good morning and welcome to the second webinar of the sba federal contracting series in partnership with the u.s small business administration and the utrgv procurement technical assistance center my name is daniel rodriguez and it is my great pleasure as the director of marketing and programs of your local chamber to moderate this event and welcome you for joining us today this webinar is being recorded and live streamed on our facebook page if you have any questions uh throughout the presentation please do not hesitate to leave your questions on the zoom chat the zoom q a feature or the facebook comments this webinar will be uploaded to the brownsville chamber youtube page if you would like to go back and review the information provided this webinar will be going over the federal hub zone program and texas hub program certification as the federal government uses special programs to help small businesses win at least 23 of all federal contracting dollars each year to help provide a level playing field for small businesses located in a hubzone area the government limits competition for certain contracts to businesses that participate in the federal hub zone programs this portion of the webinar will be presented by gilbert solis who is the business opportunity specialist of the lower rio grande valley sba district office later on in the webinar we will hear from orlando castaneda castaneda the the senior business advisor of the utrgv ptex who will be speaking about the texas health program certification girl gilbert thank you for joining us this morning thank you danielle for this uh for the opening i appreciate that and uh want to thank the attendees today for joining us at this very important webinar so basically what i'll be covering today as danielle has stated is the federal subzone program which has devolved to help fuel small business growth and these historically underutilized business zones and the valley district and with a goal to award at least three percent of federal contract dollars to hubzone certified companies each year um so other than the federal hubzone program sba also provides assistance to small businesses interested in getting into the federal government contracting arena we also have the our primary certification for socially and economically disadvantaged individuals that's known as the 8 a business development program and of course the woman-owned small business uh certification program which we will have a webinar scheduled for this month july 30th same time 10 to 11 30. so those who are interested check with the brownsville chamber of commerce or you can contact me directly um i think i'll have to go further down okay the uh historically underutilized business zones uh the hubzone certification these zones by the way are identified by the u.s census bureau and the u.s housing urban development those areas with high unemployment and low medium income were criterias for a hubsan qualified area to qualify for the hubzone program uh first you have to be a small business uh be at least 51 percent owned and controlled by a u.s citizen or a community development corporation as well as agricultural cooperative native hawaiian organizations or the indian tribe also have its principal office located in a hubzone area and since this program is also an employment empowerment program you must have at least 35 percent of your employees residing in a hubzone area okay the uh purpose of the hubzone again historically underutilized business zones is to provide again provide federal contracting assistance to qualified small firms located in these of zone areas and also the purpose is to simulate the capital investment within those those zones and also to empower communities through economic leveraging the hubzone areas or designations are typically areas of low to medium household incomes and of course as i mentioned a high end high unemployment is another criteria for these zones they provide employment opportunities for the underserved areas the federal government has specified annual prime contracting goals for these designated small businesses for the hubzone program it is three percent each fiscal year uh the federal agency must award uh some of these government opportu federal government contracting opportunities to the certified firms the sba does not have any authority to decide without supporting data that a particular area should or shop should not be designated a hubzone again that is determined by the uh census bureau u.s census bureau and the housing urban development the the way to get to know whether you reside in a federal hubzone uh designated area is you'll have to go to our website at www.sba.gov forward slash hubzone or you can go to www.sba.gov forward slash content forward slash hubzone dash maps and these are the latest updates of these qualified areas now once you uh on the program you need to recertify for the hub zone certification uh every three years as required and there is no limit to the length of time a business can be in the hug zone program uh such as long as they continue to qualify as i mentioned to you the the qualifications earlier we'll go over those in in a second here there are six kinds of hub zones uh they're known as the qualified non-metropolitan county uh which can become a redesignated uh zone when the hubzone eligibility ceases redesignation for the last three years these maps were frozen on december 12 2017 and will maintain their designations until july 31st of 2021 when you go into the uh the uh the mapping website uh you can locate your physical location on that map and in there it will instruct you the uh on the how much time that zone has to qualify and i think they're going up all the way to december 31st 2021 the other kind of hubzone is qualified census tract then you have your indian land uh qualified base closure areas uh qualified disease disaster area and