There are several articles and blogs that explains how to register a trademark in India in one way or the other but I hope that this post will be comprehensive enough to answer most of them.A trademark is anyword (PEPSI, COCO COLA, PEPSODENT),name (RAYMOND VEIL, CHRISTIAN LOUBOUTIN),surname (TATA, BATA, BAJAJ),signature (LOUIS PHILIPPE),letters (BMW, IBM, HDFC),numeral (555, 501),symbol (MERCEDES BENZ THREE POINTED STAR, ADDIDAS PYRAMID),device (AMUL GIRL, PILLSBURY BOY),color scheme (PIZZA HUT, DOMINOS),packaging (CADBURY’S),shape of goods (COCO COLA BOTTLE)or any combination thereof that identifies and distinguishes the source of the goods of one party from those of others.When the mark is used in respect of services then the mark is also commonly referred to as Service Mark. Magic! Merely because a trademark is not filed for registration with the trademark office, does not mean it is available for you to take. In a common law country like India, usage of a trademark gets importance over filing an application/obtaining registration for a trademark. Search using Google and see if anyone is using the trademark you want to adopt. If you see a similar mark do a bit of research to see how much they have used their mark, period of usage, goods or services for which is it used, has the mark gained any reputation etc. More importantly, compare the marks yourself and decide whether your trademark will infringe the rights of the other person. Your few minutes of research will save you from the risk of choosing deceptively similar marks, resulting in lengthy oppositions and infringement action costing time and money. a. File an application with the trademark office.Congratulations! You have cleared the first two hurdles. Give yourself a pat on the back for discovering that you are going to have exclusive rights on your trademark, and proceed with filing a trademark application. You can either file a paper application with the Indian Trademark Office (TMO) or file an application online at http://ipindia.nic.in. You will require a digital signature and an Axis/SBI bank account for filing the application online. The official fee is INR.3500 (approx USD 70) per mark/class.If you are a foreign entity who wants to protect your trademark in India, consider claiming priority.India is a member to the Paris Convention and signatory to the TRIPS agreement. Examination of your trademark application.In approximately seven to nine months the trademark office will send you the examination report either citing the objections consisting of absolute or relative grounds or both, or, in the absence of any objections allowing the application to be published in the upcoming trademarks journal for a third party to raise objections to the registration. The time to respond to the examination report is 30 days from the receipt of the same and this deadline cannot be extended. So it is important that you file a response with the trademark office within the deadline of 30 days.The objections under absolute grounds are that– your trademark is not distinctive; i.e.: your trademark is not capable of distinguishing the goods and or services of one person from those of others.– your trademark is descriptive or devoid of any distinctive character; i.e.: your trademark directly refers to the goods or services for which the protection is sought. Ex: Trademark FAIRBEAUTY filed for cosmetics under class 03 cannot be registered.– your trademark is a generic term or is customary to trade; Ex: APPLE for fruits, SOFTWARE for software services cannot be registered.The objections under absolute grounds can be over come by stating that your trademark has acquired distinctiveness by extensive usage over a period of time and that the public in general, identifies your product or service by your trademark and that the public identifies only you in relation to your trademark and no one else. Documentary evidence is required to be filed in support of your claim along with your response.The objections under relative grounds are: the existence of similar trademarks on the records of the trademark office.The objections under relative grounds can be over come by stating that your trademark is different from the other cited marks in the examination report.In what ways your trademark is different from the others needs to be explained in detail. Submission of documentary evidence of extensive usage of your trademark will also help you to strengthen your case.c. Hearing before the examiner.In about six months from filing your response to the examination report, the trademark office will either allow the application to be published in the upcoming trademarks journal for a third party to raise objections to the registration or fix a hearing by sending you a hearing notice with a date and time to meet the examiner and explain why your trademark should be allowed to proceed towards registration. This opportunity should be exploited to explain to the examiner, the evidences filed at the time of responding to the examination report in detail and to submit additional evidence. Subsequently the examiner will pass an order either allowing or refusing registration of your application. If it is a refusal, you can appeal against the order of the examiner before the Intellectual Property Appellate Board (IPAB) with 15 days of such refusal.d. Publication of the application in the trademarks journal.Within two to three weeks from the date of the examiner’s order to publish the trademark, the trademark application is published in the trademarks journal. You can