one and it goes across the six to the left and just kind of its kind of a certain keen on down to it ends up to 36 down the lower right hand corner on the left navigating and going north and south and of course everything on the ranges to the east of that meridian those are six miles on each one of those so it's 36 miles you're looking at total 36 miles the other way so every one of the squares is 36 square miles in and of itself so there's lots of our models there imagine we're only looking at just a matter of what 36 total townships there so we have in this county we have we start with touch of two south so it'd be the second one up from the bottom we don't even start until we get her over to three west so we would be kind of over on that left green arrow that's where we start with our county so you get a little bit of an idea how many miles they were trying to survey because they're one of those smaller squares got cut up models there's a mile and that's how they would describe those Northwest worth or the southeast corner of the Northeast quarter on that right hand side there of course you can divide that down those those corners of quarters are 40 acres because if you divide 640 acres which is a sort of mile of line they're going to get forty-eighters these are what the requirements were you can't be any less president by that date it could be way for American half-breed Indian male no females allowed signing things it could be a citizen getting a citizen who has a war they have intention to become one you have to be above the age of 18 and so there were many tales about the mentor 17 and they put the number 18 on a piece of paper put the Machine and they stand in front of Justice of Peace and say they had to reside on at cultivating land for four years they could get it half of the square of my life every single weren't there married 640 acres and the severe general on the donation land playing patent or when they would go through the process they might declare which have the white god there were love working picking year old ladies so then they said that you had to be a resident between December 1st of 1850 and 1853 for later arrivals and you're still having be a white male citizen over with the intention of becoming a citizen of the state yeah so you had to be they change the age from 1821 and you had to be holding that line for four consecutive years you couldn't leave a gap in there it cut the video area down 260 acres or twice that if you're married you can only have one donation for the person no mineral lands and so apparently there were some people who knew that there were men lands on the property but they would go out there and put a blindfold on her over their head say that I've seen them in alignment and they make that statement in front of two witnesses the witnesses go back and test it out on paper that was it and so there was a lot of fraud going on another days but anyway you had to notify history of general so there were some real rigid guidelines there 16 and 36 those two sections were set aside for public schools and back at some of the other territories the US government was selling land for Patna coordinator Soho here they wanted to see the settlement occurred herself they were doing everything they could not only one to judge illegitimate the existing sellers but they wanted to see more cellphone take place in order to the track tenant be in contact form and have you taken us nearly as practicable by legal subdivisions that is disabled square miles and where they weren't subdivided in the square miles then this freighter general with mark and surveyed the boundaries of planes most of the time that second part there which is a surrender general with mark and survey the boundaries explained those were done by the county surveyor faxing and so many of those didn't take place until I mean you couldn't do it until you had the donation land claims have any survey to a section corner there was no way he could have a DLC floating out there in the middle of nowhere it had to be tied to section parts that man they had to get out there and survey these sections th square miles of ice north south east west lines first then they come back later under contract to the county surveyor all of his hand in orbits I was to do blah blah according to the manual instructions for survey of public lands I promised to do all those things and then he would tie to those section quarters with everyone they don't mention I went and the severe general would put that in the book and make a note on the platter the claimant was required to do these things he had come up with to this interest witnesses but you can as you look at those statements by those disinterested witnesses a lot of times you notice that they were the neighbors I mean you think about it once quarter mile for personnel for company basically that's a lot of land so you get your nearest neighbor and you make a trip up to important city to the paperwork started and down before the bottom there were says the surveyor gentlemen do those things the first one there is a critical one to keep in mind that issue of the certificate he would format over all those documents and proofs to the general Land Office in Washington DC and then eventually the deal would issue a patent that lanta just says the government here buy this land or selling it to you the case may be seventy three hundred twenty-nine DLCs we had open less than four hundred in our county but all of West County wasn't accounted for because that wasn't considered could be available available available land out there so it just they called it unsaid uncivilized territory basic knocks on the earlier mass so here we are updating fifty 1853 the land was no longer free that we're selling it for a 1/4 acre so here comes the amendment of 1853 there was still a lot of moaning here in the northwest because people haven't met the timelines of the and Excel they extended this time they reduced the occupation time to two years but