pre-designated areas so these are the six kind of hubzone types of hub zones you must establish a business in the area identified as a hubzone okay you you also have to ensure that at least 25 of your employees reside in a hub zone you must be eligible at the firm of the you must be eligible at the time of the bid and award and may continue to maintain compliance uh once you're certified sometimes can be challenging but uh um you uh you can contact us if there is any questions you may have uh at any given time there are about 5 000 firms certified in the hubzone program so there are a lot of small businesses taking advantage of this program okay what is a hub zone again the hubzone stands for historically underutilized business zone uh which is a program that was established back in 1997 to help those urban and rural areas stimulate the economy in those areas the program increases again the community employment opportunities it also stimulates community capital investment and empowers communities through economic leveraging when a small business receives a federal contract for all these criterias or these events will will take place so that is the whole purpose of the federal hub zone is the hubzone certification appropriate for for you that should be a question uh prior to applying for the uh certification um a uh hubzone firm must be a hubzone small business concern based on the sba size standards and must meet the uh for its snakes code for its primary next code and determined by which is determined by revenues and employees so uh they will uh you'll have to comply with the size standards uh and you must be at least 51 percent unconditionally and owned and controlled by persons who are u.s citizens so because there are tax subsidized programs you must be a u.s citizen a small business whose principal office is located within a designated hubzone and be the location where the greatest number of the firm's employees perform their work for service and construction the termination of principal office excludes the concerns employees who perform the majority of their work at that job location and uh so most likely a uh hubzone certified firm who's doing construction work of course have to uh conductor contract in different uh job sites a small business with at least 35 of its employees residing in a hub zone um the company must be eligible at the time of offering awards so all these requirements must be in place uh prior to you participating on any of these federal government contracts at the time of the application for certification a hubzone small business concern must meet uh sba size standards and its primary next scope so again a size standard is very important and that is based on your your industry your next codes and the uh the sizes listed under the sba size standard rule at the top of the initial contract offers offer rather a hubzone small business concern must be small for the size standard corresponding to the next code assigned to the contract now different rules uh apply to firms owned by tribal governments alaska native corporations community development corporations small agricultural co-ops and native hawaiian organizations so at this point we look at these types of firms on the case by case i missed one down there it says uh no minimum time in business what that means is as long as you uh qualify for this uh certification uh you will be uh certified now for the a day business development program which is again our primary certification you'll be you will be required to be in business operation for two years okay sba hub's own responsibilities we got implements and regulates programs streamlines certification process determines and adjudicates eligibility and maintains certification listing for the sba responsibilities uh sba can regulate and implement or sba regulates and implements a hubzone program and we will determine which business is eligible sba also maintains a listing of qualified hubzone small business concerns to fulfill requirements and these are uh listed on what is known as a dynamic small business search and if you're needing that website you can contact me of course sba adjudicates protests of eligibility for those hubzone contracts many times there are some protests that that evolve throughout the uh before the the awards are conducted so we will most certainly take a look at that uh streamlined certification sba is the process or is in the process of reautomating the online application system for the hubzone program uh currently we're using the general sba general login system the gls system uh but there are talks that we will be uh changing that to a different portal um certification documentation requirements have also been reduced if you go to our website you'll see the listings uh the list of the required documents that have to be uploaded and then standing recertification process has been substantially automated and you will receive 30 or 60 days advance notice that that's currently in place now we'll look at the hubzone eligibility and requirements you'll see them on the screen there ownership by individuals the concern must be at least 51 owned and controlled by a u.s citizen uh the citizen means a person born or naturalized in the u.s and sba does not consider holders of permanent visas and resident aliens to be citizens so persons means a natural person under the regulations effective may 25th is back 2018 a hubzone small business concern must be at least 51 percent only controlled by a u.s citizen now the what they did is they removed the words unconditionally and uh and directly in other words if an entity other than the us system or u.s citizen owns in a firm that's okay so as long as the parent entity is owned by a us citizen so this is uh uh this is case by case so we'll take a look at the uh the situation in hand principal office principal office must be located within a designated