download the trademark journal and check if your mark has been advertised. After the expiry of four months from the date of publication of the trademarks journal in which your mark was published, check the status of your trademark application online and if there are no objections to your trademark by way of oppositions filed by any other person, write a follow up letter to the trademark office requesting registration of your trademark and issuance of your trademark registration certificate.In the event of any person raising an objection to your trademark application by way of an opposition, the trademark office will notify you of the objection along with the copy of the notice of opposition as filed by the other party. Opposition proceedings are complicated and we suggest that you consult your legal counsel.e. Registration of your trademark and issuance of the registration certificate.If no objections are received by way of oppositions to your trademark application within this four month period, the trademark office will grant registration to your trademark and issue the registration certificate. Once you receive the registration certificate peruse the contents of the certificate to ensure that there is no discrepancy in the data and in case of any, bring it to the attention of the examiner and have it rectified.f. Renewal of your trademark registration.Every trademark registration is valid for a period of ten years from the date of filing the application. An application for renewal of a trademark registration can be made six months prior to the expiry of the registration. The renewal fee is INR 5000 (approx USD 100) per mark/class. When we look for life in outer space, why do we look for signs that make life possible on Earth? Isn't it possible that differen
tl;dr: For optimized and efficient usage of resources, energy and brain power, E.T should resemble us and their functionality should match that of ours in big proportions. Even if E.T life originated at a higher temperature like ours, they should have evolved into creatures adapted to fairly moderate temperatures, which may be higher or lower than our sustainable zone.I think, if at all extra terrestrials exist, they should look like us, because, the structure of human beings is very efficient, which enables us in rational and intelligent thinking and perform desired physical activities. Here are certain points to as to why aliens should resemble us, more or less :1. BRAIN- In humans, the volume varies from 1130-1260 cc, which is neither too big so as to consume unnecessary energy nor too small to limit our thinking capability (Assuming we are intelligent enough now, not taking evolution into account). So, if we meet an alien who comes to us by making an inter stellar journey, must be pretty close or a bit more intelligent than us.2. NEURAL CIRCUITS- The neural network in humans work by creating electrical impulses at scale of mili volts. As electrical charging and discharging is available, it means a salt forming metal is involved in its ionic form, Potassium in our case, so am assuming the neural actions in every living organism must work in a similar manner as its the fastest means of communication that can occur inside our body. Hence, an alien must be having a salt forming metal forming ions and facilitating neural communication.3. LIMBS-Two hands, two legs, most efficient. Extra limbs need extra brain power consumption and extra energy consumption. In order to make inter stellar journeys which pretty much require the body to go in a hibernation-like situation so as to consume as less energy as possible, having extra limbs is definitely not an advantage. Again, to operate and manufacture spacecrafts, they need limbs that can provide grip, and not tentacles for sure!! 4. BODY FLUIDS- We have water in our body which acts as a solute. I guess, for every living organism in the universe, a solute in body, that too in large quantity, is a must. Now, what if they have alcohol as a solute instead of water? Now that's not possible as you mentioned temperatures of 1000 Degrees in question. Some kind of acid? May be, but acids may be corrosive, and its highly unlikely of an alien made of gold or platinum.5. EYES- We have a view field of 120 degrees. Now aliens MAY have an eye in the back to increase their field of view. But I don't think they'll need a bunch of eyes, again, reason is brain power and energy.6. RESPIRATION- So far, best form of cellular respiration known to humans is diffusion. But we may assume that aliens may have a separate organ dedicated to air circulation in body, so two hearts kind of thing. (Time Lord? :D ). Of course, gaseous exchange has to be external, its highly unlikely for a living organism to produce its own requirement of respiratory gases. Besides, our cells “burn” stuffs to provide us energy, and burning means oxygen. I don't think aliens will be walking nuclear reactors. So, they will either need oxygen or some sort of oxides, or somehow, cause oxidation in order to perform cellular combustion.7. TEMPERATURE- Astronomers search for planets that are in the so called “habitable zones”. Now that's because of the temperature factor. Every living organism will need a fluid/liquid which is stable, non lethal and has solution forming properties. At temperatures exceeding 1000s of degrees, we may not find liquids worth such properties, same applies to very very low temperatures. Now aliens won't like to stay in cryogenic state if they want to communicate with us, will they?

Did Muhammad split the Moon in two?
