don't take you seriously so for example proof of claim on how the Oregon Constitution operates upon me a private man okay let's see let's see what proof of claim that in my private capacity I am subject to class A B and a commercial driver's license so basically what they're saying here in your private capacity if you know about the driver's license that it's really only for commercial use so here they're saying that you need to prove to me that I need this in a private capacity so the way they do it is proof of claim that in my private capacity I am subject to class A B and commercial driver's license see this so this is probably one of their codes for laws and here it probably says that in a private capacity a driver's license is not required so this one looks about traveling and not driving if you know about that so here they're stating all the required things right under the law proof of claim that the state of Oregon via the D DMV sells any other driver license proof of claim that my private vehicle is not a recreational vehicle that is operated solely for personal or private use so basically they're saying that you're only using it for private use right you're not here anything that there the law is requiring proof of claim that the secured party has access to lawful money of account to pay debts at Law Without becoming a tort Visa so so they're saying they need to prove that you have access to pay with lawful money of account now do we go around paying with big bars of gold nobody has that right nobody can do that even your where you pay your bills they don't take that so they have to prove that we don't go around paying with gold bars um I don't know how they're going to prove that because we don't you know you could just say like look at all my what they need to approve you know ing to law then um after that you can State any violation so if you're doing like uh bills and stuff like that the main ones where you can find their what they require is under 12 and 16 CFR and that's the truth and lending Act and that's what that looks like and that's where you'll find your proof of claims because under the CFR that's judicial law then once you find your approval claims for whatever you're doing see here's for a collection or a credit card proof of claim that CCC gave full disclosure to all matters dealing with said contract as to the UF U.S bankruptcy form of payment what was loaned okay did they do they ever tell you about the U.S bankruptcy do they ever tell you that they didn't actually loan you money that it was an extension of credit they have to show you proof where they told you all about that or they disclosed that to you so they're going to have to provide that proof um and when they can't that means they can't rebutt it you know because there is no proof you know if they'll need to show you their accounting where they took money out of their bank account and specifically loaned you money like when you when you show me that I want it notarized and signed under penalty of perjury by an accountant so that's how you're getting them and then once you find whatever your situation is under the 12 CFR or the 16 CFR the proof of claims the things that they're um they're required by law to do and they're they're failing to comply you know they're failing to do the full disclosure to tell you about these things that's where they failed you could say this credit card company failed to comply with the requirement of full disclosure and then if you've ever heard of violations those a lot of those are under title 15. or under 15 USC a lot of them under under the 15 USC um so you can find a lot of those there and a lot of violations to these so first you find out where what what they're required by law to do Under the CFR either 12 or 16 there's a lot of them regarding billing and bills and then you find the violations a lot of them under 15 USC there's 1601 and 1640 and there's a lot under 15 USC different ones that you can find so you need the requirement and the violation the violation sometimes that's where you can if you have if you find a where if they didn't read one of the requirements if they're failing to meet a requirement that's when you have a violation and some of the violations pay up to a thousand each so that's where you would look so make sure you do do a proof of claim as you can see they start off just by saying I am in receipt and judicially accept the value your letter entitled demand payment for debt reference number okay let's come to my attention that has applied to the above Banner that there not has been a true qualified meeting of the minds so in order to perhaps to have a contract you do have to have meaning of the minds you have to have um equal consideration equal consideration is where you're giving your signature because that's what gives you the credit and they're giving you something of value but as we know they're just extending you your own credit there they actually never gave you anything so there is no equal consideration and also there must be a meeting of the minds if you read um meet your straw man which is a fraud or misrepresentation on the contract or the contract itself is an unconscionable contract or other controversies that may exist in the contract as I want to resolve this matter as soon as possible I am initiating this private administrative remedy to determine such matters and I agreed to continue making payments predicated upon your proof of claim so you're saying you'll you'll start then this is the last page you kind of sum it up here and over here is where you sign and you see how they have the notary because the notary stands for a witness in court so if you do this when you're doing the administrative process it's like they they're like your witness so in a court or arbitration or mediation this would count as a witness okay this is another example of a they have three examples here of conditional acceptances this is like our next step after you sent your cover letter you've sent your thing and make sure in the cover letter you tell them that they're not supposed to take adverse action against you because that would be one of the requirements right that they would be violating if they did do that so here is another one see they put 34 proof claim a lot of people asked me about this so I just wanted to show you kind of an example of what this looks like so after that you know they're supposed to prove all those things right rebut this could this could be um what do they call these sometimes um this is a conditional acceptance proof of claim but some people call it conditional acceptance affidavit or something like that because the affidavit they would have to rebut all this point by point if they cannot then it stands as truth in Commerce so after the after it's been like 20 days or 10 days or whatever you required them then it's like and they haven't sent you they could have sent you some papers or a statement but that's not what you're asking for you're asking for them to show you actually real proof of these claims you're making right so now they haven't responded in a sufficient way next thing you can send them the notice of fault and the opportunity to cure so this is their opportunity to make it right before you proceed this is the administrative process right so they're kind of like they're in default right this is their last opportunity to make it right send you the proof show you that they're not doing this but the thing is they are doing it so they probably aren't going to be able to send the proof and then the last thing is the Affidavit of notice of default so this is what it looks like and this is one you got them in default and you need the signature and the notary so once you've done all that um that's like the administrative process you can either report them to the CFB or you can go to the court or the arbitration that's the next step and you would have to contact their registered agent to do that so anyway I just wanted to review that with you just to show you what the letters will start to look like as you start to do the administrative process