hub zone and again the only way to find out uh if your office or your location is through our our map system if you go to our website as i provided to you earlier you can check your designation there and to see if you are qualified and that your area or location is a is in a ozone location for concerns whose primary industry is service or construction again the determination of the principal office excludes the concerns employees who perform the majority of their work at the job site location to fulfill specific contract applications so the uh what is a service and construction uh will be looked at a little differently than your regular uh other type of industry that you're in uh 35 residency at least 35 percent of its employees must reside in a hub zone and now there's a definition for employee means all individuals employed on a full-time part-time or other basis so as long as that individual works a minimum of 40 hours per month um this includes employees obtained from a temporary employee agency leasing concern or through a union agreement or co co-employed pursuant to a professional employer organization agreement so um yeah that's a new uh requirement of regulation rather that allows you to uh an employee uh who works 40 hours a month and is considered a part-time employee so we'll take a look at that and volunteers uh these are individuals who receive deferred compensation or no or no compensation including no in-kind compensation for work reform uh they are not considered an employee so uh you can't use volunteers as uh part of the uh the 35 of the required employees the size at the time of the application for certification a hubzone small business concern must meet sba size standards for its primary industry class classification and those you can go on to uh our website and the regulations uh are under 13 which is volume 13 cfr code of federal regulations 121.201 so you'll see all the size standards uh based on your next codes north american industrial classification code and you will see the uh the actual size standard now the last of months they were based on the last three years revenues uh they changed that to the last five years so anything that goes over the uh your size standard threshold [Music] then you're considered a big business and you're not no longer a small business so if you need some help with that you can you can contact me and i can help you review uh your size standards based on your next codes contract warts a certified firm must meet all eligibility requirements at the time it submits its initial offer for a government contract up until and including the time of of that actual contract award uh if a certified is performing on a hubzone contract and submits an offer for another hubzone contract it cannot attempt to maintain the hubzone residency requirement it must meet the requirement at the time it submits its initial offer and up until and including the time of the award so we got to make sure before you go out and seek a contract negotiate a contract that we have to be active as a hubzone certification which includes the sam registry uh systems for award management that also has to be active before you conduct any federal government contracting uh projects so make sure that uh you got those all uh on the active uh level so that way there won't be any protests or any any setbacks on the uh on the contract operations and the the time the timeline of that contract uh hubs on location again if you go to our website you'll see the map link where you can check for updates on these qualified areas and they do recommend you use the google google chrome rather or another modern browser to open these maps okay they seem to work a lot better helpful application process you want to primarily register with the systems for award management is known as sam and update your dynamic small business search profile you will be required to register and obtain a duns number which is free and identify a primary next code uh for your your company so this is one of the main steps uh initial main steps to to apply for any of our certification programs so that's very important apply for certification um as i mentioned before uh we are currently using the sba general login system if you go to that website it'll link you to to that that portal you will have to create a profile and once you're once you're active in that gls system then you can start uploading your your documents the documents requir d to apply for the hubzone application so if you need help with that you can also contact me uh but the on that website on our hubzone website you'll see the uh the list of supporting documents required okay and i think that's it for that supporting documentation requirements for ownership and control and structure you can submit a birth certificate a current balance valid u.s passport or a certification or of neutralization rather trust or franchise agreement if applicable the supporting documents requested will differ based on your ownership structure if you're incorporated of course you'll look at your corporation documentation which includes articles of incorporation copies of stock certificates stock ledgers corporate bylaws and any amendments certificate of good standing for the llcs you will be asked to provide an operating agreement and including any amendments to that agreement you're also requested to provide articles of organizations and any amendments a certificate of good standing for partnership firms partnership agreements as well as here any amendments have to be submitted and for sole proprietor is simply your dba which is doing business as or a trade name certificate business planning incorporating hubzone compliance into business planning try to maintain a hubzone employee percentage significantly greater than 35 perhaps maybe even 45 to 60. so that's one of the uh recommendations uh maintain a list of