hi I'm Michele welcome back to finally revealed in this episode I want to talk again about contracts now I know I'm always saying read your contracts if you're not going to read it get someone else to read it for you such as an attorney preferably an attorney who has insurance an attorney who will give you a letter to tell you the salient important parts of the contract so that you can rely on that advice the reason for that is because you should know what you're signing before you sign it the more important the matter is either is a dollar amount or at what's at stake for you or what's an emotional tie to you the slower you should go the more advice you should get and the more carefully you should be there are some legal ways that you can fix a mistake if you did sign something and someone lied to you about it at the beginning or both parties we're completely on the wrong page and made a material mistake and the way that you do this it's a principle called rescission you can rescind based on fraud you can also rescind based on mutual mistake probably the most common type of rescission that people have heard about is in the event of a marriage that was done either under false pretenses or by mutual mistake and that's an annulment and what it is is like a big legal eraser that says we're not getting divorced we're just going to say it never happened we're just erasing it it never happened so parties can agree to rescind a contract which marriage is a contract or one party can go to court and ask the court for that remedy of rescission again it's either based on fraud which is a misrepresentation it's a misrepresentation knowingly made with intent for someone to rely on it that party relied on it they were damaged BAM that's fraud or mutual mistake and you know that in an annulment situation there are different rules on it but overall rescission is either fraud or mutual mistake so I would not rely on these as a way to get out and just say I'll sign anything and I can hopefully I can fix it later or maybe I can call it this or that you should know what you're doing when you get into it but in the event that you do your best to get into a situation and something you don't know about pops up later or both parties are operating under the assumption that something else is going to happen and they're going to be able to perform this contract and they were wrong rescission might be a way out I hope this was helpful to you if it was give me a thumbs up if you have any questions or comments leave them below please subscribe to the page we're getting more subscribers thank you so...