Hi, and thank you so much for your questionAnas ibn Malik (A.S.) narrated that the people of Makkah asked the Prophet (PBUH) to show them a miracle , so he showed them the splitting of the moon , into two distinct parts , that they even saw the mountain of Hira' between them.Explanation of the HadithThis incident was narrated by a number of the companions of the Prophet (PBUH), among them were: 'Abdullah ibn 'Umar, 'Abdullah ibn Abbas and others. The Indian and Chinese calendars have recorded the incident of the splitting of the moon.A few years ago while I was giving a lecture at the Faculty of Medicine at Cardiff University, in Wales, a Muslim asked me a question about the verses at the beginning of Surat al-Qamar (the moon), about the splitting of the moon, and whether it is considered as one of the scientific signs which are mentioned in the Qur'an and whether there is any scientific evidence discovered to explain this incident.My answer was that this incident is considered one of the most tangible miracles, which took place to support the Prophet (PBUH) when he was challenged by the polytheists and disbelievers of Quraish, showing them this miracle to prove that he is a Messenger of Allah. Anyway, miracles take place as unusual incidents that break all regular laws of nature. Therefore, conventional science is unable to explain how miracles take place, and if they were not mentioned in the Qur'an and in the Sunnah of the Prophet (PBUH), we would not have been obliged to believe in them. Therefore, we believe that the incident of the splitting of the moon took place exactly as the words of Allah Glorified be Who says:﴾ The Hour has drawn near , and the moon has been cleft asunder . And if they see a sign, they turn away, and say: (This is continuous magic). They belied (this Qur'an), and followed their own lusts. And every matter will be settled [according to the kind of deeds (for the doer of good deeds, his deeds will take him to Paradise, and similarly evil deeds will take their doers to Hell)]. And indeed there has come to them news (in this Qur'an) wherein there is (enough warning) to check (them from evil), Perfect wisdom (this Qur'an), but (the psignNowing of) warners benefit them not. ﴿(Surat Al-Qamar (The Moon): 1-5)When I finished my speech, a British man from the audience named Dawud Musa Pidcock, leader of the British Muslim Party, asked to add something to my answer. He said: “It is these verses, at the beginning of suratal-Qamar that made me embrace Islam in the late seventies.” This occurred while he was doing extensive research in comparative religion, and one of the Muslims gave him a copy of translation of the meanings of the Qur'an. When he opened this copy for the first time, he came across Surat al-Qamar, and he read the verses at the beginning of the surah, and could not believe that the moon had split into two distinct parts and they were rejoined, so he closed the copy of the translation and kept it aside.In 1978 Mr. Pidcock was destined by Allah's Will to watch a program about space journeys, in which the well-known British announcer Jamed Burke, received three of the American space scientists. During the debate, the announcer kept criticizing the immoderate spending by NASA (millions of Dollars) on space projects, while there are millions of people on earth suffering from starvation, diseases and ignorance. The answer of the space experts came to assert that it was these journeys that made it feasible to develop important technology applied in medical diagnosis and treatment, industry, agriculture, and many other fields. During this debate, they referred to the first time that a human being landed on the surface of the moon, and how this trip cost more than $100 million dollars. The scientists went on to say that this journey proved a scientific fact, that if they had spent several times as much as they did to convince people with it, no body would have believed them. This fact was that the moon had been split a long time ago and rejoined, and there is a lot of concrete evidence on the surface of the moon to prove this.Mr. Pidcock went on to say : “ When I heard this , I jumped off my chair , and said this is a miracle which took place fourteen hundred years ago to support Muhammad , and the Qur'an narrates it in such a detailed way . After this long period and during the age of science and technology, Allah employs people (non-Muslims) who spent all this money for nothing but to prove that this miracle had actually happened. Then, I said to myself, this must be the true religion, and I went back to the translation of the meanings of the Qur'an, reading it eagerly. It was these verses at the opening of surat al-Qamar that lie behind my reversion to Islam.”This happens at a time when some Muslims claim that the splitting of the moon has not yet taken place, and that it is one of the signs of the Hereafter as the opening of the surah says: ﴾ The Hour has drawn near. ﴿ They are oblivious to the fact that the Prophet (PBUH) said in a hadith narrated by Imam Muslim , on the authority of Sahl ibn Sa'd that Sahl said : "I heard the Messenger of Allah (PBUH) say :“I and the Last Hour are (close to each other) like this (and he pointed by joining his forefinger, (one) next to the thumb and the middle finger (together).”Those who deny the incident of the splitting of the moon, use incorrect evidence to support their opinion as they use the verse in surat al-Isra:﴾ And nothing stops Us from sending the evidences (proofs , signs) but that the people of old denied them. ﴿(Surat Al-Isrâ' (The Journey by Night): 59)This verse is not used in the right context since many perceptible signs and miracles took place during the noble life of the Prophet (PBUH).Peace and blessings of Allah be upon the seal of Prophets (PBUH) , for whom Allah made the moon split into two parts , twice , as an honor for him and to raise his rank and support his message (among his people) , and left for us a concrete evidence to prove that this splitting did actually take place .reference1 -The Moon Cleft AsunderDr. Zaghloul El-Naggar