potential hires in case one of your hubzone residents quit and you also want to watch the hubzone maps for any changes because they are from time to from time to time some changes to the uh designated uh zones and then sign up for email alerts uh through our website changes in geographical eligibility can affect your continued eligibility in the federal hub zone program in terms of location or principal office and employment so we want to make sure that we're like i said before that we're in compliance under the federal regulations size and affiliation uh most recent three years of corporate federal taxes uh tax returns rather including all schedules and attachments will also be will have to be provided by each small business who's interested in this program most recent federal personal income tax returns for all individuals that own 20 or more of the applicant firm including all schedules and attachments and w-2s these are the other part of the uh of the required documents that you possibly have to submit okay ozone side visits recertification these side visits are done randomly and unannounced it may include a visit to any of the firms at any location so if you're in the program uh we will have to do do the or conduct these site visits uh sba may propose decertification on the basis of a failed side visit when it cannot confirm that firm in operating from the hubzone principal office or meeting the 35 hubzone employee residence requirements so those are like i said those are very important requirements so when we do these side visits make sure you're in good standing uh recertification as i mentioned to you to maintain your hubzone certification uh your firm must recertify to sba every three years of that it is in the compliance with all the hubs and requirements failure to timely recertify will lead to sba proposing a decertification from the program even though certification can potentially be indefinite the medium number of years in the program has been only four years getting the most out of your hubzone certification [Music] each year we do offer free training currently we're doing these trainings uh virtually through webinars and online conference calls currently we do have what is called the online 7j training which covers well over 20 different uh training topics for example could be how to negotiate a federal government contract how to self-market your your company to these federal agencies um capture management how to set up an accounting system these are just a couple of topics but uh that are available if you're interested please call me or email me and i can provide you the uh the current uh schedule uh again these are online uh there's no charts to any small business so that that's available we also provide training through network of resource partners including sbdc um p tax as we're doing today uh score and other contractors other other opportunities to maybe expand or explore other bigger contracts is through joint venturing we do offer currently we do offer the all small mentor protege program joint ventures if you're interested in that if you know if a uh a partner or a small business who's willing to work with you you can always request this certification if you're interested you can call me or you can go directly to certify.sba.gov that is a portal which allows you to register for the all small mentor project program slash joint venture program again the government has a mandate of awarding three percent of all the prime contract dollars to hubzone firms and our local federal agencies that we currently work with are also requesting uh or working with these federal hubzone program or certified firms rather so if you're interested and once you get certified we can provide you those contacts that way you can stay in front of these federal agencies we also conduct these meet and greets training opportunities uh we've got one coming up in august uh it's a meet and greet uh featuring the department of the navy uh this will be done uh through our through a webinar uh if you're interested in that we can provide you the that information i think it uh get the the date on that will be in you hear us and welcome yes thank you everybody for taking time out of your schedule to be uh here with us today we appreciate it i am going to go ahead and share my screen now so okay let's try that one more time gilbert hadn't quite gotten out uh so here we go so as was mentioned my name is orlando castaneda i am with the university of texas rio grande valley p-tech procurement technical assistance center and today we're going to be discussing the state of texas historically underutilized business program we'll go over the definition as to what makes up a hub the benefits of being hub certified the eligibility criteria the purpose or intent of the program the procurement guidelines and goals and what you need to begin the registration okay along with this we'll also be discussing the centralized master bidders list this is a registration somewhat similar to the federal sam registration the system for awards management and we'll go over the purpose of that program as well okay what is a hub a historically underutilized business is a for-profit entity that does not exceed the sba size standards it is at least 51 owned by a minority group or a woman-owned business uh just several years back they actually did add the service disabled veteran um you must at least have i believe it is a 20 service connected disability uh rating and a letter substantiating that from the va okay a hub is an entity with its principal place here in the state of texas as this is a state of texas a program and a hub has an owner or the owners residing in the state of texas they simply want to make sure that they are involved in the day-to-day activities and operations of the business and that they're readily available to address any issues that the company may