the date is pretty critical at the top they did three there you can see that they were extending that act and they were forcing them to pay for their land at this time so it all going all the way up to 1855 but they could come in kind of open up that door still trying to see subtle I'm here anyway you only had NOK 5 one year and two or at that time they came up with a separate surveying surveyor-general for the entire territory washington so they kind of took a road on the or in the city surveyor-general and of course there's another amendment 1864 late filings and final proofs you could actually have your ears clean when the original plaintiff died in the air could do that these were the number of oregon city or the number of oregon general land offices and you can see two of legrand and five in the dallas and the rest of course were here on the west side Roseburg we were pretty good it's time Oregon City of course was that king of the land grants of arisia here's what you had to do to establish that dlc did your notification in had to have that proof of citizenship had to have the marriage proof had to show that you're actually fulfilling the requirements of the residency and to have that survey done so they knew what located how to describe it and then if it was taken as an alum apart then state what the elephant part was this is the notification this is what they would the general and all of us describing that land cut our to read anything on that that's the old handwritten methods they would use that's the form that was to be used by them at that time they submit that to the land office in Oregon City and here's a proof citizenship these are the notes I'm sorry that in congregate these are actually scanned original notes from donation lands button survey so you have to wait till you've got all these things oh by the way you'll see a little website on their own if any of you want to look at that later you can I can tell you what it is like I've memorized you can go there and look up all these donation land claims the original field notes and that's one of them right there I'm sorry I can't zoom in on that show you very much more detail better they are in colored and you can see sometimes more than you reading or trying to stress different things whatnot and they've just done that within the past few years so they're all out for the entire state haffley wants to know how they prove their citizen air I'm not a genealogist maybe Carol maybe you have an idea how are they proving up on their birthright from Virginia you did have a relative attached to you they absolutely and when you're dealing with somebody from the East Coast for you may you know that maybe where you came from or a port or whatever and you had to steal plagues and go around the Horner so the meats and downs flames those are the ones that were not nice even square portions of sections of square miles were given the these donation land like numbers starting with 37 so it's not to confuse you with the sections that were numbered 1 through 36 if you'll recall so here's the big one this patent certificate what if you got that that was time to celebrate because that meant that finally the United States government recognized the authenticity of your claim and they said you had met all these requirements and that these facts were being certified after the Commissioner of the general Land Office in Washington and it was actually just one of the steps in the process but it was really good for these folks have you know they couldn't act we couldn't take the county couldn't tax you on the other hand you couldn't mortgage that claim but I gotta tell you there was a lot of claim swapping out stuff along those days there really was you look at the record sheet you can go back to the title of course our courthouse burned to the ground in 1859 the same year Stasia and we lost a lot of records in half but there we have a lot of other ways of proving that there were a lot of land spots going on prior to these patents actually being issued by the United States government so even though it wasn't legal it was happening and we you know if you had said when your land improved it a lot and you didn't have the cash or any way of coming up with the cash you could usually work out a deal with you know whoever you're doing with the town to or the you know they were burning banks that time work out some kind of a deal to have some kind of mortgage against your claim the illegal buoyed me up so here's one of those certificates and it's got a certificate number up in the upper left hand corner that is number 35 69 and like I said that was a time to celebrate because they have done everything and done all the paperwork and there were a lot of them that didn't get this far and is that a county number or a state that's a actually United States government number issued in the Land Office can in order all right that's what said Washington DC so the papal edition in Washington DC but the certificate was issued from work in cities so like I said it did take years to get that after you submitted that certificate which should contain all the proofs everything now they had to prove up on it as part of the certificate to get the certificate that the necklace would have forwarded all the facts and improves everything back to Washington DC they had to they had to actually go out and do these things and sometimes the Senate was kind of trouble for example Lafayette was the hotbed of political activity and commerce in the entire county of Daniel at the time so there were a number of businesses in in Lafayette and the businesses were operated and owned by people who lived out in the country well come to find out they've been doing that since the 1840s and you know pop it was established in 1846 and so they were told it's government that they have to go out and subtler web and improve their lose their place so it cause they turned into her initial notification and you remember the notification form and that just said