today we're going to talk about something that i think is pretty exciting and you know you don't get a lot of excitement in the criminal justice world in a positive way so what am i talking about that's so exciting in the criminal justice world right now well the more act hi i'm miriam and this is trials and errors what is the more act miriam you're supposed to tell us well let me tell you you you know how congress always likes to take the first letter of the name of whatever bill they're introducing and it becomes an acronym like the safe act or the patriot act the more act stands for marijuana opportunity reinvestment and expungement act and basically what this proposes to do is to decriminalize marijuana allow marijuana to be taxed because we love those taxes open up banking for marijuana growers and sellers and also to expunge criminal record so when i was reading the act in a little more detail to get ready for this video i kind of got like goosebumps i kind of got it's the way we feel about anything that will make our job as criminal defense attorneys less necessary and that seems weird but it would be a great day if my job was less required for things like marijuana sales the act does a number of things and the more act is directly in response to what states are doing there are a number of states that already have marijuana legislation either marijuana is decriminalized or marijuana is completely legal or they have medical marijuana where they have a combination of all of those things the problem becomes it's still marijuana possession and sale is still a federal crime so what that means is that what's perfectly legal for you to do say in virginia in 2024 yay virginia it would not be legal to do in maryland in 2024 unless maryland catches up to the great state of virginia how do we work that out how does that get resolved since you do have states rights but we know that federal law has supremacy over the states what a lot of people involved in criminal justice reform have asked for years is to take marijuana off the schedule one list and the schedule one is like the really really bad drugs right like heroin and meth and crack and cocaine and all of those really you know big scary drugs marijuana is in that same list the people at the dea insist that marijuana is a gateway drug and if you smoke marijuana or you sell marijuana someday you're going to sell and smoke crack or heroin or meth or pcp and it's just going to be over and your your kids are going to be naked and running around in the street and you're going to be [ __ ] on the ground in the middle of a field and it's just going to be mayhem i don't know what else is going to happen but we know that when people smoke marijuana they really don't do a lot of anything marijuana statistically is safer for society than alcohol is that's just the truth why is it still illegal why is it still a schedule one drug we know the answer to that because we know if you've watched more of these videos that there are many justice systems in america and the war on drugs was specifically designed to target one or two particular classes of people in america black america and poor america those are the people that are targeted by our government this act proposes to take it off the schedule one decriminalize it reinvest meaning that people who were targeted by these drug war laws would be brought back to their original condition meaning that their records could be expunged they could be full members of society again with none of the collateral consequences they would be able to get housing they would be able to qualify for scholarships they would be able to get jobs they would be able to vote and own a gun and all that other stuff that everybody else who smoked marijuana but never got caught can still do it's a really big deal i mean it's a it's a huge deal the reason why this is so important is because the war on drugs has led to mass incarceration mass incarceration leads to so many consequences that we may never even consider as we go about our day-to-day lives it makes it very hard to get a job it makes it very hard to get housing it makes it very hard to exist and it becomes this this cycle right you sell drugs you get a criminal conviction you go to get a job you can't get a job what are you gonna do right if you can't get a job or the only job you can get is making seven dollars and 25 cents an hour and you have two or three children to put her to feed and to put a roof over their heads society has seen fit to criminalize something and let's not just say criminalized to over criminalize and let's also be really really accurate about what happens when you make something so forbidden right you invite violence you invite all of this stuff that people say comes from marijuana sales the other thing that's super exciting about this act is that it recognizes very early on in its language the equities involved and just how unfair how racially tilted our drug laws were and i mean it says it right there that this has been a disaster for entire communities of people the thing that i find interesting and it's smart on the part of the government right we we want a lot of things and you need to find money for all of these things and if we're not going to tax the rich and it doesn't seem like we're going to do that anytime soon you've got to find other sources of income we can tax marijuana if it's legal and we can take all of that income and use it for things like free college universal health care we can use it for so many fantastic things people are gonna smoke pot people are gonna sell it it makes sense for our government to finally catch up with the rest or a lot of the the world is already where all of this almost all of the states are i know virginia is one of 15 states that has just passed a bill to fully legalize adult use marijuana they're just getting medical marijuana underway in virginia even though that hasn't started they've already said no no no no we want it full bore straight ahead and that's going to start in 2024 in virginia and they're also going to be expunging people's records which is makes me really happy so what can we do right now right where where are we at we have a majority in the senate by almost nothing what you can do is a couple of things number one i highly recommend going on to the normal website you'll find a link down below for that it's n-o-r-m-l i am a member of the normal legal defense fund and i have been for a really long time this organization has done so much to make sure these laws are understood and not just understood by people who are legalizing marijuana but by people who may not be i liken it a lot to death penalty abolitionists who were really not trying to preach to the choir and were trying to devise arguments that would get people who were really like no no no you know we're gonna kill that person get them on board and so normal is a great organization what they also have on their website is they have links to every single state's laws it has their upcoming bills you should contact your senator contact both of your sons contact everybody senators and tell them that you really really really really really want them to sign on to this bill because it will be life-changing for so many people now here's the thing you don't have to smoke pot or be in favor of weed in order to think to yourself okay this is a thing that people should not go to prison for because trust me people go to prison and they go to prison for decades so don't think of it in terms of yourself and what you feel about marijuana right you don't like it don't smoke it it's really about how we can correct the injustices in our society try to repair although i don't know if you can taking away people's taking away years of people's lives but trying to heal just a tiny tiny little bit the damage that's been done if you like this video give it a