face if there are any and of course in accordance with the attack each state agency shall make a good faith effort to utilize historically and utilize businesses in their procurements that could be whether it's a service or a product um at this point i'd like to stress upon the uh the differences between the state of texas historically underutilized business and the federal hub zone um with the federal hub zone as you heard gilbert mentioned they actually do set aside three percent of contracts for hub zones as you can see here this is a goaling program they do not set aside contracts for hubs they look to be inclusive of hubs but they do not set aside any particular percentage of contracts for historically and utilized businesses i just kind of wanted to make that differentiation between the states program and the federal hub zone program okay the benefits of becoming hubs certified as with the hubzone this certification is free of charge as well it's administered by the comptroller of public accounts uh texas procurement and support services and the certification is good for four years as long as there are no changes in ownership with the company excuse me and once you complete the process and you are successful in attaining your hub certification designation you will be listed in the hub directory and if you participate in the centralized master measures list you'll be listed in that registry as well and state agencies utilize both of these directories when they're soliciting for proposals for their needs if you participate in this program if you meet the criteria and you do get the certification it is increased exposure to the world basically it's it's a it's a public database anybody can access it we've had clients that have been certified as state of texas hubs and they have been contacted by private companies corporate america to provide their product or service so it's it's a good marketing tool and then the elimibility criteria are pretty much uh they're pretty similar up to uh what gilbert mentioned with the hubs zone as this program is administered by the comptroller's office it is a state of texas program so they do look for the owners to reside in the state of texas the united states citizens are naturalized citizens citizens uh of course to meet that minority or woman status 51 ownership these majority owners need to be [Music] active participants in the company and again since this is a state of texas program the business needs to be based here in the state of texas you cannot have your corporate office in florida or new york and participate in the hub program if by chance you do have a corporate office or your corporate office is in california and you do want to sell to the state of texas you can do so or get added to the registry via the cmb the centralized master bidders list okay and what is the purpose of the program uh as mentioned before t-pass texas procurement support services administers this program for women and minority-owned businesses and again it is to be inclusive of these smaller businesses in texas procurement so again to increase the number of the woman and minority owned businesses participating in government the state of texas government procurement institutions of higher education also look for historically revised businesses when they go out for purchases okay do we have any questions so far danielle no we do not okay all righty well i'm either doing a really good job or this is uh okay so the procurement guidelines so the state of texas procurement guidelines require a solicitation of proposals when a state agency or institution of higher education goes out for purchase so again these state agencies and institutions of higher education are required by law to utilize the hub directory and the centralized master bidders list when they go out for solicitations and then according to the rules created by t-pass all state agencies must elicit three proposals for every procurement opportunity of three uh three of these bids must be from the hub to okay of these three bits two must be from the hub directory okay and then these are the actual procurement utilization goals for the business categories so as you can see here for heavy construction and this is text.work basically the road work uh it is 11.2 percent historically utilized business utilization um 21.1 for building construction uh the 39 uh 32.9 percent for special trades uh 23.7 for professional services 26 for other services and the 21.1 for commodity contracts okay so what does being hub certified mean to your business basically it identifies you as a historically utilized business you do get a certificate and it's good for four years if you do pursue opportunities say with utrgv they may ask you if you are hug certified and you say yes they will ask you for a copy of your shirt certificate and that certificate will show them your vendor number and your vendor id and let them know as to when your certification will expire again just to reiterate your business will be listed in the hub directory under your name and as i stated it will include your vendor id and your vendor number and the certificate number as well and again this provides all state agencies and institutions of higher education with a a supplemental tool if you will along with you utilizing the centralized master bidders list when they're looking for proposals or bids okay what do you need to begin you will need your ein as they do not want to uh receive anyone's social security number again they don't want the identity theft liability on their end uh your company's business structure i can tell you that the application itself to become a hub certified is the same regardless of your business structure but i believe as as gilbert mentioned earlier your business structure will drive what supporting documentation you are to provide to substantiate your claim as any hub and