I'm notifying the United States government that I'm making a claim on this land for some - this act of coverage blah blah blah so then they would start the process at that time you know what there weren't any there weren't any donation land claim cops so for the most part they they knew that they had to show some improvements and later on in later years not in Oconee County but especially down south they were syndicates created that all they did was probably won't land swaps but that's in Seneca they just did timber swaps just crazy shenanigans until finally Congress Paolina then it proved up on it and some people went to jail so anyway with the patent when she got that pad after you've already done all the work and everything then that actually said the United States government is handing you this this is an original patent right here I'll test this we're not gonna look at it backwards you know I think this came down in 18 I can't read it it was 1858 and it was recorded in the Meo County Clerk's office in a you know I don't know if the original was burned in the fire and so they asked for duplicate or what but somebody had written on here that this is this is signed by this is to Dan McDaniel and I'll sign on Johnson who are the grandparents of binaural Westerfield and it was signed by James became the president and he came 58 however that really isn't his signature on there that's some under one just a recorder or a secretary so now that you've got the panic attacks by some subdivision portion of that section that would mean like a hammer or so northwest corner of Northeast you know one of the quarters of that in the end of the forty-eighters this means there's an apartment so that would be a 40 acre parcel in one square mile 14 acres out of the three thousand six hundred forty pages so in the NFL County Art Foundation land claims were mostly by meets amount and that would mean that they weren't nice where north south east west and those are much harder to locate and the ones that were Southie conformity with the sectionalize lands probably named a tree surgeon tree and Oh wrong oh yeah oh yes well the section corners did - of course the section parts had to be deferred and so the contracting survey reviews from the county surveyor who tied the set of claims down they had to tie them to mathematically by survey to the section line land all the claims of each drawing were out the parts they were all nice where around here they're just ran up crazy that's right and by the time settlement moved to the south especially south of the Grossberg down in the Medford area and whatnot they say by then in Oregon severe general had said you will make your claim conform to the sectional plays you look at their maps down there for donation lying claims and there are all nice wear or rectangular shape and this area where it has such really Selma that wasn't the case at all so here's the donation land playing description and that's Washington County actually but you'll see there it says north 40 chains west sixty one point four two chains and then it goes a crazy bearing south of 10 degrees 45 minutes east or you play music after a while you get to where you recognize these guys handwriting and you can actually figure out what all that chicken scratching means and make sense of it of course it changes 66 feet they use that change some links so he had these numbers that no no notification either that's the initial one with seven would tell the surveyor general's office that hey I'm making this plane I'm notifying you of that I had to do that percent of that act and then you had the certificate number and of course your claim number was assigned by that office but once as I can't stress enough that certificate that was so critical to what these centers loved it and when they got that certificate they really because that was a lot of work they take the entire fortunes here in the state getting that certificate this I kind of threw this together to get an idea of how many claims in the various townships notice over the West County you see zeros that's where the camera company country court right here mean bill in this Township force out for West 52 claims at the highest density of the claims in the county of course 49-38 oh and twenty five thirty eight nineteen every area so you see the the distribution there I guess you could say that the good farmland like for example downright red on them and west of there going Fort Sheridan that's all relatively good farmland and so not that there isn't good farmland up in the anvil or overlock at Dayton enough cordon ID but the center of population in commerce was that triangle there 49 52 and thirty-five maybe part a little bit of Dundee of course Dundee and Newburgh at that time work there was no settlement just because in these early days I mean there was settlement but there wasn't any town so McMinnville and of course Lafayette were the big town and look at the numbers of settlement in this area right here like kind of it it's a little bit of a different take this is actually HS Maloney humbly Hezbollah knee and he was the county severe he had been a government severe back in eighteen eighties and you've done some of them certainly actually did some of the surveying over in the madness area for the Indian Reservation over there and he was being ready here to go down to survey the Polk County line in 1890 and I don't know how many of you recall the presentation view on that line what got to be but they they kind of agreed between poking I've got kind of they just go out survey everybody degree that mind well guess what we're a creation of the state legislators not later became the County Recorder in Bell County and of course his son Tom all he worked over dates on auto parts for many years and I think one of Tom's sons may have worked for see now we can talk a little bit about the Homestead Act came after the donation land claim here we go 1862 so why didn't you think III there were sold and land we're reporter