then uh you will need your nitp codes your natural national institute of governmental purchasing class and item codes this is a five-digit number that identifies the product or service you provide with regards to the hub zone they're actually looking for your next code that's a six digit national institute uh national and make snakes uh north american industry classification system sorry i was getting them both mixed up there and then you will also need to identify the various highway districts where you are willing to provide a service or a product i typically tell my clients if they're selling a product and it can be shipped they should check all 25 highway districts for the state of texas this here is a very old example of what your profile will look like once i work through the presentation i will actually get out and go to google chrome to show you a current uh profile but as you can see here you can identify the vendor id and the vendor number you see that they're an active hub firm they're out of mission texas uh this is a hispanic female owned business it's got their phone number and fax number email address their business description is site work to include paving concrete and asphalt so this here is your opportunity to utilize your own words as to the product or service you provide because as you can see they're distilling you down to a number as to the product or service you provide and they happen to fall into the category of the heavy highway construction o1 and again this is just a sample profile okay what is the fee to become hub certified it's free there is no charge to you and we can help you through the process okay and again the certification is good for four years and as gilbert mentioned with the hubzone they'll let you know i believe it's uh 90 60 30 days out that you will need to renew or you're up for renewal if you still want to participate in the program okay so that was regarding the state's historically underutilized business certification now we're going to talk about the centralized master bidders list which is a registration and as i mentioned earlier this is similar to sam which is the federal registration what i tell folks is i don't know if you all remember but you could thi k about it as yellow pages so the central master central master bidders list getting ahead of myself is a database that's used utilized by state of texas purchasing officers uh contracting officers purchasing agents to develop a mailing list when they are to solicit for proposals or seek bids for products okay so who can register in the centralized master bidders list that's manufacturers suppliers service providers uh pretty much anybody that is selling something and that wants to sell to the state of texas and again there are over 200 different state agencies and institutions of higher education that utilize the centralized master bidders list and i can tell you that even local governmental entities utilize it as well school districts cities counties so it's a public database and anybody can go look in there okay there is a fee associated with this one and it's mainly for the administration of the program itself the fee is 70 and you will need to renew annually as you can see there that breaks down to less than six dollars a month and again it covers the administration of the program so uh before i jump into that the way the centralized master bidders list works is that as you saw via the hub uh requirements uh what you needed to get started for your hub certification it talked about your national institute of governmental purchasing code your nigp codes that that five digit code that identifies what you do as a business well the cmbo utilizes that same number whenever an institution or an agency has a need they utilize that same numbering system so if you have a number that matches matches to an agency's need you will actually get an email notification letting you know that for example the department of public safety is looking for your product or service and you could click on the links review the solicitation and decide as to whether or not you want to submit a proposal or submit a bid okay moving on how much will being a hub or uh participating in the centralized master business registration increase your business well um as the chief procurement officer for utrgv states you do not obtain 100 of the proposals you do not know of so again these are great marketing tools and certification will list your business in the hub directory so again further marketing and again not only are you exposed or is your business out there for contracting officers and purchasing agents to see but again it's a public battery so corporate america private sector companies can see your information as well and again it's just increased exposure for your business so if you need further information you can contact us uh our contact information will be towards the end of the presentation or you can actually call the comptroller public accounts office and there's their number but we're here and we're here to help you all all of our services to you are completely free confidential we're actually grant funded we're funded through the department of defense and our program is administered by the defense logistics agency and to apply for the hub certification you simply need to fill out those three pages of basic company information and provide the supporting documentation and all of that will be sent up to austin for their review and their approval okay and as i had mentioned earlier the chief procurement officer for utrgv is actually mr alex valdes he's a great resource that actually is his direct line uh he's a pretty busy guy so if you call him and he doesn't answer leave him a message or you can shoot him an email um he will most likely have you speak to or refer you to someone in his team because they actually do have various buyers that cover