maker by 1862 started the Homestead Act and here are the requirements 160 acres 34 bucks you had to live there for five years after six months of living there you could pay up a buck and a quarter acre and get that that land so 160 acres you have this say that you're going to become a citizen we're had to be one or it here's the first guy Daniel Freeman 1868 Nebraska new again okay here's the last one mister deer door and Southwest the last family so this home said that went for quite a while and then of course we had railroad land grants starting in 1860s and so they were trying to get these railroad companies to build their lines so that they support Commerce and transportation into these territories States and so they give every odd-numbered square mile for 20 miles back on each side of the right-of-way to the real or just given to and this was to recruit what it cost them to build a rail they couldn't sell from one to a half an acre they didn't have to pay taxes 170 million acres set aside there's what was happening at that there's the patch bull you can see in the lower left-hand corner there's a real spawn now the center of the kind of and then every other section and that way you know clear up into after the turn of the century and but in nineteen nineteen thirteen they knew they knew there were some real problems with fraud and so the Congress took back three million little takers so when you do your donation line playing research you've got all those plans went through the entire process and so that certificate is crucial to have that and there is a networks the archives you can get this list of the ones that were rejected for various reasons and of course gotta look for the parent counties now we're one of the parent counties but there are courthouses in a state much older than ours because our first one that kept the records that didn't bear the ground was actually occupied in 1860 or 61 so we're so basically when I record start we're gonna state archives and get all those records on these DLCs on microfilm you have to know that VLC number and there once again is that website I told you about earlier and that's where you can get those actual maps of the entire plant like when I was talking about the middle area that's 36 4 miles you can get a map of that entire 36 square miles you can download it from that website for free your net to have a pretty big printer to print that out because you're and so I just want to point out what the resources were here a guy named Sierra blank was a surveyor for building for many many years he came up with this case book on organ donation vampires and that's one of the good resources on this stuff and of course county records and the AOC Association where kennix has those records almost on each land claims and flats are on your association or the county website I'm gonna pass this around this is turn the lights back on if you want and when you hold this you're holding a little bit desperate and gene are what lady at Museum brought down some of she tried sell books she brought down some of the books that I had written back in 1990 or 95 that are the road name origins wrote all of our books and yet now county there are county roads I didn't go into public roads I think those are three dollars Dean is that right yeah we also have this 1879 map that it's real close to what the maps were but by 1879 as I pointed out where there had been a lot of swaps a lot of patents had been issued by 1879 and so a lot of transfers have taken place and you'll see names on here that you don't see in the donation aligned plan list and these are $2 apiece I believe yeah original this is on file in the counter and they orchestrate this pork society and they sell them to this was actually somebody way back when have made marks on it for the voting precincts so you see the South 4th precinct which is Sheraton world alignment minute how many days Lafayette North Fork of the yam Hill which is kind of in the geminal Carlton area and then what am i anyway so Dayton and of course the Willamette they call it the lamina that's where we carry any questions [Music] the ones who survived all the influenza and everything that they work near stated seeing yeah the ones they got rounded up and sent to the reservation right now they were given that reservation filter basically created those were created by the government has separate lands and they you know it they're really part of what we call state when you do second nations there are separate nations and so they have their own rules so a little bit on that there's a lot to that Bureau of Indian Affairs do you want to talk to about that but eighteen and the 1850s they rounded up a bunch of them and of course Port Gamble just over the Polk County line was one first reservations right we just a park at state park it's the only one of its okay if you accuse if you were to lengthen arrival you just didn't and you were out of luck so you we have a number of sites that we have the donation land claim surveys on and we know exactly where the corners are and everything so without the middle of this plan is an oddball shape we know there was a settler there we even know its name we don't know much so they were rejected for one way or another well they were so evolved eventually if you came after that guy had have basically lost his plane then you can come up and you could you could buy oh yeah okay yeah I see what you're saying I don't know that you would have any more right than any other seller at the time that came up with the money there's probably the first come first served with the money in hand and that's what the government was charging a for my maker whatever was yeah the one that I passed around there is the original or look at their of I'm not sure which but Jerry's brought a really this is this is even clear it hasn't faded as much and who is this this is for one of your relatives or so in the year of our Lord 1866 this happened was it was issued so that 1866 so they may
